I. RECITALS
A. Project Site
W"HEREAS,the azea of land that is the subject of this Ordinance is diaarammaticall}�
represented in Exhibit A attached hereto and incorporated into this Ordinance; and
commonh�known as the Eastem Urban Center(EUC),and for the purpose ofgeneral
description herein consists of 207 acres located adjacent to and east of SR-12�,
adjacent to and west of Eastlake Pazk���a��. south of Birch Road and the Ota}�Ranch
ToHn Center, and north of the future extension of]�4ain Street (`Project Site"); and
B. Project; Application for Discretionan Approvals
V�%HEREAS. a duh �erified application was filed with the Cin� of Chula Vista
Development Services Department on June 29, 201� by SLF IV-Millenia, LLC(the
"Applicant.""O�mer`and"Developer'requestine 1)appro�-al of an EUC Sectionai
Planning Area (SPA) Plan and Form Based Code (FBC) amendment to relocate the
primarv school site from District 9 to District �: and 2) clazif��ing the appro��al
process for the deletion of street segments and for the appro��al of the Pazkine
Manaeement Plan ��ithin Milienia: and
C. PriorDiscretionan Appro�als
«'HEREAS, the SPA plan approved b}�the City in September of 2009 included tHo
potential school sites: A preferred sis acre site in the South-Central Residential
District(District 9)and an altemative site in the South���estern\'eighborhood District
(District 10)should the priman�site be rejected by the School District In September
2012, the School District provided formal confirmation that the altemative site in
District ]0�cas no lonser needed; therefore, in March 2013 a SPA plan amendment
induded the elimination of the alternati��e school site (Resolution 20li-038 and
ordinance 32�7); and

D. Environmental Determination
WHEREAS. the Director of Development Services has reviewed the proposed
project for compliance with the California Environmental Qualiry Act(CEQA) and
has determined that the project was covered in previously adopted Final Second Tier
Environmental Impact Report, E1R 07-01. The Director of Development Services
has determined that only minor technical changes or additions to this document are
necessary and that none of the conditions described in Section 15162 and 15164 of
the State CEQA Guidelines calling for the preparation of a subsequent document
have occurred; therefore, the Director of Development Services has prepared an
addendum to the Final Second Tier Environmental Impact Report, EIR 07-01; and
WHEREAS, the Cit}� Council finds that the Addendum (IS ]5-0003) to EIR 07-01
has been prepared in accordance with the requirements of CEQA, and the
Environmental Procedures of the City of Chula Vista; and
E. Planning Commission Record of Application
VdHEREAS, the Director of Development Services set the time and place for a
hearing on the Project, and notice ofthe hearing,together with its purpose,was given
by its publication in a newspaper of general circulation in the City,and its mailing to
properq� o���ners within 500 feet of the eaterior boundary of the Project Site at least
ten (]0) days prior to the hearing; and
WI IEREAS, the Planning Commission held an advertised public hearing on July 13,
2016, on the Project to adopt Resolution MPA15-0009 recommending that the Ciry
Council amend the EUC SPA Plan; and
Vl'I-IEREAS, the proceedings and all evidence introduced before the Planning
Commission at the public hearing on the Project and the minutes and Resolution
resulting therefrom, are incorporated into the record of this proceeding; and
F. City Council Record of Application
VdHEREAS; the Cit}� Clerk set the time and place for the hearing on the Project
application and notices of said hearina, together with its purposes given by its
publication in a newspaper of general circulation in the City,and its mailing to property
owners within �00 feet of the exterior boundaries of the Project Site at least ten (10)
da}�s prior to the hearing; and
VdHEREAS;the dulv noticed and called public hearino on the Project N�as held before
the Ciq'Council in the Counci] Chambers in the City Hall, Chula Vista Ci��ic Center,
276 Fourth Avenue.to receive the recommendations ofthe Plannin,Commission,and
to hear public testimom�with regard to the same. y

Il. NOW THEREFORE. the Cirv Council of the Cin� of Chula Vista does herebv find.
determine and ordain as folloN�s:
A. CONSISTEI�'CY �i'ITH GENERAL PLAI�'
The Ciri� Council finds that the proposed amendment to the EUC Planned
Communirv District Reeulations and Form Based Code are consistent«ith the Cirv
of Chula Vista General Plan. The General Plan contains a "floatine" location for a
required elementan- school within the overall 207-acre EUC�The proposed
amendment is to allo���for the relocation of the priman�school site from District 9 to
District �. The deletion of a seement of A4ontaae Avenue is consistent H°ith the
General Plan in that it is not considered a circulation element road. The appro�al
authorin� for future street deletions and for the Parkins n4anaeement Plan is
administrati��e in narure and therefore is also consistent�ith the General Plan. The
adoption of parking rates���ill replace esisting pazkina rates alreadv established in the
SPA.
B. APPROVAL OF PROPOSED .Ab4Ei�'DMENTS
The Cin� Council hereb�� approves the amendments to the Eastern Urban Center
Planned Communit��District Resulations and Desi�n Guidelines(Form Based Code)
as represented in Ezhibit B attached hereto and incorporated herein bv this reference.
III. EFFECTIVE DATE
This ordinance shall tal:e effect and be in full force on the thirtieth da} from and afrer its adoption.

Chapter 02 District Regulations and Design Guidelines
02.00.000 Purpose and Intent
The purpose of this Chapter is to provide rewlations and design euidelines for e of the ten
EUC Districts. It is intended that these rewlations and guidelines are used to pplement the
other requiremenu in the FBC and rzlated documenu.
This Chapter identifies si� dominant land use cateeories and each of th UC districts that fall

03.15.001 Parking Principles:

03.15.002 Pazkin? Requiremenu - General:
Pazking space requiremenu shall be as provided for herein, or as dzterrmned-byconsistent
«�ith an approved Pazkine Management Plan.The Parking Management Plan shall consider
shazed pazking opportunicies and time of day and day of the week differences in peak
pazking demand to accurately project the total amoun[ of pazking required to meet total
demand at any one time. All available on-street parldng spaces shall be counted towards
saiisfying a project's total required parkine.
The Director of Development Services shall approve and adopt the Parking Management
Plan, - .

shall incorporate the pazkin�rates adopted bv Citv Council Ordinance V and reflected
in Table III-A herein. Once the Parkine Manaeement Plan is adopted, all subsequent
revisions to parldne rates in Table III-A.herein and in the Parkine Manaeement Plan, shall
require prior review and avoroval bv the Plannin� Commission until such time as the
Parkine Di strict Council transfers from the Master Develo�er to the Communirv Association.
Followin2 this transfer. further revisions to oarkine rates shall be approved bv the Director
of Develonmednt Services.
03.15.003 Parkine Rates:
�educed Pazkin2$ase Rates: Table III-A(Parkin�Rates)for the EliC are established based
on the follo�ti�ng national parking standards.These standards are intended to be implemented
in conjunction with the approved Pazkins Management Plan.In ca]culating required parking
for a simgle use,the highest number ofparldng spaces(weekday vs. weekend)shall be used.
For mi�ed use, multiple use or shared use scenarios the sum of the required spaces for all
uses shall be determined for both the weekday and weekend scenarios,with the Iarger ofthe
tw�o goveming.
For uses not identified in the table belo�v, parking rates shall be determined by using the
provisions oudined in General Note 3 of Table IIT A wi[h appropriate adjustments made by
a registered traffic eneineer to account for the mixed use and transit-oriented narure of the
EUC.
