+BACKGROUND
1 . This item *was continued from the City Council meeting of August 5, 1980 because
Council had not adopted the ordinance allowing consideration of rezonings to MHP in cases
where the MHP zone would contain less than 5 acres. Council subsequently did adopt the
ordinance (August 19, 1980) clearing the way for the consideration of these two reronings.
2. The proposed zone changes are not subject to environmental review singe"they are
of considered projects under the criteria set forth by CEQA because no physical.' change will
tEresult from the zone change action.
PLANNING COMMISSION RECOMMENDATION
On June 11 , 1980 the Planning Commission, by a vote of 5 to 1 , with one member absent,
recommended that Council enact ordinances rezoning Jade Bay Mobile Lodge at 701 "D" Street
frog R-3 to MHP in accordance with Resolution PCZ-80-H(1 ) and Bison Mobile Home Park at
708 "H" Street from R-3 to MHP in accordance with Resolution PCZ-80-H(3) .
RECOMMENDATI0N:
Concur with the Planning Commission with the addition of the following findings which
apply to each of the parks:
1. The mobile home park is providing approximately 75 spaces at a rental rate 25-30%
lower than rents charged in recently developed parks, thereby contributing to the
supply of affordable housing.
2. The facility is located in close proximity to shopping facilities and transportaT.,
tion corridors. In addition, the park is designed with an inward orientation and; .
is fenced and landscaped to provide a buffer from adjacent land uses. Thus, the
separation provided by these buffering conditions make the area compatible with
the surrounding land use patterns.
DISCUSSION
1 . The ordinance adopted by Council on August 19, 1980 specified that the MHP zone
can be applied to properties of less than 5 acres where the City Council finds that a
smaller park would enhance or protect the supply of affordable housing and would be
compatible with surrounding land use patterns. In evaluating these two parks against
the findings, the Planning Department found that space rental is between 25% and 30%
lower than in the newer parks, so the rezoning will tend to protect the supply of afford-
'able housing. With respect to compatibility with the surrounding areas, it is appropriate
to note the following factors:

a. Both parks are small in size and low in profile so that they blend in
well with adjacent land uses.
b. Both parks are well landscaped on their periphery, are neat, clean and
well maintained.
c. Both parks have existed for a period of approximately 20 years without
causing any discernible conflict with adjacent land uses.
d. The Jade Bay Mobile Lodge is across the street from another mobile home
park and is bordered on the west by an open landscaped area adjacent to
the railroad.
e. The Bison Mobilehome Park is bordered by Mueller School on the south,
two service stations on the north, the railroad track on the west and
apartments on the east. As an inward oriented land use, it is very
compatible with its neighbors.

3. It is my conclusion that both parks fulfill the provisions of the MHP '7one as
recently modified by Council and that they merit the protection of the MHP zone.

RESOLUTION NO. PCZ-80-H(1 )
RESOLUTION OF THE CITY PLANNING COMMISSION RECCiIMENDING TO
THE CITY COUNCIL THE CHANGE OF ZONE FOR 4.35 ACRES AT
701 "D" STREET FROM R-3 TO MHP
WHEREAS, Ordinance No. 1845, adopted by the City Council on November 28, 1978,
established the MHP (mobile home park) zone, and
WHEREAS, it was deemed expedient to consider designating various mobile
home park sites to the MHP zone, and
WHEREAS, the proposed rezonings will not result in any physical change, and
are not considered "projects" under CEQA and therefore not subject to environmental
review, and
WHEREAS, the City Planning Commission set the time and place for a hearing
on said zone change, and notice of said hearing, together with 1Ls purpose, was
given by the publication in a newspaper of general circulation in the City at least
10 days prior to the date of said hearing, and
WHEREAS, a hearing was held at the time and place as advertised, namely
7:00 p.m. , June 11 , 1980, in the City Council Chambers before the Planning
Commission and said hearing was thereafter closed.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1 . From facts presented to the Commission , the Commission finds that
public necessity, convenience, general welfare and good zoning practice require
the change of zone from R-3 to MHP for approximately 4.35 acres, located at
701 "D" Street and developed as Jade Bay Mobile Lodge.
2. The findings of fact in support of said determination are as follows:
a. The establishment of the MHP zone on the subject site recognizes
the existing land use and will require further Council action in
order to approve a change in land use.
b. The General Plan designates the site as Residential , 13-26 DU/acre;
the MHP zone does not specify a density so there is no conflict
between the zone and the General Plan.
3. The Planning Commission recommends to the City Council that said change
of zone be granted.
4. That this resolution be transmitted to the City Council and a copy be
transmitted to the owner of the property.
PASSED AND APPROVED BY THE CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA

Re: Rezoning Jade Bay Mobile Lodge from R-3 to MHP
Dear Mr. Peterson,
I am the owner of Jade Bay Mobile Lodge. My wife and I have
owned the mobilehome park since 1965 , which we acquired upon
our retirement. We have worked very hard all our lives so
that we would have something that would support us through
our retirement. Let me make it clear that we do not intend
to sell the park or convert it to any other use. The City
of Chula Vista has proposed to rezone our property on the
basis to provide appropriate locations where mobilehome parks
are to be established and maintained. I believe that this
is not a good reason for establishing Jade Bay Mobile Lodge
in the MHP zone for the following reasons: years old
(1) it is an older park, approximately 20 y
(2) it is a very small park in todays standards, approximately
41/2 acres
(3) it is not feasible for redevelopment into a new
mobilehome park.
I believe that the City of Chula Vista and its officials have
the duty to best serve the public interest. This does not
mean that they should arbitrarily set restrictions upon any
group of individuals or businesses without taking into
consideration the facts for each situation. I firmly believe
that blanket zoning and rent controls only help those
individuals that have already taken advantage of the public
by increasing rents to the highest limits or by converting bblili
property into the highest and best use. That only leaves
good businesses under the mercy of the new restrictions
placed on them. Let me tell you about the rent increase
that we made effective June 1, 1980. We increased the rent

$9. 00 per month on all spaces. This was to cover the following:
(1) increases in water costs
(2) installation of new cable T.V. system costing $6, 300
(3) increase in cost of monthly cable T.V. service
(4) purchase of a mobilehome for a new manager costing $5, 000
(5) increases in maintenance costs.
I could go on with this list of items which we the owners
are to absorb during this coming year. Now let me tell
you what our new rent is effective June 1, 1980. It is
$110. 00 per month plus utilities. I venture to say that
there are very few places that a person could currently find
for this reasonable rent.
We take pride in our park and maintain it at the highest
level but with time deterioration takes place. At some
future time it will be unfeasible to operate as a mobilehome
park. Therefore, it would be unfair for the Planning
Commission to restrict our mobilehome park to the MHP zone.
Let me reiterate that it is a small mobilehome park and it
is over 20 years old. My son Kenneth Kubota will attend the
June 11, 1980 meeting and will represent us. If there are.
