MOTOR VEHICLES AND TRAFFIC �� Article I . General Provisions '- Section 19 . 1. 1. Short Title. This chapter shall be known :i •„ , 4 ` ' • ;and may be cited as the "Traffic Code. " 3 , � 1 . . `: Section 19 . 1. 2 . Intent and Purposes . It is the intent of - � t � the City Council in adopting this ordinance to provide a convenient ? _ 'compilation of the rules and requlations governing and controlling � � Y � ` the movement of motor:.vehicles and traffic in the City of Chula Vista. %.; _ �, : .. ' 'These rules and regulat2ons are further intended to supplement the r " regulations contained in the Vehicle Code of the State of California � ' '� ��� in those instances where the subject matter is not covered by state traffic laws , and to enact local regulations where express power is i;: i . granted to local authorities to control particular subject matter. s It is the purpose of this ordinance to provide standards and guide . ;` � lines for the administration of motor vehicles and traffic regulations ,i for those departments charged with such responsibility in the City i ,, of Chula Vista. Certain definitions and regulations contained herein � � � incorporate the exact language of the Vehicle Code of the State of o- California and should be cited with reference to the Code Sections f. t �; ; , , of the Vehicle Code as indicated. If any definitions or regulations >: � . �� are not contained herein, or if definitions or regulations contained ; • ;; :. ' ' herein are inconsistent with the Vehicle Code, such definitions or Y-' ' ,4' " regulations as found in the Vehicle Code as it exists or as it may ;ue. Words and phrases defined herein in the language of the � a�, : ; Vehicle Code of the State of California shall be cited by the section �;. , �umber of said Vehicle Code as indicated. Whenever any words or �� P . phrases used herein are not defined but are defined in the Vehicle � �. .: Code and amendments thereto, such definitions shall apply. � (a) "A11ey" . Any public highway having a roadway not exceeding twenty-five (25) feet in width, which is primarily used ; w G. for access to the rear or side entrances of abutting property. (Cite � ; z i : S�ction 110 Veh.C.A. ) � f � � � . t , (b) "Bicycle" . Any device propelled by human power upon ; " which any person may ride , having two tandem wheels , either of which � • is more than twenty (20) inches in diameter. (Cite Section 21200 : Veh.C .A. ) ' (c) "Bus" . An� motor vehicle, other than a motor truck or � , truck tractor, designed for carrying more than nine persons including � . i t the driver and used and maintained for the transportation of passengers . � _ (Cite Section 233 Veh.C.A. ) ,� � (d) "Bus Loading Zone" . The space adjacent to a curb or � ,i edge of roadway reserved for the exclusive use of buses during loading ' and unloading passengers . ' ` (e) "Business District" . That portion of a highway and the I property contiguous thereto (1) upon one side of which highway, for a disfance of 600 feet, 50 percent or more of the contiguous p'roperty � : fronting thereon is occupied by buildinqs in use for business , or (2) 4 + . upon both sides of which highway, collectively, for a distance of , � / 300 feet, 50 percent�or more of the contiguous property fronting � thereon is so occupied. A business district may be longer �han the , { , . - . � distances specified if the above ratio of buildings in use for business � t ; : to the length of the highway exists . (Cite Section 235 Veh.C. ) � - (f) "COUncil" . The Council of the City of Chula Vista. t , { � (g) "Crosswalk" . (1) That portion of a roadway included , I ' f ; within the prolongation or connection of the boundary lines of side- . ; { } walks at intersections where the intersecting roadways meet at � � . , ; � approximately right angles , except the prolongation of such lines ; � 1 ' from an alley across a street, or (2) any portion of a roadway � _ - 'z- � .. "s � � � � � ; � . � ' �� distinctly indicated for pedestrians crossing by lines or other markings on the surface . Nothwithstanding the foregoing provisions of this section, there shall not be a crosswalk where local authorities ' have placed signs indicating no crossing . (Cite Section 275 Veh .C. ) . (h) "Curb" . The lateral boundary of the roadway whether such curb be marked by curbing construetion, or not so marked; the word "curb" as herein used shall not include the line dividing tlie j roadway of a street from parking strips in the center of a street a � � or from tracks or rights-of-way of public utility companies . (i) "Divisional Island" . A raised island located in the roadway and separating opposing or conflicting streams of traffic. (j) r"Holidays" . Within the meaning of this chapter, holidays are the first day of January, the twelfth day of February, the twenty- � � second day of February, the thirtieth day of May, the fourth day of July, the