, ; Proposition.64 has been written and sponsored by the marijuana
industry and out-of-state pro drug-legalizing billionaires
,� .
• Although it is 62 pages in length, the Proaosition 64,does little to reaulate or control
mariivana distribution in California. Creating'supply chain definitions does not constitute
' regulation, nor does identifying a"few violations that cost practically nothing if incurred—
� $100, $200. But most egregiously, allowing 6 plants in every home or apartment in
California undermines any attempt,to•regulate or control distribution.
' • Proposition 64 allows the mariivana industrv to advertise on TV and elsewhere,
overtur,ning decades of.bans on,advertising smoking pcoducts and;behavioc.;, -,., r. ; �.,•,
• Proaosition 64 creates,a scenario where a maiocitv�of�mariivana product can ao:untaxed.

• The Proposition 64 does very little to protect vouth. By its ve,ry nature,(6 plants in every

home), the AUMA makes massive amounts of unregulated marijuana available to 12-17
' and 18-25 year oids. These are the most vulnerable members of society to marijuana's
� brain degrading characteristics. Setting a purchase age limit of 21 irnot�a grand�regulatory
accomplishment, nor does it protect the still vulnerable 21-25 year old user. Similarly,,a

small fine fo�selling fo miriors is not a comm`itment to p�otecting California's youth. Lastly,
all forms of advertising is permitted, e.g. billboards— millions of California minors drive and
ride in cars on our highways every dayi How are they protected from,these,messages?,,:�
• The Proaosition 64 does little to arotect the health of other users. It outlines an
inadequate set of labeling and testing.requirements._Ihen it.sets forth_what we.have come
� to call the "Unreasonably Impractical clause." This vague language is not a standard, but an
invitation.to litigation.by_the_marijuana.indust .ry to'eliminate�these"requi�ements#eritirely.
• The Proposition 64 commandeers a maioritv of the aroiected tax revenues for the first SO

years�of its�existence,-leaving a) public heaith education,-b) increased law enforcement and
� c) environmental protection, which it claims to provide, unfunded. This, along with the
ability to reduce taxes altogetFie�,'leaves all�public=protection oriented�spending at serious
risk. ' .

• The Proaosition 64 eliminates local control of indoor and outdoor cultivation and mobile
delivery as it makes every home or apartment a grow site capable of producing 6 plants or
the equivalent of producing over 6,000 joints. It undermines eliminates local land-use:. •
authority and transforms all city and county governments into agents for the marijuana
industry.
• The Proposition 64 does nothine to protect the public aeainst drus-imaaired drivers.
Marijuana-impaired driving fatalities doubled in Washington in one vear.
• The Proposition 64 will do nothinQ to reduce dru2 crime or the black market. 40% of
marijuana sold in Colorado is untaxed black market marijuana.
