RESOLUTION OF THE CITY COUivCIL OF THE CITI' OF
CHliLA VISTA APPROVING A TRASH .ASSESSMEI�TT
BASELII�'E STUDY AND STRUCTURAL BMP FEASIB[LITY
REPORT CONSULTII�'G SERVICES AGREEME?�TT BETA'EEN
THE CITI' A1�TD D-AtiAX E\GINEERII�'G INC. AND
AUTHORIZING THE CITY MAI�'AGER TO APPROVE UP TO
TW'O OI�'E-YEAR EX7ENSIONS TO SAID AGREEMENT
�i'HEREAS. the State and Reoional V�'ater Boazds ha��e focused on reducine pollutants
(including trash) in storm water runoff through technolog�� and �vater qualit}� based controls in
I�'PDES permits for o��er 20 ��eazs; and
R'HEREAS, despite these controls and efforts, vash continues to be an ongoine problem
across the State: and
«'HEREAS, trash is harmful to the State`s ��ater resources. impairs surface water
beneficial uses and violates water qualit�� objecti�es. Trash is unsiehth�, destro��s sensitive
habitat, harms aquatic life and �ti�ildlife at all le��els in the food web. and spreads contaeion that
threatens human health. creates obswctions, and poses sw�immine hazards; and
WHEREAS, on April 7, 201�, the State �1%ater Resources Control Boazd (SWRCB)
adopted amendments to the N'ater Qualit}� Convol Plans for Ocean «'aters of California and for
the Inland Surface Water, Enclosed Ba}�s, and Estuaries of California for Trash (Trash
Amendments); and
R'HEREAS. the Trash Amendments were subsequentl}� appro��ed by the Office of
Administrative La�� (OAL) on December 2, 201�, and United States Envirorunental Protection
Aeencv (USEPA) on Januarv 12, 2016; and
V�'HEREAS; the Citv of Chula Vista is required to comply ���ith the Trash Amendments
by conductine a Baseline Smd��. de��elopine a Structural BA4P Feasibility Repon and selectine
one of n��o compliance "tracks ; and
WHEREAS. failure to compl}� H�ith the Trash Amendments or V1'ater Qualit��
Impro��ement Plan (Vl'QIP) requirements w�ould e�pose the Cih� to enforcement action b}� the
Regional Board and/or third-party la�+�suits; and
�\'HEREAS. in addition to the Trash amendment requirements; the Cit� of Chula Vista
has also committed to numeric ooals related to physical aesthetics in the San Dieeo Ba�� \1%QIP:

WHEREAS, the studv and report wil] assist the City in determining the most appropriate
track to select in order to meet the goal and schedule requirements for both the Trash
Amendments and the San Diego Bay WQIP; and
WHEREAS, since the fumre cost to comply with the Trash Amendments and the WQIP
is expected to be significant; selecting the most cost effective track is essential; and
WHEREAS, due to the expertise and experience necessary to perform a Baseline Study
and Feasibility Report, staff executed a Request for Proposal to solicit the assistance of qualified
engineering and em�ironmental consulting firms; and
WHEREAS,- in accordance ��th City Purchasing Guidelines, on April 29, 2016, the
Public Works Engineering Depariment advertised a Request for Proposal (RFP) for consultant
services to conduct Trash Assessmerit Baseline Study.and Structural BMP Feasibility Report
Services for Fiscal Year ZOl6/2017; and
WHEREAS; the following four consultants submitted proposals:
• D-Max Engineering,Inc.
• Geosyntec Consultants
• Michael Baker International
• LaRoc En��ironmental
WHEREAS, afrer careful consideration of consultant qualifications and experience, and
based on a scoring system developed for this purpose, the Selection Committee determined that
D-MAX Engineering; Inc. (D-MAX) was the most qualified firm to conduct Trash Assessment
Baseline Study and Structural BMP Feasibilit}� Report Services; and
WHEREAS, D-MAX has partnered with subconsultant, Larry Walker Associates, Inc.
(LWA), creating an interdisciplinary project team with extensive practical experience and
technical e�pertise in compl}�ing H�ith the requirements of the State Trash Amendments and the
applicable trash control goals; strategies, and schedules detailed in the San Diego Bay WQIP;
and
WHEREAS; the initial agreement will be for one year from Council approval date to
August 31, 2017; and
WHEREAS, provisions are included allowing the agreement to be extended at the City's
sole discretion for two additional one-year ternis; and
WHEREAS, if the City e�eroises an option to eatend, each extension shall be on the
same terms and conditions contained in the agreement, provided that the amounts specified in
section 3.A of the Agreement_ may be increased by up to 5`% for each extension, at the discretion
of the City ManaRer or his designee; and

WHEREAS. the Cin� shall Qi�e H�ritten notice to Consultant of the Cin�'s election to
exercise its option to extend in a letter signed b� the Citv Manager, or designee. Such notice
shail be provided at least 60 da��s prior to the expiration of the term; and
N'HEREAS. the Development Sen�ices Director has re��iewed the proposed project for
compliance ��ith the Califomia En��ironmental Qualit�� Act (CEQA) and has determined that the
acti��itv is not a "Projecr' as defined under Section 1�378 of the State CEQA Guidelines because
it w�ll not result in a ph��sical chanee in the en��ironmenr. therefore. pursuant to Section
1�060(c)(3) of the State CEQA Guidelines, the acti��it�� is not subject to the CEQA.
Not�vithstandine the foregoing it has also been determined that there is no possibilit}� that the
acti��itv may ha��e a significant effect on the environment therefore, pursuant to Section
1�061(b)(3) of the State CEQA Guidelines, the activin• is not subject to the CEQA. Thus, no
environmental revie��� is required.
NOW. THEREFORE. BE IT RESOLVED b�� the Cit�� Council of the Citv of Chula
Vista, that it appro��es the Trash Assessment Baseline Studv and Structural BMP Feasibilit}�
Report Consulting Sen�ices Agreement; bet��=een the Cit�� and D-A4ax Eneineerine [nc., in the
form presented. with such minor modifications as ma�� be required or approvedyby the Cit��
Attorne��, a cop}� of�+�hich shall be kept on file in the Office of the Citv Clerk, and authorizes and
directs the I�4avor to eaecute same.
BE IT FURTHER RESOL\%ED bv the Citv Council of the Citv of Chula Vista that it
authorizes the Cit�� Manager to appro��e up to t�ti�o one-��ear eatensions to said Aareement.
