TF392 (�88,000), AI�'D STA438� (�70;000) CIP BUDGETS II�' TRAI�'SNET FUI�'DS AI�'D APPROPRIATIIVG THE EQUIVALENT AA40UNTS TO TF34� (��0,000), TF327 ($7�,000), TF321 (�13.000) AI�D GG222 (�70,000); AND PROV'IDII�'G THE CERTIFICATION AI�'D IivDEn�'ITY STATEn9ENTS \'ECESSARY TO OBTAII�' TRANS\iET FIJNDS WHEREAS. on 1�'o��ember 4. 2004. the ��oters of San Diego Count}� approved the San Dieeo Transportation Impro��ement Proeram Ordinance and Expenditure Plan (TransA'et Extension Ordinance); and � WHEREAS, the TransNer Extension Ordinance provides that SANDAG, actine as the ReQional Transportation Commission, shall approve a multi-��eaz program of projects submitted by local jurisdictions identif��ino those transportation projects eligible to use transportation sales tax (Trans?�'et) funds: and V1%HEREAS. in Februarv 201�. the Cit�� of Chula Vista ��as pro��ided �vith an estimate of annual TronsAre� local street impro��ement revenues for Fiscal Years 2016 through 2020; and il%HEREAS. Council adopted the TransNet Local Street Improvement Proeram of Projects for Fisca] Years 2014/201� throueh 2018/2019 for indusion in the Reeional Transportation Improvement Proeram (RTIP) on �4a�� 6. 2014 through passa2e of Resolution 2014-066: and �VHEREAS, additional fundine is required for several projects. Available Transl�'et fundina is available for these projects. as sho�m on Ezhibit A; and �'HEREAS, staff recommends amending the re��ised 7ransNet Local Street Improvement Program of Projects for Fiscal 1'ears 2014/201� throueh 2018/2019 for indusion in the Regional Transportation Improvement Program (RTIP) as sho�vn on Exhibit A; and «'HEREAS; the Citv of Chula Vista has held a noticed public meetine on �4a}� ]0, 2016, ��ith an aeenda item that clearlv identified the proposed list of projects prior to approval of the projects b�� its authorized le_islati��e bod�� in accordance ��ith Section �(A) of the Trans�\'e! E�tension Ordinance and Rule 7 of SA\'DAG Board Polic�� No. 31. Resolution No. 2016-078 Paee No. 2 NOV✓, THEREFORE, BE IT RESOLVED that pursuant to Section 2(C)(1) of the TransNet Eatension Ordinance; the City of Chula Vista certifies that no more than 30 percent (30%) of its annual revenues shall be spent on maintenance-related projects. BE IT FURTHER RESOLVED that pursuant to Section 4(E)(3) of the TransA'er Extension Ordinance; the City of Chula Vista certifies that all new projects, or major reconstruction projects, funded by TrunsA'eI revenues shall accommodate travel by pedestrians and bicyclists_ and that an�� e�:ception to this requirement perniitted under the Ordinance and proposed shall be clearly noticed as part of the City oFChula Vista's public hearing process. BE IT FURTHER RESOLVED that pursuant to Section 8 of the TransNet Extension Ordinance. the City of Chula Vista certifies that the required minimum annual level of local discretionary fu�ds to be expended for street and road purposes will be met throuahout the five- year period consistent with the most recent Maintenance of Effort Requirements adopted by SANDAG. BE IT FURTHER RESOLVED that pursuant to Section 9A of the TrunsNet Extension Ordinance, the City of Chula Vista certifies that it will collect $2,209, plus all applicable annual increases, from the private sector for each newly constructed residential housing unit in that jurisdiction to comply ��ith the provisions of the Regional Transportation Congestion Improvement Program (RTCIP). BE IT FURTHER RESOLVED that pursuant to Section 13 of the Transn'et Extension Ordinance, the City of Chula Vista certifies that it has established a separate Transportation Improvement Account for TrarasNel revenues with interest earned expended only for those purposes for which the funds were allocated. BE IT FURTHER RESOLVED that pursuant to Section 18 of the Ti•ansAJet Extension Ordinance, the City of Chula Vista certifies that each project of$250,000 or more w�ill be clearly designated during eonstruetion ��ith Tra�7sArel project funding identification signs. BE IT FURTHER RESOLVED that the City of Chula Vista does hereby certify that all other applicable provisions of the TrunsNet Extension Ordinance and SANDAG Board Policy No. 31 have been met. BE IT FURTHER RESOLVED that the City of Chula Vista agrees to indemnify; hold harmless, and defend SANDAG, the San Diego County Regional Transportation Commission, and all officers and employees thereof against all causes of action or claims related to City of Chula Vista's Trun.tiNer funded projects. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista approves the amendment of the TransNet Local Street Improvement Proaram of Projects for Fiscal Years 2014/2015 through 2018/2019 for inclusion in the Regional Transportation Improvement Program. reducing the S7'L389 ($50;000), TF392 ($88,000) and STM385 ($70,000) CIP Budgets in TransNet Funds and appropriating the equivalent amounts to "I'F34� ($�0,000), TF327 ($7�;000), TF321 ($13;000) and GG222 ($70,000).
