OF THE CITY COUNCIL OF THE
CITY OF CHULA VISTA, CALIFORNIA
Held Tuesday September 11, 1972
A regular meeting of the City Council of the City of Chula Vista, California, was
held on the above date beginning at 7:00 p.m. in the Council Chamber, Civic Center,
276 Fourth Avenue, with the following
Councilmen present: Councilmen Scott, Hamilton, Hyde, Egdahl
Councilmen absent: Councilman Hobel
Staff present: Acting City Manager Bourcier, Attorney Max Wiza, Assistant
Director of Public Works Robens, Assistant Director of Planning
Williams, Director of Building and Housing Grady, Environmental
Review Coordinator Reid
The pledge of allegiance to the Flag was led by Mayor Hamilton, followed by a moment
of silent prayer.
APPROVAL OF MINUTES It was moved by Councilman Scott, seconded
by Councilman Hyde and unanimously carried
that the minutes of the meetings of August 29
and September 4, 1973 be approved, copies
having been sent to each Councilman.
PUBLIC HEARING (CONTINUED) - The applicant is requesting a freestanding

denied this variance application and approved
a low profile, freestanding identification
sign, set back 25 feet to 35 feet from the
front property line.
The Council continued this hearing from the
meeting of August 7 so a full Council can be
present. In view of the fact that one
Councilman is absent, and it would take a
unanimous vote of those present to override
the decision of the Commission, the Council
concurred that the hearing should be continued.

the hearing be continued to the meeting of
September 25, 1973.

RESOLUTION NO. 7012 - At the meeting of September 4, 1973, the

The two bids which were received are:

It was recommended that the contract be
awarded to the low bidder.

RECO~4ENDATION OF ENVIRONMENTAL The Environmental Control Commission had reeom-

Control Commission be given an opportunity

mental Impact Reports.
In a report to the Council, Director of
Planning Peterson asked that the request be
filed stating that the current procedure
establishes an adequate method of providing
Environmental Control Commission input into
these reports. Their present proposal would
have the disadvantage of ex~ending an already
lengthy processing time, duplicate the review
of the Planning Commission and duplicate
the Commission's own review of draft Environ-
mental Impact Reports.
Motion to file It was moved by Councilman Hyde and seconded
by Mayor Hamilton that the request be filed.
Discussion of motion Councilman Scott commented that he attended
the Environmental Control Commission
meeting at which this was discussed, and
their intent was that they would call a
special meeting between the time the Planning
Commission and Council met to study the
Environmental I~pactReport.
Councilman Egdahl indicated he would have no
objection to the request if the Environmental
Control Commission did not interrupt the
normal process of submitting the Environmental
Impact Reports to the City Couneil.
Substitute motion It was moved by Councilman Scott, seconded
by Councilman Hyde and unanimously c~rried
that this be sent back to the Environmental
Control Commission stating that the City
Council would consider sueh a policy if it
does not slow down the process, and they are
to resubmit it to the Council and staff in
that form.
Role of Environmental Couneilman Egdahl pointed out that the role
Control Commission of the Environmental Control Commission is
more advisory to the Planning Commission than
to the Council, and their input should be to
the Planning Commission before it makes its
final decision.

Staff at commission Councilman Hyde questioned whether a staff
meetings momber is present at the Environmental Con-
trol Commission meetings.
Acting City Manager Bourcier explained that
no staff member is present; however, from
time to time, they are requested to attend.
The Manager added that he felt it was not
necessary on a continual basis.
Motion for staff report It was moved by Councilman Hyde, seconded
by Councilman Scott and unanimously carried
that the City Manager be requested to look
into the desirability and practicability of
assigning the Environmental Review Coordina-
tor as a staff liaison representative to the
Environmental Control Commission and a staff
m~mber to all other commis,sions that do no%
presently have one.
STATUS REPORT REGARDING Director of Planning Peterson reported that
JOINT CITY AND COUNTY he met with the County Planning Director
STUDY ON CASTLE PARK AREA and a representative of the San Diego Planning
Department. It was the opinion of this group
that the Board of Supervisors would be un-
willing to adopt any sort of plan for the
Castle Park area which would result in a
reduction in land use intensity or a down
zoning. It was pointed out that the Board's
general policy is to encourage more intense
development near urban centers and that the
existing zoning conforms to this policy.
Mr. Peterson added that if Chula Vista wishes
to pursue this study, it would be a unilateral
effort and he recommended it be given a iow
priority work assignment until other projects
in the department are completed.
Motion to accept report It was moved by Councilman Egdahl, seconded
by Councilman Scott and unanimously carried
that the recommendation of the department
head be accepted.
REPORT ON AUDIO Director of Building and Housing Grady re-

INSTALLATIONS to the site on Corte Maria to investigate
the problem. They reported the tower to be
structurally adequate. As to the inter-
,ference, this is under the realm of the
Federal Communications Commission, and
several calls were made to them; however, to
date, they have not returned any of the calls.
Motion to continue It was moved by Councilman Egdahl, seconded
by Councilman Scott and unanimously carried
that this item be continued for one week.
Mayor Hamilton indicated that he would per-
sonally call the Federal Communications Com-
mission in the morning.
Councilman Hyde discussed the aesthetics
of the antenna structure, and felt that some
sort of regulation should be considered by
the Council for this type of structure in
residential areas.

