On August 12, 1980, the City Council did not pu, the ordinance on the second reading but
referred it back to the Board of Appeals and Advisors.
RECOMMENDATION: That Council
Put the ordinance on its second reading.
BOARD/COMMISSION RECOMMENDATION:
By a unanimous vote, the Board of Appeals and Advisors recommends the ordinance be put
on the second reading for adoption.
DISCUSSION:
On August 12, 1980, the Uniform Plumbing Code, 1979 Edition, was on the Council agenda
for the second reading and adoption. The second reading was postponed and the ordinance
referred back to the Board of Appeals and Advisors due to a report handed the City
Council by Mr. Dexter Levy, Business Manager of the Plumbers and Pipefitters Local 230
of San Diego and Imperial Counties. On September 8, 1980, the Board of Appeals and
Advisors reopened the hearing for the adoption of the Uniform Plumbing Code, 1979 Edition
to take testimony in reference to the report from the Plumbers and Pipefitters Local 230.
Mr. Dexter Levy noted that the International Union in conjunction with the UCLA School of
Public Health conducted a survey of plumbers and pipefitters regarding the number of
incidents of heart disease, liver ailments, kidney disease, cataracts, skin and other
unusual cancer which are far above the national average. The survey contributed these
incidents to the handling and installation of plastic plumbing.
Mr. Rob Lindvail , representing the Plumbing Piping Industry Council , Inc. of San Diego
was in favor of adopting the Uniform Plumbing Code, 1979 Edition -as the report from the
International Union did not actually prove that their members have a higher incidence
of certain ailments and diseases.
From the facts presented, the Board of Appeals and Advisors determined that no conclusions
were established that there is a health problem inherent with the use of plastic pipe and
the solvent cement used in connecting the pipe. Until such tiriie as documented evidence
is available to prove that plastic pipe and the solvent cement is dangerous to health,
the use of plastic drainage waste and vents and water systems should be continued. On
October 1 , 1980, the California Department of Housing and Community Development sent a
notice that a public hearing will be held on November 24, 1980 to adopt regulations and
amend the Uniform Plumbing Code, 1979 Edition to allow for the expanded use of plastic
drain waste and vent pipe within residential buildings.