first Monday in September, the ninth day of September, y the twelfth day of October, the eleventh day of November, the tcaenty- � fifth day of December and Thanksgiving Day. If any of the above . � T' � holidays , with the exception of Thanksgiving Day arid Labor Day, falls ' upon a Sunday, the Monday following is a holiday.l (k) "Loading Zone" . The space adjacent to a curb reserved 3 � for the exclusive use of vehicles during the loading or unloading of passengers or materials . � ' (1) "Official Time Standard" . Whenever certain hours are s � ' ' named herein, they shall mean standard time or daylight saving time, i i 1 as may be in current use in this City. f ' ' (m) "Park or Parking" shall mean the standing of a vehicle, ; whether occupied or not, otherwise than temporarily for the purpose � . ' of and while actually engaged in loading or unloading merchandise or j ! passengers . (Cite Section 463 Veh.C.A. ) r � F (n) "Parking Meter" . A mechanical device installed within. ii or upon the curb or sidewalk area, immediately adjacent to a parking � space, for the purpose of controlling the period of time for the % occupancy of such parking space by any vehicle. ; i ; 4 (o) "Parkway" . That portion of a street other than a road- t < ' ;' way or a sidewalk. i3 , (p) "Passenger Loading Zone" . The space adjacent to a curb ; �� reserved for the exclusive use of vehicles during the loading or un- �3 , � � . loading of passenqers . _ , � � ' (q) . "Pedestrian. " Any person afoot. � f. . (r) "Police Officer" . Every officer of the Police Department , � of the City of Chu1a Vista or any officer authorized to direct or ' k regulate traffic or to make arrests for violations of traffic � regulations. (s) "Stop, or Stopping" when prohibited, shall mean any cessation of movement of a vehicle, whether occupied or not, except j when necessary to avoid conflict with other traffic or in compliance = with the direction of a police officer or official traffic control � , � - device or signal . , (t) "Taxicab Stand" . A space adjacent to a curb reserved for taxicabs to stand and wait for passengers . i (u) "Vehicle Code" . The Vehicle Code of the State of California, as amended. ;; Article II . Traffic Administration � Section 19 . 2 . 1. Duties of the Police Department � � The Police Department shall � ;� (a) Enforce the provisions of this Traffic Code and all the ! r f . State vehicle laws applicable to street traffic in this City, to make t ' arrests for traffic violations , to investigate traffic accidents and A � to cooperate with the City Engineer and other officers of the City in � � � � the administration of the traffic laws and in developing ways and y means to improve traffic conditions and to carry out those duties � i ; imposed upon said Department by this Chapter, and i (b) Cooperate with the City Engineer in conducting studies f � of high accident frequency locations and determining remedial measures, I 3 } and � i (c) Maintain a suitable system of filing traffic accident , r reports . Accidents , reports or cards referring to them shall be � f ` � . � i filed alphabetically by location. Such reports shall be available , � ' for the use and information of the City Engineer, and � r ; . 1 f ; � (d) Prepare annually a traffic report which shall be filed � � { A � with the City Council . Such a report shall contain information on ' traffic matters in this City as follows : � � I ;. 1. The number of traffic accidents , the number of people � t � i : killed, the number of persons injured and other pertinent i ! i j traffic accident data; � � 3 E1' . ? �i � ^ �, 2 . The number of traffic accidents investigated and �� i ''y ' other pertinent data on the safety activities of the Police Department; . � 1 ; 3. The plans and recommendations of the Department for � ; future traffic safety activities . I Section 19 . 2 . 2 . Duties of the City Engineer � r The City Engineer shall; i , (a) Determine the installation, proper timing and maintenance � 1 � of official traffic control devices , to conduct engineering analysis of traffic accidents , and to devise remedial measures , to conduct engineering investigation of traffic conditions , and to cooperate with other City officials in the development of ways and means to improve traffic conditions . Whenever, by the provisions of this Code, a power is granted :to the City Engineer or a duty imposed upon him, � the power may be exercised or the duty performed by his deputy or by • ' • a person authorized in writing by him. Whenever the City Engineer i1 � ; '' makes a determination authorized by this Chapter, pursuant to the � _ � j ;! provisions of the California Vehicle Code, the violation of which - is � �. a misdemeanor, said determination shall promptly be filed in writing , : �� by the City Engineer with the City Clerk and the Chief of Police, so � � y that enforcing officials shall be aware of any changes or modifications ��' ` S of regulatory determinations , and I, '; `'� (b) Initiate and recommend necessary legislation for the �� % F i . �`• -` efficient operation of traffic and the prevention of traffic accidents , i . >1 and � ,, i � .