CURB CUTS FOR BUSINESSES Mayor Hamilton questioned the standards for
curb cuts of ingress and egress for busi-
nesses, and particularly cited the diffi-
culty in making a left turn into the Handyman
area. The Mayor added that the problem is
compounded by the fact that the Handyman
sign is not visible until you reach that
point at which you must be in the left
hand lane to make the turn.
He stated that he would like information on
how wide the driveways are allowed to be, if
this is considered safe, or if they should
be widened to get more visibility and lateral
movement to move in and out of traffic.
Assistant Director of Public Works Roberts
stated he would look into this and report
back.
Motion to refer to It was moved by Mayor Hamilton, seconded by
Safety Commission Councilman Scott and unanimously carried
that this be referred to the Safety Commis-
sion.
CONTACTS WITH NATIONAL Councilman Scott asked if the staff has had
STEEL AND SHIPBUILDING any contact with NASSCO in regard to a
COMPANY (NASSCO) shipyard location on the property next to
Rohr Industries. He indicated that this was
the only feasible location for the shipyard.
Mayor Hamilton commented that he has spoken
to Mr. Ken Wood, attorney for NASSCO, but
that there does not seem to be enough informa-
tion from them for the Council to work on.
Motion to contact NASSCO It was moved by Councilman Scott and seconded
by Mayor Hamilton that a letter (or a commu-
nication of some sort) be given to NASSCO
requesting them t0-tell the Council what
their plans are for a shipyard in that area
(directly behind Rohr Industries) -- whether
they are interested, and if they are, what
are they going to do to pursue it. If they
are going to pursue that location, what can
the City of Chula Vista do to expedite it.
Discussion of motion Councilman Hyde felt the motion was premature,
declaring that the Council has not had a
staff analysis of what the impact of a ship-
yard at this location would be.
Amendment to motion Councilman Egdahl asked that the motion be
amended to strike the following from the
motion: "what can the City of Chula Vista
do to expedite it" and substituted with
the following: "in order that the City can
better analyze the impact and arrive at a
position."
Councilman Scott agreed, and stated he would
add this to his motion.
Mayor Hamilton noted that the Regional Board
created by the Coastal Commission will be the
one to make the final decision. He agreed to
the second.

SAFETY COMMISSION VACANCIES Councilman Hyde noted the number of vacancies
on the Safety Commission and stated that the
Council should act as soon as possible to
get on with the selections to fill the
Vacancies.
ANNEXATION POLICIES It was moved by Councilman Hyde, seconded
by Mayor Hamilton and unanimously carried
that this item be set for a Council Conference
(adjourned regular meeting) - the time to be
determined at the next Council meeting.
PLANNING COMMISSION Councilman Hyde noted in the Planning Commission
FIELD TRIPS minutes an inquiry by Commissioner Wilson
as to whether their field trips would be
resumed.
Assistant Director of Planning Williams ex-
plained that this item was held over pending
discussions with the City Attorney.
WRITTEN COMMUNICATIONS

Claim denied it vas moved by Councilman Scott, seconded by
Councilman Hyde and unanimously carried that
the claim be denied and turned over to the
City's insurance carrier for investigation.
Request of Bonita Business and Mrs. Emily Ritter, President, has requested
Professional Association for Council permission to erect wooden signs at

would be borne by the Association.

Evangelist Temple for permission to erect a tent at Hilltop and

ORAL COMMUNICATIONS
Nobel Massey Mr. Mas~ey explained that he was the HAM oper-

announcements which he would furnish the
neighbors listing information of TV manufac-
turers who would furnish filters for TV'$
sold after July 1958.
Mr. Massey read an ordinance which he is
proposing for Chula Vista which would subject
all electronic audio recording and repro-
ducing equipment vended in Chula Vista to be
"so trapped, by-passed or shielded as to pre-
vent the reception of and the reproduction
of radio frequency signals from any nearby
transmitters..."
Mayor Hamilton asked Mr. Massey for a copy
of his proposed ordinance which will be given
to the City Attorney for comment.
Kathryn Moore Mrs. Moore remarked that she is friendly with
1134 Tobias Drive Mrs. McPherson, the next-door neighbor of
Mr. Massey, and has called her on several
occasions. One evening, as they conversed
on the telephone, Mr. Massey's voice came
across the telephone loud and clear. Mrs.
Moore asked that if the Council is consider-
ing the ordinance as proposed by Mr. Massey,
that some stipulation should be put in that
would cover telephones.
ADJOURNMENT Mayor Hamilton adjourned the meeting at
7:55 p.m. to the meeting scheduled for
Tuesday, September 18, 1973 at 7:00 p.m.
