ITEM TITLE: Ordinance 0'04p - Relating to animal impoundment regulations
SECOND READING AND ADOPTION

BACKGROUND:
The Municipal Code does not presently provide specific authority for
the disposition of impounded dogs .
RECOMMENDATION: It is my recommendation that the Council approve
the amendment to the Municipal Code to specifically
authorize disposition of impounded dogs .
BOARD/COMMISSION RECOMMENDATION: Not Applicable .
DISCUSSION:
The section that previously existed in the Municipal Code dealing
with disposition of unclaimed dogs was adopted in 1975 as Section
6 .24 .040 of the Municipal Code . Before this section appeared in
print, Chapter 6 .24 was extensively revised and a new Section
6 . 24 .040 was added as an amendment to the Municipal Code . Previously
enacted Section 6 .24 . 040 never appeared in the new Code and the new
Section 6 .24 .040 superseded it. It is necessary to include the ordi-
nance as it originally appeared in Section 6 .24 .040, but it would be
more appropriate to put it in Chapter 6 .12 of the Code . This section
gives notice of the authority of the Poundmaster to dispose of dogs
which are not claimed by their owners .
Normally, if an owner does not contact the animal shelter within
three working days, he does not contact the shelter at all . The
shelter cannot board these dogs for more than three working days
with its present resources. This ordinance would authorize the Pound-
master to dispose of the dogs after three working days by either
selling them, giving them away or destorying them.
FISCAL IMPACT: Not applicable .
