Public hearing - Consideration of prez�ning and rezoning of 3.41 acres
on the south side of Kennedy Street from R-3 (County) and R-3-G toR-3-�-P
ITEM TITLE: Ordinance - Prezoning 1 .59 acres south of Kennedy Street, approximately 200
feet rrest of Second Avenue to R-3-M-P
Ordinance - Amending Zoning Ordinance to change zone on 1 .82 acres located
165 feet south of Kennedy Street from R-3-G to R-3-M-P

BACKGROUND:
1 . The applicant's request Znvolves the development of thei� pro erty in the
city lnto multz-family units under R-3-�� zon�ng (22+ units per acre�e The request
to annex the 1 .59 acres of land in the County was approved by the Planning
Commission on April 9, 1975 and has been submitted to LAFCO.
2. The Planning Commission found that the zoning was justified and appropriate
for the area. N complete copy of the staff report to the Commissi;on is attached.
The density permltted under the proposed rezoning and prezoning on the subject
property is 69 units, 3 units fewer than possible under the exlsting R�3 zoni.ng
in the County and the R-3-G zoning in the City.
3. The Planning Commission reviewed the Pdegative Declaration and certified that
it had been prepared in accordance with CEQA, 1970, as amended. The PJegative
Declaration is attached for Council review and certification.

Financial Statement:
Commission-Board Recommendation: The Planning Commission Voted 6-0 on April 9, 1975
to certify the Initial Study and recommend to the City Council the ddoption of
prezoning and rezoning of the 3.41 acre property to R-3-�1-P, wlth development of the
property subject to an approved precise plan conforming to the conditions set forth
in PCZ-75-C.
Department Head Recommendation:
Concur. In addition, rezoning of the 1 .82 acres from R-3-G to R-3-M-p should become
effective only upon the annexation of the adjoining 1 .59 acres located in the County.
Therefore, the City Council should withhold the second reading of that ordinance until
the annexation 1s completed. •

WHEREAS, said applicatior� requested the prezoning of� 1 .59 acres on the
south side of Kennedy Street from R-3 (County} i;o R-3-M, and the rezoning of the
adjacent 1 .82 ar_res from �-3-G to R-3-M, and
WHEREAS, the Planning Commission set the time and p1ace for a hearing on
said appl�ication, and notice of said htaring, together with its purpose, was given
by the publication in a newspaper of c�eneral circulation in the City at least .
10 days priar to the date af said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m. ,
April 9, 1975 in the Council Chamber, City Hall , before the Planning Carnmission,
and said hearing NJas thereafter closed.
NOI� 7HEPEFORE BE IT RESQLVED AS FOLLOWS:
1 . Fram facts presented to the Commission, the Commission finds that
public necessity, convenience, general welfare and good zoning practice .require
the prezaning af 1 .59 acres of property an tf�e so�th side of Kennedy Street ta
R-3-M-P and the rezoning of the adjacent 1 .82 acres from R-3--G to R-3-1�J-P, and
adoptian of the fallowing Prec�se Plan guidelines:
a. The west side of the property shall be �redominantly used for
parki ng and a dri v���ray.
b. The project shall be �esigned to i,�inirnize its effect on ich�
adjaining single family residents to tf��e east by utilization of
landscaping, fencinc� and b�ailding setb�.ck and sep�ration.
c. Precise plan �ppraval shall be subj�ct to evidence that the
three lots have been legal�y created, ar�cl are conso7idatpd by a Plat
Adjustmert Map.

c. R-3-t�l-P zoniny conforms to the Chula Vista GeneraT P1an which
designates the area as "High Density Residential ," (13-26 DU/Acre).
3. The PTanning Commission recommends to the City Council that said
prezoning and rezoning be adopted.
4. That this resolution b� transmitted, along with the application, to
the City Council , and a copy of this resolution shall be transmitted to the
applicant.

The entire site is essentially flat and barren of vegetation. The soutf�
half of Kennedy Street borde��ing the property is unimproved. The aves�;crly

a fielc! investigatian i�� conjunction Vaith the Initial Study, staff found the

3. Proposed cievelopmen�. � -
No p7ans liave been subr�itted for tl�e deveTopment; however, the requested
zone cliaFige 4�rould permi� a r�aximum of 69 apartment uni�:s, con�pared to 71
units possible unaer the ex�isting City anci County zoning.
4. Adjacent lots. �
The lots bordering the site an th� east side, frontinc� on Second Avenue,
� whicl� are zoned R-3 in the Ccuniy, are presently developed �vith single family
detacl�ed d4vellings; ho�;��ver, they �tave sufficieii�t deptf� (13U'-170' } to be

property adjacent on the south car,r�ies the same zoning as proposed for Lhe
subject property. .
