ITEM EXPLANATION�
A. BACKGROUND
1 . The applicant, John Morgan ,for Morgan and Gardner, Inc. , has requested ~
rezoning to adjust a zoning boundary between the R-1 and R-3-P-13 zones within a
proposed 33 acre subdivision (PCS-76-9) on the north side of E Street between Corte
Maria and I-805. The R-3-P-13 zoning for this property �vas established by City Council
action on July 13, 1976.
2. The zoning boundary adjustment is required to bring the existing zoning into
conformity with the proposed Morgan/Gardner tentative map.
3. The Environmental Impact Report (EIR-76-11 } on this project was scheduled for -
certification by the City Council in consideration of the tentative subdivision map
for the area.
B. DISCUSSION
1 . This property has been studied for the proposed development of single family
residences on the upper level of the site and multiple residential development on the
lower east-facing slopes. A major concern in the rezoning of this property from
R-3-G-D to R-3-P-13 was the need to insure that special consideration would be �iven
to addressaing the following problems :

a. Preservation of a grove of mature eucalyptus trees to the east of
Hilltop Drive on the slope area separating the upper and lower levels
of the site;
b. Adequate screening and landscaping, both from "E" Street and I-805, to
insure separation from visual and noise impacts and creation of an
aesthetically pleasing development; and
c. Raising the lower R-3-P-13 zoned area above the 100 year flood level.
Specific conditions were contained in Resolution PCZ-76-F to insure that these
concerns would be addressed.
2. In the process of staff' s review of the slope areas between the R-3-P-13
zone and the R-1 zone it was determined and agreed to by the developer that, for the
sake of maintenance, the slopes containing both the existing eucalyptus grove and the
northward extension of the grove to be planted with new trees as part of the sub-
division development should be within the ownership of the down �lo�e, or R-3-P-13
lots. In order to achieve this goal , the lot boundaries have been adjusted to
include these areas. The applicant should be advised that in preparing precise
plans for development of the R-3-P-13 area, he should not assume density credit
for the slope areas being recommended for R-3-P-13 zoning.
3. Good zoning practice dictates that whereven possible zoning boundaries
should be drawn at property lines, both for purposes of legal description and to
avoid having the zoning standards for more than one zone apply to a single piece
of property.

TO THE CITY COUNCIL THE CHANGE OF "LONING BOUNDARIES OF �
R-] AND R-3-P-13 DISTRICTS ON FROPERTY NORTH OF "E"
STREET, BETWEEN CORTE MARIA AND I-805, M,pRGAN AND GARDNER, �

WNEREAS, John Morgan for Morgan and Gardner, Inc., requested rezoning �
to adjust a boundary between the R-1 and R-3-P-13 zones within a proposed 33- '
acre subdivision (PCS-76-9) on the north side of "E" Street between Corte Maria
and I-805, and
WHEREAS, the R-3-P-13 zoning for this property was established by City
Council action on July 13, 1976, and
MIHEREAS, the proposed subdivision Nas approved by the Planning Comnission ,
on March 9, 1977, and the zoning boundary adjustment is required to bring the
existing ioning into conformity with the approved map, and
WHEREAS, the Environmenta] Impact Report (EIR-76-11) on this project was
approved by the Planning Cormiission on March 9, i977.
WHEREAS, the Planning Commission set the time and place for a public
hearing on said application, and notice of said hearing, together with its
purpose, was given by the publication in a newspaper of general circulation in
the City at least ten days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m.,
March 9, 1977, before the Planning Cocr�nission, and said hearing was tFFereafter
closed.
NOW THEREFORE BE IT RESOLVED AS FOLLOWS:
1. From facts presented to the Commission, the Commission finds that
public necessity, convenience, general welfare and good zoning practice require
• the adjusting of the zoning boundartes of said R-1 and R-3-P-13 districts on
prbperty north of "E" Street, between Corte Maria and I-805, in order to avoid
having more than one zone apply to a single property, subject to the following
conditions: '
a. The grove of eucalyptus trees �n the site shall be preserved.

Removal of any trees shall be subject to prior approval by `
the Director of Planning. � �
b. Resculpturing of the slope area north of the existing eucalyp-
tus trees will be permitted; however, no buildings will be
permitted on the slopes. The slope shall undulate, retaining
