LLC FOR THE CONSTRUCT]ON OF TRAFFIC SIGNAL ID4PROVEMEI�'TS II�' THE MILLENIA PROJECT AND PROVIDII�'G TRANSPORTATIO\ DEVELOPMENT IMPACT FEE AI�'D TRAFF[C SIGI�'AL FEE CREDIT FOR ELIGIBLE EXPEI�'SES R'�I-IEREAS. SLF IV-Millenia. LLC (De�eloper)_ the ow�ners of the Millenia project have constructed a number of vaffic signals and portions of future traffic signals within the Millenia project and �+�ill construct other sienals and portions of signals as part of the remaining phases of development in the project: and R'HEREAS. the De��eloper has submitted t��o reimbursement requests to the Citv: Request =1 in the amount of 5280,276.69 for Eastlal:e ParkH-ay at Stvlus Street (location #9) and at the Bus Rapid Transit (BRT) Guide�va�� (location '.`li) and Request #Z in the amount of 591.468 for BRT comdor signals at Orion Avenue/\'orth Drive�va�� (location ;=10) and Solstice Street (location �11); and WHEREAS, the Resolution reimburses the developer b}� pro��iding de��elopment fee credit for elieible traffic signal ���ork and appurtenances throush the City`s Transportation Development lmpact Fee (TDIF) Proeram and the Cih-`s Traffic�Signal Impact Fee Program; and V�'HEREAS, in accordance ���ith the Chula Vista TDIF Program, traffic sienals on major road�vavs identified �i�ithin the TDIF program, aze eligible for TDIF credit once the City has audited the expenses; and WHEREAS. if the signal is not on a TDIF road���ay. eligible expenses can be credited through the Traffic Signal Impact Fee Program: and WHEREAS, as part of the implementation of the City's TDIF and Traffic Signal Impact Fee Programs, staff evaluates reimbursement requests from de��elopers in the Cit�� to ensure that all costs aze qualif}ine costs under the Cit��'s respective fee proerams; and �1'HEREAS. in accordance ���ith the TDIF policy, since Eastlake Park���ay is a TDIF facilit�� and Stylus Sveet is not, the reimbursement of TD[F eligible expenses will be split at �0% TDIF and �0% Traffic Signal Impact Fee since half of the intersection approaches are on a TDIF facilit��: and \VHEREAS, the e�penses related to the BR7� Transit Guide�va}� are not TDIF elieible and �ti�ill be credited onlv throu�h the Traffic Si�nal Impact Fee Program; and Resolution No. 2016-168 Page No. 2 WHEREAS, the signal at Eastlake Parkway/Srylus Street (location #9) was quoted a price of$201,000 plus a change order for $826.69 for traffic signal equipment related to wiring and a signal controller (Eahibit 1) and the same exhibit refers to two bid items, totaling $66,000 (Bid Items #4 & #5); for $45,000 and $21;000, respectively for undergrounding conduit to cross the BRT transit guideway plus foundation work at the Stylus Street location for a total construction cost of$267.826.69: and WHEREAS; there are also engineering costs of$10,975.00 related to this work; as such, the total reimbursement sought b}� the Developer for Request#1 is $278,801.69; and WHEREAS, the City's policies for reimbursement require that all projects be competitively bid and that any project ���ith a change order eaceeding $50,000 be brought to the Citv Council for approval and reimbursement Request #1 is a change order which was added by the de��eloper to an eaisting, competitively bid Millenia signal contract; and WHEREAS, the signal modification at the intersection of Eastlake Parkwa}�/Stylus Street (]ocation #9) is also in very close proximity to the signal with the BRT Guide��ay (location #]3) and as such, both signalized locations aze operating as one larger intersection with additional signal equipment necessary for the two locations; and WHEREAS; based on the above, any BRT related underground equipment for sienal systems which are being installed in ad��ance of the BRT system operating will be reimbursed via the Traffic Signal Impact Fee; and WHEREAS, although the Developer submitted expenses totaling $278;801.69, for signal #9, it should be noted that, based on the cost of comparable signals, staff recommends reimbursement for the construction costs of the traffic signal at Eastlake Parkway/St}�lus Street (location # 9) in the amount of$206,975 because afrer careful review, staff found this amount to be consistent with other similarly configured signals in Millenia; and WHEREAS; the $206,97� reimbursement for location #9 shall be $103,487 in credit from the TD[F Program and $103;488 in credit from the Traffic Signal Impact Fee Program; and WHGREAS, based on the above, the total eligible reimbursement total for Request #1 will be $206,97�; and WHEREAS, the Developer's Request #2 is for reimbursement of signal related expenses on the Bus Rapid Transit corridor signals at Orion Avenue/North Driveway (location #]0) and Solstice Street (location #11); and WHEREAS, as part of the construction of the planned streets in Millenia, the developers are required, pursuant to a specific mitigation measure in tlie project Environmental Impact Report (GIR), to place conduits along Yhe corridor, not just at intersections, this requirement is intended to facilitate the fumre construction of BRT corridor traffic signals by SANDAG and due to the fact that the de��eloproent phasing and street construction is often well in advance of SANDAG's planned ser��icc, SANDAG �n�ill not reimburse the Developer for those future facilities early: and Resolution?�'o. 2016-168 Pa�e?�'o. 3 V�%HEREAS; should the Developer have ti�anted to preserve their rieht to future reimbursement, the} ���ould ha��e had to publich� bid, at pre��ailine wa2e rates, the full street impro��ements; which would ha��e resulted in cost increases to the Developer ���ell in e�cess of the requested reimbursement amounts; and A'HEREAS, it is in the public`s best interest to have the conduit installed N•ith the initial street infrastncture now in order to avoid ha��ins the street pa��ement section trenched in the future ��hen BRT sen•ice is planned and the traffic sienals are needed since it is more cost effective and less disruptive to the public to install these facilities now and the conduit �vhich is placed ui11 be o�ned b}� the City and a�ailable for the Cit�� s use, ���hich could indude placing infrastructure needed to support the Smart Cities Initiati��e and signal s��stems communications; and �'�'HEREAS. the Cit}� can pursue reimbursement from SA\'DAG for use of the conduits ���hen SA?�'DAG completes the BRT signal construction; and A'HEREAS, the De��eloper is requesting reimbursement for t�vo sienalized intersections needed for the BRT sen�ice ���hich includes 5�3.2�43 for intersection #10 and �38?2� for intersection .'—.`1L for a total reimbursement request of �91.468 for engineerine, adminisvation - and construction costs: and W"HEREAS. anv future work related to these sienalized locations H�ill not be reimbursed bv the Cit�� of Chula Vista since the�� are needed yfor the BRT service so no additional reimbursement requests ���ill be accepted for these hao intersections as they �+�ill be completed and funded bv SANDAG: and R'HEREAS, staff is recommending the appro��al of the requested reimbursement "Request #2" in the amount of �91,468, to be allocated to the Traffic Sienal Impact Fee Program.
