Public hearing - Consideration of amendments to the I-L and I zones to permit
ITEM TITLE: certain commercial land uses as conditional uses
Ordinance 07,27- Amending Sections 19.44.040 and 19.46.040 of the Municipal
Code relating to conditional uses in the Limited Industrial and General
Industrial zones

1 . The City Council , meeting in regular session on August 5, 1980, requested that
staff prepare a modification to the zoning ordinance which would permit certain commercial
land uses to be established in industrial zones through the conditional use permit process.
According to Council direction, all conditional use permit applications filed for the
purpose of establishing such commercial land uses should be reviewed by the City Planning
Commission and the City Council .
2. On October 14, 1980 the City Council accepted the Planning Department's report
on the subject matter and referred the draft zoning amendments embodied in the said
report to the Planning Commission for review and recommendation.
3. On November 12, 1980 the Planning Commission adopted the Negative Declaration
on IS-81-17 which is forwarded herewith.
RECOMMENDATION: Concur with Planning Commission recommendation.
PLANNING COMMISSION RECOMMENDATION:
On November 12, 1980 the Planning Commission unanimously recommended that Council
enact an ordinance amending the I-L and I. zonal regulations in accordance with Resolution
PCA-81-2.
ANALYSIS
1 . The proposed amendments would authorize, through the conditional use permit process,
the location of certain commercial uses in the I-L and I zones. The authorized uses
would be those large retail distribution centers which are engaged in the high volume,
warehouse-type sale of goods and which, therefore, require massive floor space for the
integrated storage and display of goods, and much onsite parking. These quasi-industrial
land uses can often be best accommodated on large industrial holdings.
2. The draft amendments would not generally authorize the establishment of retail
stores and shops in this municipality's industrial zones. Such a general authorization
would constitute a partial return to "cumulative" zoning, and would substantially reduce
the zoning plan's capacity to implement the policies constituent to the Land Use Element
of the Chula Vista General Plan.
3. The area of retail merchandising is ever changing. On the east coast and in
several other locations major manufacturers have grouped together to lease space under one
roof for the disposal of production overruns, last year's models, and other surplus mer-
chandise. There also is a tendency for discount centers to seek larger square footages
outside of retail areas in order to minimize overhead. This zoning text amendment would
accommodate these types of uses subject to the approval of a conditional use permit by
both the Planning Commission and City Council .

4. The proposed amendments would be companion provisions to those of Sections
19.44.040 L and 19.46.040 F, which, through the conditional use permit process, permit
the retail sale of such bulky items as furniture, carpets and other similar items," in
the I-L and I zones, respectively. However, it should be noted that the proposed ordin-
anence amendments are not confined to the sale of bulky merchandise.

A. Background
The Chula Vista City Council requested that staff prepare a
modification to the zoning ordinance which would permit certain
commercail land uses to be established in industrial zones
through the conditional use permit process. The Council also
indicated that both the Planning Commission and City Council shall
be involved in the review process for these requests.
B. Project Description

Amend the Chula Vista Municipal Code (Section 19. 44 .040 and
19. 46 . 040) to read as follows :

19 .44 . 040 Conditional uses .
Conditional uses permitted in I-L zone include :
M. Retail distribution centers and manufactures ' outlets which
require extensive floor areas for the storage and display of
merchandise, and the high-volume, warehouse-type sale of goods.
Conditional use permit applications for the establishment of
retail commercial sales uses , covered by the provisions of
this subsection, shall be considered by the City Council ,
subsequent to its receipt of recommendations thereon from the
Planning Commission.

C. Compatibility with zoning and plans
The proposed project is compatible with the zoning ordinance and
is consistent with the goals and objectives of the General Plan.
D. Findings of insignificant impact
1. The project involves a zoning text amendment and is not site
specific, therefore no natural or man-made resources will be
affected. Each proposed project considered under these provisions
will be subject to additional environmental review.
2 . The proposed amendment is not at variance with the goals and
objectives of the General Plan and short term goals will not be
achieved to the disadvantage of long term environmental goals .
3. There are no impacts anticipated to occur which could interact
to create a substantial cumulative impact on the environment.
4 . The zoning text amendment will not adversely affect ambient
noise levels nor will it effect air quality. No hazards to human
beings will result.

' RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO
THE CITY COUNCIL THE ADOPTION OF AN AMENDMENT TO SECTIONS
19.44.040 and 19.46.040 RELATING TO CONDITIONAL USES IN THE
LIMITED INDUSTRIAL AND GENERAL INDUSTRIAL ZONES
WHEREAS, Section 19.44.040 of the Chula Vista Municipal Code lists the
conditional uses permitted in the I-L zone and Section 19.46.040 lists the
conditional uses permitted in the I zone, and
WHEREAS, the City Council requested preparation of a modification to the
zoning ordinance to permit some commercial land uses in the industrial zones
through the conditional use permit process, and
WHEREAS, an Initial Study, IS-81-17, of possible adverse environmental
impacts of the proposed amendment was conducted by the Environmental Review
Committee on October 14, 1980, which concluded the proposed amendment would not
produce significant environmental effects and recommended the adoption of a
Negative Declaration, and
WHEREAS, the City Planning Commission set the time and place for a public
hearing to consider the proposed amendment, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m. ,
November 12, 1980 in the Council Chambers, 276 Fourth Avenue, before the Planning
Commission and the hearing was thereafter closed, and
WHEREAS, the Planning Commission found that the proposed amendment will have
no significant environmental impact and adopted the Negative Declaration on IS-81-17.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1 . From facts presented to the Planning Commission, the Commission finds
that public necessity, convenience, general welfare and good zoning practice
require the following amendments to the zoning ordinance:
a. Add to Section 19.44.040, Conditional Uses, the following subsection:
M. Retail distribution centers and manufacturers' outlets which require
extensive floor areas for the storage and display of merchandise, and
the high-volume, warehouse-type sale of goods. Conditional use permit
applications for the establishment of retail commercial sales uses,
covered by the provisions of this subsection, shall be considered by
the City Council , subsequent to its receipt of recommendations thereon

2. The Planning Commission recommends to the City Council that said
amendments be adopted.
