�I RESOLUTION OF THE CITY COUI�'CIL OF THE CITY OF
CHULA V[STA APPROVII�'G AN AGREEMEI�'T BETN'EEN
, THE CITY OF CHULA VISTA AI�'D SAI�' DIEGO COUI�iTY
SAI�TITATION DISTRICT V�'HICH SHALL EXTEir'D THE
DURAT[ON OF THE CITY'S WASTE�'ATER
TRANSPORTATION CAPACITY RIGHTS IN THE SPRING
VALLEY OUTFALL SEWERAGE SYSTEM
�%HEREAS, b.� �irtue of a change of oreanization appro��ed by the San Dieeo Local
Asenc�� Formation Commission (LAFCO), effecti��e Julti- 1, 2010, the San Dieeo Count��
Sanitation District ("Districr') is the successor agenc�� to the Sprine Valley Sanitation District
(`Spring Valley`); and
�1iEREAS. the District o���ns; operates and maintains the Spring Valle�� Outfall
' SeH�erage S}�stem (SVOSS) for the purpose of collecting and transporting sewaee from the
District and certain other municipalities and districts (including portions of the cities of Lemon
Gro��e, I�'ational Cit��. Chula Vista, San Diego, La Mesa� and the Rancho San Diego community)
to the Cih� of San Dieeo's Metropolitan Se«�erage Svstem (hereinafrer "Metro System") for
treatment and disposal purposes; and
WI-IEREAS, the SVOSS includes the Sprina Vallev Outfail Se���er (Outfall Sewer), a
sewer segment approaimately 8.7 miles long located N�ithin the Sweetwater River Basin that runs
from the intersection of Jamacha Boule��ard and S���eetw�ater Road in Spring Valley; ro a point of
connection ti�ith the Metropolitan Se���eraee System located near the junction of Interstate � and
State Route �4: and V
WHEREAS; the Cit}� oN�ns, operates and maintains portions of a se��eraee system ti�ithin
the Sweet��ater Basin for the purpose of collectine and transporting se��age from the northerly
portions of the City and certain other districts to the Metro Svstem via SVOSS, and the City has
been leasing transportation capacity in the SVOSS since Ma}� 9. 1964; and
WHEREAS; the most recent lease agreement entiiled "Agreement between the City of
Chula Vista and the Spring Valle�� Sanitation District for the Transportation of�'astew�ater in the
Spring Valley Joint S}�stem" dated 1�9ay 20, 1997, espired on June 30: 2013 (hereinafter "Lease
Agreemenr`). and the District finds that City may again lease capacity riehts in the SVOSS
���ithout impairine its usefulness; and
`��HEREAS, the Cit�� and District are parties to the "Regional Waste���ater Disposal
Aereement bet�reen the Cih� of San Dieeo and the Participating Aeencies in the Metropolitan
�� Se���erage Svstem ` filed on A1a}� 18: 1998 as Document No. 00-18�17 ���ith the Cit�� Clerk of the
Cin of San Dieeo (hereinafter "Re_ional V�'aste�a�ater Disposal Aereement"); and

! \1%HEREAS: in accordance ���ith the Reeional l�'aste�vater Disposal Aereement, the Citv
, and District ha��e the risht to discharee ���aste���ater up to established limits into the A4etro
S��stem, hereinafrer referred to as "1�4etro Capacit�� Rights; and

WHEREAS, it is recognized that there exist certain additional agreements between the
parties hereto related to the transportation of sewage that ultimate]y flows througb the SVOSS,
Including the "Agreement between the City of Chula Vista and Spring Valle}� Sanitation District
for the Connection of Ciry's Proctor Valley Road Sewer to District's Frisbie Trunl." dated July
20; 1999 and the "Agreement betv��een the City of Chula Vista and Spring Valley Sanitation
District for a new 8" Connection from the Church of the Good Shepherd to Chula Vista's Bonita
Road Se��er and Recorded Flo��Adjustment" dated March 24, 2009; and
WHEREAS, this agreement v��ill retain the same cooperative spirit of the previous
agreements and will set limits in relation to sewer transpoRation charges and capacity rights not
to exceed an equitable allocation for the maintenance, operation, and capital replacement costs
for the Spring Valley Outfall Seweraee System (SVOSS); and
WHEREAS, this Sewa�e Transportation Agreement between the District and the Ciry
override, supersede, and replace both of these existing agreements described above, and
maintains capacity transportation rights requirement of proportional cost sharing in CIP and
restriction on flow characteristic cost for each agency as intended in the original agreements;
and
WHEREAS, the capacity limit set forth by the this Agreement for the agency discharging
into the SVOSS (8J miles of 39" RCP Pipe) limit the City's Tributary to discharge peak flow
into the SVOSS to 17.64 cubic feet per second; Church of the Good Shepherd is limited to
discharging 2,120 gallons per day of sewer into the 330' ]ong 10" diameter pipe of the City
� sewer trunk; and Ciry has no limit for discharging sewer into the 1.8 mile long, 15" diameter
Frisbie sewer trunk; and
WHEREAS; the agreement is limited to 15 years; however, the lease will be
automatically extended upon written notice from the District, such that this total Agreement term
is coterminous with the Regional Wastewater Disposal Agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Counci] of the City of Chula
Vista, that it approves the "Se�-age Transportation for Spring Valley Outfall Sewerage System"
between the City of Chula Vista and the District, in the form presented, with such minor
modifications as may be required or approved by the City Attomey and authorizes and directs
the City Manager to execute said Agreement.
