HomeMy WebLinkAboutcc min 1973/12/10 MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF CHULA VISTA, CALIFORNIA Held Monday (EPA Regulations) December 10, 1973 A special meeting of the City Council of the City of Chula Vista, California, was held on the above date beginning at 7:00 p.m. in the Council Chamber, Civic Center, 276 Fourth Avenue, with the following Councilmen present: Councilmen Scott, Hobel, Hamilton, Hyde Councilman absent: Councilman Egdahl Staff present: City Manager Thomson, City Attorney Lindberg DIRECTION TO THE CITY ATTORNEY City Attorney Lindberg explained that the City RELATIVE TO THE FILING OF A of Chula Vista has prepared petitions for re- PETITION FOR REVIEW IN THE view of the Environmental Protection Agency's UNITED STATES COURT OF APPEALS rules and regulations promulgated on November FOR THE NINTH CIRCUIT ON 12, 1973, as the California Transportation ENVIRONMENTAL PROTECTION Control Plan. AGENCY REGULATIONS - CALIFORNIA TRANSPORTATION At present, there are on file over 100 agency CONTROL PLAN petitions, and authorization is being asked for Chula Vista to file its petition. EPA has just relaxed its control plan to the extent of allowing the larger cities (in ex- cess of 100,000) to have a year's grace period - until July 1975. However, there are other elements in regard to the expansion of exist- ing parking facilities and the entire program of administering the plan which are in effect as of August 15, 1973, that would make it most desirable to obtain judicial review of this matter. Motion to file petition It was moved by Councilman Scott, seconded by Councilman Hyde and unanimously carried to file this petition. Suggestions from other County Councilman Hyde asked if CPO or other County agencies agencies have come up with any suggestions for modifications of the laws pertaining to this. Councilman Hobel indicated that the matter will be placed on the December 17 agenda of CPO. Craig Beam, Legal Intern Mr. Beam stated he contacted CPO and they will submit a plan to supplant the EPA reg- ulations, in addition to San Diego's peti- tion for review. Special City Council Meeting 2 December 10, 1973 ADJOURNMENT The Mayer adjourned the meeting at 7:11 p.m. to the meeting scheduled for Tuesday, December 11, 1973.