� (c) Maintain schedules relating to the parking of vehicles , � ; 'E direction of movement of traffic, speed zone, through highcaays , truck �, :i� € routes, and stop signs on City streets as provided by ordinances or f s-t ' � si` resolutions approved and regulations promulaged pursuant to this Code. ; � 3 Section 19 . 2 . 3 . Emergency and Trial Regulations . ,�; <z � ,• � j�, (a) The Police Department is empowered to enforce regulations �_ � t necess:ary to make effective the provisions of this Code. In the event ' : � ; !` ; of fire, emergency or special events the Police Department is empowered ' �- .' , to establish and enforce temporary traffic regulations . '� � ' I, , ': � -5- I � I � ;� 3 If � �� � � �i � � � '. (b) For the purpose of minimizing traffic hazards and (� , .� traffic congestion and for the promotion of public safety , the City p , '� Engineer is authorized to establish any traffic regulation for a � trial period of eight months; provided that (1) prior to the commence- � - , . i :. ment of any trial period a copy of the proposed regulation shall be " i . sent by the City Engineer to the Council, together with a statement 4 � . . ` of the reasons therefor;: and (2) such trial period shall begin upon � ' � t the posting of signs or other appropriate notices to the public . , � • (c) If a resolution embodying such regulation, or any part , � ' thereof, is not approved after the eight-month trial period, such . � i regulation shall cease to be effective. { . (d) The City Engineer may test traffic-control devices , under actual traffic conditions . "s ' E (e) Resolutions to control the direction of movement of ; traffic and the parking of vehicles on streets within the City shall > . be enacted pursuant to the authority of this section. t Article III . Enforcement and Obedience to Traffic Regulations. I� Section 19 . 3 . 1. Authority of Police and Fire Depar,tment Officials . �'.`� �. - � :; (a) Officers of the Police Department and such officers as � � � ;� are assigned by the Chief of Police are hereby authorized to direct ' �` all traffic by voice , hand, audible or other signal , in conformance �` ` +rr with traffic laws , except that in the event of a fire or other emergency ; x �, f: or to expedite traffic or to safeguard pedestrians , officers of the 4, :' l , Police Department or members of the Fire Department may direct traffic c � as conditions may require, nothwithstanding the provisions to the {� ` ' � contrary contained in this chapter or the Vehicle Code. � I (b) No person other than an officer of the Police Department r , i , or members of the Fire Department or a person authorized by the Chief t � of Police or a person authorized by law shall direct or attempt to �. ; �, ; direct traffic, by voice , hand, or other signal, except that persons } - {� i ; may operate , when and as herein provided, any mechanical pushbutton . f; ;'. � � signal erected by the City Engineer. � ' (c) No person shall fail or refuse to comply with any lawful { ' � � order, signal or direction of a traffic or Police Officer or a member ': i j: ; � of the Fire Department or a person authorized by the Chief of Police or i �; t' ' by law. ! ; -6- g 73 I ' (d) At places where large numbers of people and vehicles � '} � ' are to gather or have gathered, nothing in this chapter shall be i� f t Y_ construed to prevent any police officer from prohibiting any person yl , � ' from parking any vehicle upon or using any street or sidewalk, or ;�I � from prohibiting any pedestrian from using any street or sidewalk , and � � . ' T : said police officer shall have authority to direct the parking of vehicles in any reasonable manner, way or direction, and it is (, . { hereby declared to be unlawful for any person to fail to promptly .Y :'. I � , obey said police officer ' s order, signal or command, regardless of :i ; ' 3 " any other provision of this chapter . � : ; � Section 19 . 3 . 2 . Required Obedience to Traffic Regulations . f (a) It is a misdemeanor for any person driving any vehicle � . , '� or other conveyance upon any street, or any pedestrian, to do any � ' act forbidden, or to fail to perform any act required under this � - . chapter. j; (b) No person sha11 interfere with or obstruct in any way � �` � � ,' i any police officer or _other officer or employee of this City in their y : enforcement of the provisions of this chapter. The removal, obliteration , -� I�. �• ' or concealment of any chalk mark or other distinguishing mark used by �, ;; ,= � '<, any Police Officer or other employee or officer of this City in � �+ ' connection with the enforcement of the parking regulations of this j, �. ,'� `� 1 chapter shall, if done for the purpose of evading the provisions of ' ; this chapter, constitute such interference or obstruction. (, � i �. , �. (c) The provisions of this chapter shall apply to the P' : � operator of any vehicle owned by or used in the service of the United ' #: , States Government, this state , any county , or city and it shall be �' �� unlawful for any such operator to violate any of the ' provisions of � , ,' i3 this chapter, except as otherwise permitted or exempted in this chapter �{ i I �- . i: ; or in the California Vehicle Code, or required by Federal Law. j i" � � �� ; Section 19 . 