BACKGROUND 1 . The applicant, Robert Eerebout, requested a change of zone and prezoning in connection with annexation to the City of Chula Vi�ta. The majority of the subject property is located in the unincorporated area of Castle Park abutting the Chula Vista city limits. 2. An Initial Study, IS-76-109, of possible adverse environmental impact was conducted by the Environmental Review Committee on December 16, 1976. The Committee concluded that there would be no significant effects and made a draft Negative Declaration, which was certified by the Planning Commission on January 12, 1977. B. DISCUSSION 1 . BOARD/COMMISSION RECOMMENDATION� On January 12, 1977 the Planning Commission voted 6-0 to recommend that the City Council approve the prezoning and rezoning of the property at 1049 Third Avenue and 1052 Del Mar to C-T and R-3 in accordance with Resolution PCZ-76-T. AGENDA ITEM N0. �-,=5=� 13 Supplemental page No. 2 2. Existing zoning and prezoning/rezoning. This item involves the prezoning of approximately 1/2 acre of land on Third Avenue to C-T and approximately one acre to R-3. A nearby area of approximately 1700 sq. ft. is recommended for rezoning from C-T to R-3. The adjacent county area to the north is zoned C (commercial ) for a depth of 100 feet along Third Avenue, with the remaining county area east of Third zoned and developed for apartments (see locator) . With the exception of the first lot south of the subject property the commercial depth in the city is 187 feet along Third Avenue. Staff recommends retention of the 187 ft. distance to provide for adequate commercial depth. The 100 ft. depth utilized by the county has proven to be inadequate to provide the necessary parking, landscaping, and setbacks required for sound commercial development. The first lot south of the subject property facing on Del P�ar has been developed with apartment units; however, the rear 23 feet of the lot is still zoned C-T (thorough- fare commercial ) and, therefore, should be rezoned to coincide with the existing develop- ment and bring the zone boundary in line with the remaining developments which extend south to Naples Street. The proposed R-3 zoning involves approximateTy one acre of land located east of Third Avenue at the north end of Del Mar. A maximum of 32 units could be developed on this relatively level parcel which abuts R-3 zoning to the north and south. 3. General Plan The General Plan designation for this area is thoroughfare commercial along Third Avenue and high density residential adjacent to Del Mar. Therefore, the proposed zoning designations will be consistent with the General Plan. 4. Public Works ' comments. The Department of Public Works has noted that public improvements (curb, gutter and sidewalk) are nonexistent in this area. They have also pointed out that drainage problems will exist on the site to such an extent that a fairly extensive drainage system will be required to develop the property. While these items are not appropriate as conditions for approval of the prezoning, the applicant should be appraised of these facts and take them under consideration when development is proposed. � . ZONING MQP - 343 CHECKED QY RCSOLUTION Np, FCZr76�T ' RESOLUTION O� THE CITY PLANNING COMP4ISSION RECOh1MENDING TO THG CITY COUNCI� THF PI�E�OPJING AND REZONiNG OF 1 .63 ACRES LOCATCD AT 1049 THIRD AUENUE YND 1052 DEL MAR AVENUE TO C-T AND R-3 WHEREAS, a duly verified application for prezoning of property was filed witi� the Planning Department by �obert Eerebout on December 3, 1976, application No. PCZ-76-T, and WHEREAS, said application requested prezoning to C-T and R-3 for the . property located at 1049 Third Avenue, more fully described in said application, and WHEREAS, the City included for consideration of rezoning from C-T to R-3 the vrester�y 23 feet of the parcel at 1052 Del Mar Avenue, and WHEREAS, the Planning Commission set the time and place for a hearing on said applicatian, and notice of said hearing, together with its purpose, was given by the publication in a newspaper of general circulation in the City at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m. , January 12, 1977, before the Planning Commission, and said hearing was thereafter closed. NOW THEREFORE BE IT RESOLVED AS FOL_LOWS: 1. The Commission finds that in accordance with the Negative Declaration on IS-76-109 and the findings stated therein, this prezoning and rezoning will have no significant environmental impacts, and certifies that the Negative Declara- tion was prepared in accordance with CEQA, 1970, as amended. 2. From facts presented to the Commission, the Co�nission finds that public necessity, convenience, gesieral welfare and good zoning practi�e require: Prezoning the front portion of 1049 Third Avenue for a depth of 187 feet to C-T; prezoning the rear portion of 1049 Third Avenue, starting at a point 187 feet east of Third Avenue and extending to the east praperty line, a distance of approximately 433 feet, to R-3; rezoning the westerly 23 feet of 1052 Dea Mar Avenue from C-T to R-3 as shown on the attached exhibit. 3. Findings of fact in support of said determir�ation are as follows: a. C-T and R-3 zoning coincides with the zoning pattern established for adjacent land uses located directly ta the south. b. C-T ar�d R-3 zoning classifications are cc�n�istent with the Gene� al Plan designations for the area. 4. The Ple.nning Commission recommends to the City Council that the prezoning and change �f zone be approved. 5.
