These amendments have precipitated from the events and problems which occurred during the past year in the "Telegraph Canyon Terrace Development," and siltation and erosion which occurred during the last year' s rains from several various grading operations . The Chula Vista Municipal Code places the responsibility of conformance with the plans for grading work upon the private engineer . Section 15. 04 . 165 of the Code states that the private engineer shall be responsible for all surveying for proper construction of the grading and drainage facilities and is required to inspect the site to insure that the embankment and cut slopes are placed at their proper line and grade . Prior to the release of building permits for any given lot or lots the Code requires the private engineer to submit a statement (Form PW-E-106B) as evidence that rough grading for land development has been completed within standard tolerance in accordance with the approved plans , and that all embankments and cut slopes and pad sizing are as shown on the approved plans . In general , the amendments and new sections contained in this ordinance gives the City Engineer additional authority to require certain procedures and work at his discretion to require conformance with the Chula Vista Municipal Code and approved plans and for the protection of public health , safety and welfare . In summary, the amendments and new sections to Chapter 15. 04 of the Code are as follows : AMENDED SECTIONS : 15 . 04 . 010 - addition of a definition for "Building Pad" and "Building Site ." 15. 04 . 045 - Building Pads and Sites shall drain to a street or approved drainage facility. 15 . 04 . 050 - An Engineering Geologist and Soils Engineer may both be required to file reports with the City Engineer . 15 . 04 . 100 - The City Engineer may require an on-site field inspection of the rough grading phase of the work prior to issuance of building permits . Representatives from the City, permittee , Civil and Soils Engineer and Engineering Geologist may be required to be present at the on-site field inspection. 15 . 04 . 115 - The permittee is responsible for removing any silt or debris deposited upon adjacent and downstream public or private property resulting from his grading operations . He is also responsible for repairing damages as directed by the City Engineer . Erosion and siltation control is required by appropriate measures . 15. 04 . 140 - The final "as-built" report shall also contain a seepage statement or study as appropriate . 15. 04 . 165 - 90% RELATIVE DENSITY is changed to 90% RELATIVE COMPACTION OF MAXIMUM DRY DENSITY. 15. 04 . 175 - Requires geologic reports to be prepared by an Engineering Geologist . Agenda Item No. 4j 15 For Meeting of 854 8/28/79 Supplemental Page Three A seepage statement or study is required as a part of all soils reports . All reports shall consist of a preliminary and a final "as-built" report . Whenever blasting is to be performed or bedrock is to be exposed , a seepage study must be performed to determine method of handling excess water infiltration. 15. 04 . 225 - Bonds or other security shall be released 35 days after filing a "Notice of Completion" with the County Recorder ( recorded copy to City Engineer) for improvements accepted by the City and upon acceptance of completed form PW-E--105 . 15. 04 . 270 - A seepage statement or a study is required as a part of all soil reports . 15. 04 .275 - In addition, engineering geologists and others as required by City Engineer will submit written statements that they have been retained by permittee . NEW SECTIONS : 15. 04 . 315 - The City Engineer is given authority to require abatement of dangerous conditions by property owner upon written notice . If property owner does not comply within ten (10) days of notice , City Engineer may have work done with the property owner liable for all costs . 15. 04 . 320 - The City Engineer is given authority under emergency conditions resulting from grading operations to abate the condition creating such an emergency. The City Engineer may do the work with City forces or by contract and charge the cost of the work to the property owner . 15. 04 . 325 - The cost of abating a dangerous condition shall be a special assessment against the land on which such abatement was done . The City Engineer shall make a report to the Council and at a hearing on the report the property owner may raise questions as to the necessity of the abatement . Abatement costs shall be transmitted to the tax collector for collection. An additional condition is also added to Form PW-E-10B , Rough Grading Completion Statement , whereby the City Engineer and/or Director of Building and Housing may require the setting of final grade and location stakes for building pads , slopes and structures . Agenda Item r 15 9 8/28/79 Grading Permit DATE: TO: FROM: GTTR.TFCT: Rough Grading Completion Statement The purpose of this notice is to formally notify you that your building permit will not be issued until the rough grading phase of the work has been approved . To obtain an approval of the rough grading phase , the following items must be completed and approved : 1. A compaction report when required by the permit . 2. Form PW-E-106A. 3. All drainage facilities , retaining walls , and rough grading per the approved plans . 4. The property lines flagged and staked . 5. All cut and fill slopes in excess of 15 feet vertically planted . Required irrigation system shall be installed at the discretion of the City official . In addition, at the discretion of the City official , any slope that is considered a potential erosion hazard must also be planted . 6. Set final grade and location stakes for pads , slopes and structures as required by the City Engineer and Director of Building and Housing .