3 . 3 : Exemption of Certain Vehicles . 1 � � � +, ; (a) The provisions of this chapter regulating the operation, � , t? : ,. S` f parking and standing of vehicles shall not apply to the following � 4 � ' authorized emergency vehicles when operated in the manner specified �� �' � herein pursuant to the requirements of the Vehicle Code as amended. 1, ` j i � An authorized emergency vehicle is : (1) Any publicly owned ambulance, 'f i i � - lifeguard or lifesaving equipment, (2) Any publicly owned vehicle I ,= : ;' operated by the following persons ,agencies or organizations : any ;j �� ��1 7 -7- � . , , � Z " ' forestry or fire department _of any public agency or fire department ` � � , organized as provided in the Health and Safety Code; and any police ' i ��, ;. �, : department, sheriff ' s department or the California Highway Patrol; � : 7 the district attorney of any county or any district attorney investigator; s . � , any constable or deputy constable engaged in law enforcement work; i peace officer personnel of the Department of Justice , and (3) Any � �, � vehicle. owned by the State,. or any bridge and highway district, equipped } � ' and used either for fighting fires , or towing or servicing other vehicles , � carinq for injured per-sons , or repairing damaged lighting or electrical �i �, equipment, and (4) Any state-owned vehicle used in responding to � ` � . , `' emergency fire, rescue or communications calls and operated either by � � the California Disaster Office or by any public agency or industrial fire department to which the California Disaster Office has assigned � � -` such vehicle, and ( 5) Any state-owned vehicle operated by a fish and ! game warden, and (6) Any vehicle owned or operated by any department � or agency of the United States Government when such department or ' �_ �a° agency is engaged primarily in law enforcement work and the vehicle � h i= r is used in responding to emergency calls , or when such vehicle is z: I �1 ` ' }` used in responding to emergency fire, ambulance or lifesaving calls . „ ; ,: S ': � :� (Cite Veh.C.A. Section 165) . i �' � (b) The foregoing exemptions shall not, however, relieve i' � � '" the operator of any such vehicle from the obligation to exercise due � 3, � care for the safety of others or the consequences of his wilful ;, ' disregard of the safety of others . ;1 � ` (c) The provisions of this chapter regulating the parking � l : hor standing of vehicles shall not apply to any vehicle of a City ' �' } department or public utility while necessarily in use for construction i' G : �' ; ' j or_ repair work or any vehicle owned or operated by the United States 1 : ? � Post Office while in use for the collection, transportation or delivery �. � � i: ; of United States mail . e' r l : Section 19 . 3 . 4 . Report of Damage to Property. �� ` t (a) The operator of a vehicle or the person in charge of ' , } � : any animal involved in any accident resulting in damage to any property 3i , �• � publicly owned or owned by a public utility including, but not limited � � ! '� ` to, any fire hydrant, parking meter, lighting post, telephone pole, } : 1- ' � . electric light or power pole , or any accident resulting in damage to ; ; -8- '� 9 7 .� � �; ; '•. any tree, traffic control device or other property of a like nature � located in or along any street, shall, within twenty-four hours after �-� such accident, make a written report of such damage to the Police �, ' Department of the City of Chu1a Vista. � ' (b) Every such report shall state the time when, and the t � . , place where , the accident took place, the name and address of the �i � . person owning and of the person operating or in charge of such vehicle � � .: or animal, the license number of every such vehicle, and shall briefly y. . �. � ' • describe the property damage in such accident . �� • ' % , (c) The operator of any vehicle or the person in charge of ; . � � any animal involved in an accident shall not be subject to the i � requirements or penalties of this section if and during the time j' ` he is physically . incapable of making a report, but in such event 4 . � he shall make a report as required in subsection (a) within twenty- f . four (24) hours after regaining ability to make such report. � :, Section 19 . 