Public hearing - Consideration of rezoning an 11 foot strip at the northwest
ITEM TITLE: corner of Fourth Avenue and E Street from C-T to R-3
Ordinance 1722 - Amending the zoning map to change the zone for an 11 foot by
160 foot area included in the parcel at 182 Fourth Avenue from C-T to R-3

ITEM EXPLANATION�
1 . The construction of a service station over 10 years ago at the northwest corner of
Fourth and E Street resulted in an 11 ft. wide strip of C-T zoned land not being utilized.
The strip was then sold to the owner of the adjoining R-3 zoned parcel to the north and is
now part of that parcel but retains its C-T zone designation. In order to rectify this
situation the Planning Department initiated the rezoning of this eleven foot strip from
C-T (Commercial�Thorougfifare) to R-3 (Multiple-family residential ) to bring the area into
conformance with the zoning of the larger portion of the site already zoned R-3 (75' x 150' } .
2. An Initial Study, IS-76-106, of possible adverse environmental impact was conducted
by the Environmental Review Committee on November 22, 1976. The Committee concluded that
there would be no significant effects and made a draft Negative Declaration, which was
certified by the Planning Commission on December 13, 1976.

It is the finding of the Environmental Review Committee that the project will not
haYe a significant effect on the environment for the following reasons:
� 1. There are no signifciant natural or man-made resources
� present on site whi.ch woul.d be adversely impacts by project

implementation.
2. The project is not at variance with the General Plan or
• - "' associated elements and is not anticipated to achieve short �
term to the disadvantage of long term goals. The proposed
rezoning will bring the entire project site in�o conformance
with the General Plan.
, 3. There are .no adverse impacts anticipated which could
interact to result in a substantial cumulative effect on the
environment.
� 4. The proposed apartment building wi12 not be a source of
significant stationary noise nor will �t cause the emission of
any hazardous substance that would be hazardous to human beings,

WHEREAS, the deveiopment of property at the northwest corner of Fourth �

Avenue and "E" Street, in the C-T zone, resulted in an 11 foot wide strip not �
being used, and subsequentTy sold and incorporated in the adjoining R-3 parcel, �

WHEREAS, the City Planning Commission initiated an application to con- 1

sider a change of zone for the 11 ft. by 160 ft. area from C-T to R-3, and j
WHEREAS, an Initial Study, IS-76-106, conducted by the Environmental �
Review Committee on November 24, 1976, concluded that there would be no signif- i
i
icant adverse environmental impact as a result of this rezoning action, and �
�
made a draft Negative Oeclaration, and j

WHEREAS, the City Planning Commission set the time and place for a !
i
,
hearing on said zone change, and notice of said hearing, together with its
. purpose, was given by the publication in a newspaper of generaT circulation in
the City at least 10 days prior to the date of said hearing, and
WHEREAS, a hearing was held at the time and place as advertised, namely •
7:00 p.m., December 13, 1976, before the Planning Corranission and said hearing
was thereafter closed.
NOW THEREfORE BE IT RESOLVED AS FOLLOWS:
� 1. The Planning Commission finds that in accurdance with the Negative
' Declaration on IS-76-106 and the findings stated therein, this rezoning will have
" no significant adverse environmental impact, and certifies that the Negative
' Declaration was prepared in accordance with CEQA 1970, as amended.

2. From facts presented to the Commission, the Commission finds that

` !- ,, public necessity, convenience, general welfare and good zoning practice require
; 'r �
� l " the change of zoning far an area 11 feet wide by 160 feet long, included in the
parcel at 182 Fourth Avenue, as shown on attached exhibit, from C-T to R-3.
• 3. Findings of fact in support of said determination are as follows:
a. Elimination of dual zoning on one parcel avoids the application �
, of two sets of development standards.
b. The change of zone is in substantial conformance with the General
Plan.
, . 4. The Planning Corr�nission recommends to the City Council that said
change of zone be granted.
5. That this resolution be transmitted to the City Council.
