The City Council , on January 15, 1980, enacted urgency Ordinance No. 1890, which is
codified as Section 15.56.005 of the Chula Vista Municipal Code. This ordinance brings
stock cooperative and community apartment projects under the purview of Chapter 15.56,
which was formerly limited to the regulation of residential condominium projects.
The Council then requested that the Planning Commission review the subject urgency
ordinance and submit its recommendation on the advisability of making it a permanent
amendment to the Municipal Code.
RECOMMENDATION:
Concurrence with the recommendation of the City Planning Commission.
PLANNING COMMISSION RECOMMENDATION:
On February 27, 1980 the Planning Commission adopted Resolution PCA-80-8 and thereby
recommended that the City Council enact a permanent ordinance amending Chapter 15.56
of the Municipal Code by adding Section 15.56.005, as stated in urgency Ordinance No. 1890.
(Resolution PCA-80-8, which incorporates Ordinance No. 1890 as an attachment, is
transmitted with this agenda statement. )
DISCUSSION
1. While the provisions of the City of Chula Vista ' s condominium control regulations
effectively regulate new and converted condominium projects, they do not cover stock
cooperatives or community apartments. Stock cooperatives and community apartments,
however, are similar in land use and occupancy to condominium projects, and can provide
de facto independent ownership of dwelling units in a residential project held under
common ownership. Because of this similarity, cities throughout California have
expressed concern that stock cooperatives, in particular, might be extensively used to
subvert local condominium regulations .
2. The proposed ordinance makes stock cooperatives subject to the same regulations as
condominiums.

RESOLUTION NO. PCA-80-8
RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO
THE CITY COUNCIL THE ADOPTION OF A PERMANENT ORDINANCE
AMENDING CHAPTER 15.56 OF THE MUNICIPAL CODE BY ADDING A
NEW SECTION 15.56.005 RELATING TO CONVERSION OF MULTIPLE
DWELLING UNITS HELD UNDER SINGLE OWNERSHIP TO INDEPENDENT
OWNERSHIP
WHEREAS, on January 15, 1980 the City Council adopted an urgency ordinance,
No. 1890, to make stock cooperative and community apartment projects subject to
the same regulations as residential condominium projects, and
WHEREAS, the Council requested that the Planning Commission review the
subject urgency ordinance and submit a recommendation on the advisability of
making it a permanent amendment to the Municipal Code, and
WHEREAS, the Planning Commission reviewed and considered the ordinance
at a public meeting held at 7:00 p.m. , February 27, 1980 in the Council Chambers,
2.76 Fourth Avenue.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1 . From facts presented to the Planning Commission, the Commission recommends
that the City Council enact a permanent ordinance amending Chapter 15.56 of the
Municipal Code by adding a new Section 15.56.005, as stated in Ordinance No. 1890
attached hereto.
2. That this resolution be transmitted to the City Council .