3 . 5 . When Vehicles may be Removed from Streets . t. �: � Any regularly employed and salaried officer of the Police �. '. y� Department of the City of Chula Vista may remove or cause to be ,�� ., � removed: c '<< (a) Any vehicle which is parked or left standing upon a �° � street or highway for seventy-two (72) or more consecutive hours . � ,. (b) Any vehicle which is parked on a highway in violation of ; any provision of this chapter, the Vehicle Code or other law or ordinance )_: .� , forbidding standing or parking, when the use of such hsghway or a 'r' y portion thereof is necessary for the cleaning, repair or construction i. of the highway or for the installation of underground utilities , and �. .. ` signs giving notice that such vehicle may be removed are erected and � � placed at least twenty-four (24) hours prior to the removal. 3 ' (c) Any vehicle parked upon a highway which has been i, ; . � authorized by the Council or other competent authority for a I � ' purpose other than the normal flow of traffic, or for the. movement � � of e ui ment articles or structures of unusual size. and the g � . q p , parkin y of said vehicle- would prohibit or interfere with such use or movement; ,, � ; s' providing that signs giving notice that such vehicle may be removed , iare erected or placed at least twenty-four (24) hours prior to the ;: . } removal of such vehicle . � -9- ;, �: ' Q � � . - -- --��� ' , - - ���#I -, " (d) Any vehicle parked or left standing , when the City i l Council by resolution or ordinance has prohibited such parking and h � 3'. has authorized the removal by ordinance. No vehicle may be removed ' k Y � unless signs are posted giving notice of the removal . } , Article IV. Traffic Control Devices . }r : c� ' Section 19 . 4 . 1. Authority to Install Traffic Control Devices . . i i (a) The City Engineer shall have the power and duty to i � . place and maintain, or cause to be placed and maintained, official � � traffic control devices when and as required to make effective the � C provisions of this chapter. i � : (b) Whenever the Vehicle Code requires for the effectiveness ; %� � of any provision thereof that traffic control devices be installed to yt give notice to the public of the application o£ such law, the City Engineer is hereby authorized to install or cause to be installed � the necessary devices subject to any limitations or restrictions � set forth in the 1aw applicable thereto. , � (c) The City Engineer may also place and maintain or cause f� ,. _ '� ! to be placed and maintained such additional traffic control devices w - � .' � : as may be necessary or proper to regulate traffic or to guide or � - warn traffic as required by this chapter or determined by ordinance � or resolution of the Council. ' I � Section 19 . 4 . 2. Traffic Control Signs Required for Enforce- t � , ; �� 1= ment Purposes. S' No provision of the Vehicle Code or of this chapter for � L; , which signs are required shall be enforced against an alleged violator �i � � �� �; ' unless appropriate legible signs are in place giving notice of such , � provisions of the traffic laws . Whenever a particular section does � +' not state that official traffic control devices are required, such �' y'4 I r section shall be effective even though no devices are erected or in i. � ' �{� place. {. . � � Section 19 . 4 . 3 . Obedience to Traf£ic Control Devices . , � The operator of any vehicle or train shall obey the instruc- c � � tions of any official traffic control device placed in accordance � , t � f; f with this chapter unless otherwise directed by a police officer or {• a � �. other authorized person subject to the exceptions granted the operator � j of an authorized emergency vehicle when responding to emergency calls . ?- '7� -10- ' - F .� �. Section 19 . 4 . 4 . Installation of Traffic Signals . � (a) The City Engineer is hereby directed to install and r ` maintain official traffic signals at those intersections and other , places where traffic conditions are such as to require that the flow 5 of traffic be alternately interrupted and released in order to prevent 3 or relieve traffic congestion or to protect life or property from � exceptional hazard as determined by this chapter or by ordinance j � . - or resolution of the Council. � � ' (b) The City Engineer shall ascertain, determine and recommend to the Council the locations where such signals are re- j ' guired by field investigation, traffic counts and other traffic ' information as may be pertinent and his determinations therefrom shall be made in accordance with those traffic enqineering and safety standards and instructions set forth in the California Maintenance � . Manual issued by the Division of Highways of the State of California i r: Department of Public Works . s' (c) Whenever the City Engineer installs and maintains an ` official traffic signal at any intersection, he shall likewise erect ''- .