ITEM TITLE Ordinance - Amending Chapter 5 .54 of the Chula Vista Municipal
Code Relating to the Issuance of Certificates of
Convenience and Necessity for the Operation of
Taxicabs

In June and July, suggested revisions to the Municipal Code for the
regulation of the operation of taxicabs were submitted to the City
Council in an effort to fulfill the Council policy set forth at your
meeting of November 21, 1978 .
However, for many months, the total issue of regulation of taxicabs
has been debated within the staff taking into account the action of
the City of San Diego vis-a-vis taxicab regulation. After lengthy
discussion with the staff and review of the ordinances of the City
of San Diego, a comparable ordinance has now been prepared for Council
consideration.
In effect, the new ordinance eliminates the restrictive, and in previous
years often monopolistic, practices of cities and makes it possible for
anyone satisfying basic financial, mechanical and safety provisions
of the ordinance to enter into the field of providing taxicab service .
The previous practice of attempting to impose upon the Chief of Police,
and ultimately the City Council , the burden of determining the public
convenience and necessity for the issuance of additional taxicab cer-
tificates, which as a factual matter is almost impossible off resolution,
has now been eliminated.
The ordinance does provide more stringent regulations relative to
insurance coverage, safety requirements and cleanliness and sanitary
requirements .

In addition, the ordinance adopts the procedures setting rates similar
to those now in effect in the City of San Diego . After the adoption
of the ordinance, a public hearing will be set to establish a maximum
rate or a ceiling for all taxicab service in the City of Chula Vista.
The individual certified operators may then set their own rates under
that ceiling. It is now required that such rates be prominently
displayed on the exterior of the cab.
Provisions have also been made for periodic checks on the cabs to
insure that customers are taken by the most direct and expeditious
route from point of origination to destination. Although new regu-
latory provisions are incorporated in the ordinance to insure a
higher quality of service, both the Assistant City Manager and the
Chief of Police, agree that the regulatory burden will be far less
stringent than previous concepts of visual observation of all taxis
within the community to insure that no outsider originates trips
within the City of Chula Vista.
The totally revised ordinance is now ready for Council action.
