1TEM EXPLANATION�
A. BACKGROUND
1 . The applicant requested a change of zone from R-1 to R-3-P-17 (multiple family
residential/17 dwelling units per acre, subject to approval of a precise plan) for a 4 acre
parcel . The Planning Department recommended that an adjacent 3.45 acre parcel located
between the applicant's property and East Orange Avenue also be considered for rezoning
from R-1 ta R-3-P-17.
2. The Environmental Impact Report (EIR-76-6) on this project was adopted by the
Planning Commission on November 8, 1976 and forwarded to Council on November 11 , 1976.
B. DISCUSSION
l . Adjacent zoning and land use:
North - R-3-G-P Single family attached dwellings
South - R-1 Single family dwellings (across Orange Avenue)
East - C-N Shopping center
West - R-3-G-P Apartments (Phase I, East Orange Plaza)
2. Existing conditions;
The property being considered for rezoning consists of two parcels currently zoned

STAFF RECOMMENDATION:
Concur with Planning Commission.
BOARD/COMMISSION RECOMMENDATION� On November 22, 1976 the Planning Commission voted 6-0
to recommend fihat the City Council approve the rezoning of approximately 7.45 acres located
north of E. Orange Avenue, west of Melrose, from R-1 to R-3-P-17 in accordance with
Resolution PCZ-76-M. In addition, Council should certify that EIR-76-6 for this project
has been completed in accordance with CEQA, 1970, as amended, and that the Council has
considered the EIR information in making its decision.

R-1 (residential , single family) of 4 acres to the north and 3.45 acres to the south
immediately adjacent to East Orange Avenue, with frontage on that public street. The
northernmost parcel constitutes a land-locked site requiring access through adjacent
parcels. Both of the parcels are currently vacant.
3. Proposal .
The applicant prop�ses a 60 unit apartment development on the northern 4 acres and
is requesting a change of zone to R-3-P-17 which would permit the property to be developed
with a total of 69 dwelling units based on the maximum density allowed. The 60 units
proposed and the related parking, yards and basic design meet the requirements of the R-3
zone. The development wi11 be an extension of the multiple famiTy complex adjacent on the
west which was built by the applicant.
4. General Plan.
The General Plan indicates the subject property as Commercial-Retail . Apartment
uses are currently permitted in the C-N zone under a conditional use permit. Therefore,
staff finds the proposal to be consistent with the General Plan.
C. ANALYSIS
1 . The present zoning of R-1 single family residential does not reflect a reasonable
use for the property because of its size, location or adjacent land uses. The proposed
rezoning would permit development of multiple residential dweTling units at a density
which will permit adequate open space and will be compatible with both the adjacent multi-
family residential uses and the shopping center to the east.
2. The owner of the included parcel to the south of the proposed East Orange Plaza,
Phase II, American Housing Guild, has submitted a letter to the Planning Commission in
support of the rezoning of both parcels. The letter is on file in the Planning Department.
3. Specific concerns related to this site are contained in the Environmental Impact
Report (EIR-76-6) and relate more to the development of the site than the zoning and will
be addressed under the Precise Plan.

WHEREAS, a duly verified applicati�n for change of zone was filed with the ��'
Planning Department by Celia Seligsan (Apco Development) on September 3, 1976, "
application No. PCZ-76-M, and a

WHEREAS, said application requested a change of zone for approximately
4 acres located north of East Orange Avenue, west of Melrose, more particularty >
described in said application, from R-1 to R-3-P-17, and
WHEREAS, the City Planning Comsnission included for consideration of rezoning
from R-i to R-3-P-17 an adjacent 3.45 acre parcel located between the applicant's .

. WHEREAS, the Planning Co�rnission set the time and place for a hearing on
said application, and notice of said hearing, together with its purpose, was
given by the publication in a newspaper of general circulation in the City at ,
� least 10 days prior to the date of said hearing, and ;
WHEREAS, a hearing was held at said time and place,• namely 7:00 p.m., �;
November 8 and November 22, 1976, before the Planning Commission, and said hearing !
was thereafter closed, and

WHEREAS,an Environmental Impact Report (EIR-76-S} on the project was adopted
by the Planning Commission on November 8, 1976. j
� NOW THEREfORE BE iT RESOLVED AS fOLLOWS: '
1. From facts presented to the Commission, the Commission finds that public �

necessity, coRVenience, generai welfare and good zoning practice require the �

thange of zone from R-1 to R-3-P-17 for approximately 7.45 acres located north of ., ;
East Orange Avenue, west of Melrose. �

2. The findings of fact in support of said determination are as follows:
a. The proposed use (apartments) is nat permitted under present zoning
but is considered a compatible use with the existing shopping center •

zone in this area does not represent good zoning practice.
b. Multiple family zoning conforms to the Gerseral Plan designation of -
retail comnercial as the three basic retail comnercial zones (C-N,