� �; � and maintain at such intersection street name signs clearly visible ?= -; to traffic approaching from all directions unless such street name i . ,��-' -' signs have previously been placed and are maintained at any said � '' �� intersection. t � i, "s �- E { Section 19 . 4 . 5 . Authority to Remove, Relocate and Discontinue t' , ;; Traffic Control Devices . t' The City Engineer is hereby authorized to remove , relocate 3 i or discontinue the operation of any traffic control device not < � specifically required by the Vehicle Code or this ordinance whenever � he shall determine in any particular case that the conditions which � , �' • warranted or required the installation no longer eiist or obtain. �; ! a- Section 19 . 4 . 6 . Lane Marking. i r ; ; The City Engineer is hereby authorized to mark center lines �" ` and lane lines upon the surface of the roadway to indicate the course � �� i. to be traveLled by vehicles and may pl.ace signs temporarily designating i, lanes to be used by traffic moving in a particular direction, regard- � " �' less of the center line of the highway. j� Section 19 . 4 . 7 . Distinctive Roadway Markings . � ? The City Engineer is authorized to place and maintain '' �-J� distinctive roadway markings as described in the Vehicle Code on 1 . , . . :- . , . �. - . �r those streets or parts of streets where the volume of traffic or . ` - the vertical or other curvature of the roadway renders it hazardous � � � ; : i to drive on the left side of such marking or signs and markings . s ' � _ Such marking or signs and markings shall have the same effect as , i � similar markings placed by the State Department of Public Works � pursuant to the provisions of the Vehicle Code. # ' Section 19 . 4 . 8 . Traffic Control Devices--HOUrs of Operation. R . z ,: The City Engineer shall determine the hours and days during which any traffic control device sha11 be in operation or be in � effect, except in those cases where such hours or days are specified in this chapter. Section 19 . 4 . 9 . Unauthorized Painting of Curbs . No person, unless authorized by this City, shall paint any street or curb surface; provided, however, that this section shall t � not apply to the painting of numbers on a curb surface by any f . � person who has complied with the provisions of any resolution or � 'sF ordinance of this City pertaining thereto. . � a � �" Article V. Turning Movements . � �. : � .} Section 19 . 5 . 1 . Authority to place and Obedience to Turning , I � Markers, Intersections , Multiple Lanes . � �� }� ,_ (a) The City Engineer is authorized to place markers , buttone , : � � ; ? or signs within or adjacent to intersections and indicating the course � ; to be travelled by vehicles turning at such intersections . The City i � Engineer is further authorized to locate and indicate more than one ' Ya lane of traffic from which drivers of vehicles may make right or left � 3: � hand turns; the course to be travelled as so indicated may conform to �. � � or be other than as prescribed by law or ordinance . s. Emergency Parking Signs . t � : (a) WheneQer the City Engineer sha11 determine that an i emergency traffic congestion is likely to result from the holding � of public or private assemblages, gatherings , or functions , or for � . � other reasons , the City Engineer shall have power and authority to order temporary signs to be erected or posted indicating that the , :. operation, parking or standing of vehicles is prohibited on such ' streets and alleys as the City Engineer shall direct during the time r such temporary signs are in place . Such signs shall remain in place � only during the existence of such emergency and the City Engineer shall cause such signs to be removed promptly thereafter. -21- � - --- ; (b) When signs authorized by the provisions of this section �` are in lace ivin notice thereof no P g g , person shall operate, park or stand any vehicle contrary to the directions and provisions of such signs Section 19 . 10 . 17 . Display of Warning Devices when Commercial Vehicle is Disabled. Every motor truck having an unladen weight of 4 , 000 pounds or more, and every truck-tractor irrespective of weight when operated upon any street or highway during darkness shall be eguipped with and carry at least two flares or two red lanterns or two warning lights or reflectors , which reflectors shall be of a type approved by the Department of California Highway Patrol . i i . When any vehicle above mentioned or any trailer or semi- ' trailer is disabled upon streets or highways outside of any business � or residence district within the City and upon which street or highway , � there is insufficient street lighting to reveal a vehicle at a ( ' ` distance of 200 feet during darkness, a warning signal of the character } � I � ), { indicated above shall be immediately placed at a distance of approx- ; imately 100 feet to advance of, and 100 feet to the rear of such � : disabled vehicle by the driver thereof. Authority to Establish Loading Zones . , The City Council, by resolution upon the recommendations of the City Engineer, may establish the location of loading zones and passenger loading zones as follows : At any place in any business district, and elsewhere in front of the entrance to any place of business or in front of any hall or place used for the purpose of public assembly . ; Such loading zones sha11 be indicated by yellow paint upon 1 the top of all curbs in said zone, and passenger loading zones shall � '% be indicated by white paint upon the top of all curbs in said zones. Improper Use of Meter. ,� � r� No person shall deposit or cause to be deposited in any �, � �� ' parking meter any defaced or bent coin, or any slug, device or , � ' ��;. ' ' metallic substitute for a coin of the United States except parking :, i , meter tokens authorized by the City; or deface , injure, tamper with !I' .� + open or willfully break, destroy or impair the usefulness of any �� '.'' parking meter. ,�' ' ; �(i Section 19 . 17 . 8. Parking Meters and Parking Meter Standards _ � Not to be Used for Certain Purposes . � No person other than an authorized employee of the City � � shall attach anything to a parking meter or parking meter standard. No person shall allow a bicycle, newsrack or 'any other article or :� , s thing to lean against a parking meter or a parking meter standard. � Section 19 . 17 . 10 . Rules of Evidence. z�. (a) The parking or standing of any motor vehicle in a � i parking space, at which space the parking meter displays the sign ( or signal indicating illegal parking , shall constitu•te a prima �;. . facie presumption that the vehicle has been parked or allowed to � stand in such space for a period longer than permitted by this �' 2 ,'{ • Article. � � ' � ' (b) The parking or standing of any motor vehicle in a �: ,i� � ' parking space which is controlled or regulated with the aid of a �I; � . �^.i parking meter shall constitute a prima facie presumption that the � vehicle has been parked or caused to be parked by the owner of such �� t � vehicle. �i� } ' �. � ` (c) The parking or standing of any motor vehicle in any ',� �.� � ,, parking space upon any street, alley or public place or parking lot �� � in the City shall constitute a prima facie presumption that the �;I �` vehicle has been parked or caused to be parked by the owner of such i vehicle. ��I � i,{ '. Section 19 . 17 . 11. Collection of Monies . �� , 7 The coins deposited in the parking meters shall be collected �;� J , by ' duly authorized agents of the City Finance Officer. ��i � Section 19 . 17 . 12 . Purchasing, Leasing, etc. of Parking Meters. '� I The purchasing, leasing , repairing, maintenance of parking meters; the placement and removal of parking meters from parking meter I -' ' posts; and the payment of any and all expenses relating or incidental 4 �I thereto shall be under the jurisdiction of the City Finance Officer. � � ;•' Section 19 . 17 . 13 . Use of Monies Deposited in Parking Meters . Such persons shall wear a distinctive garb or insignia indicating such appointment. Vehicles Stoppinq on Siqnal. It shall be unlawful for any person driving or operating, propelling or causing to be propelled, any vehicle to fail to stop not less than fifty (50) feet from the nearest side of a school pedestrian lane where any signal, flagman or person is stationed � giving warning that children are about to cross or are crossing the street; it is further declared unlawful to proceed until such � ;�' signal has stopped, raised or been removed, or the flagman or the : ' person stationed at such pedestrian lane has given a signal to go � , �' � or has left the locality. ,i . I Article XXI . Regulations for Bicycles . . � i � Section 19 . 21. 1. Effect of Regulations . j � . After a bicycle has been licensed for a period of ten years , the Police Department may clear the files of that record, assuming that the bicycle has either been sold or the registration has changed hands and should be re-registered. ! -:, (b) The Chief of Police shall not issue a license for any , •-, bicycle when he knows or has reasonable ground to believe that the � applicant is not the owner of or entitled to the possession of such bicycle. �' ; � (c) The Chief of Police shall keep a record of the number of each license, the date issued, the name and address of the person to whom issued and the number on the frame of the bicycle for which : iY ` � issued, and a record of all bicycle license fees collected by him. Attachment of License Plate. i � (a) The Chief of Police, upon issuing a bicycle license, � '` shall also issue a license plate bearing the license number assigned � �, to the bicycle, and the letters CVBL.
