4. During the past two years the City of Chula Vista has received and approved several
applications for the use and location of commercial coaches in connection with churches,
banks, and public facilities. These applications were processed as variance requests,
since the present provision of the Municipal Code were not applicable.
5. The use of the variance application for the processing of proposals to utilize
coaches as temporary building space is fraught with problems. The variance procedure
has been used in the past, more as a matter af expediency than as a matter of proper
administration of the zoning ordinance.
6. Under the proposed amendment, commercial coaches would be temporarily permitted in
the residential , commercial , and industrial zones of Chula Vista through the conditional
use permit process. The conditional use permit process would enable the Planning
Commission and City Council to apply those conditions of approval which are essential
to the protection of the order and amenity of involved territories. These conditions
could be varied to meet unique situations and applied on a case by case basis. The pro-
posed amendment would limit the tenure of a commercial coach utilized as buildign space
to a maximum of one year, with a possible extension of one year.
7. The Environmental Review Committee, meeting in regular session on July 29, 1976,
conducted an Initial Study (IS-76-48) on the proposed amendment; recommended the finding
that the said amendment would not have any possible significant impact upon the environ-
ment; and issued the attached draft Negative Declaration.

WIiEREAS, Section 19.53.33�, subsection C of the Plunicipal Code regulates
the permanent location and use of commercial coaches as building space in the
commercial and industrial zones, and
WHEREAS, the need is evident for the regulation of the use of coaches
as temporary building space in the residential, commercial, and industrial zones,
and
WHEREAS, the City Planning Commission set the tirne and place for a
hearing to cansider a proposed amendment to the Municipal Code, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m.,
September 27, 1976 in the Council Chamber, City Hall, 276 Fourth Avenue, before
the Planning Commission and said heariny was thereafter closed, and
WHEREAS, the Con�mission found that in accordance with the Negative
Declaration on Initial Study IS-76-48, the proposed zoniny text amendment would
not have any possible significant impact upon the environment and certified that
the tJegative Qeclaration was prepared in conformance with CEQA, 1970, as amended.
NOW TIIEREFORE QE IT RESQLVED AS FOLLOIJS:
1. From facts presented to the Planninc Commission> the Commission finds
. that public necessity, convenience, general welfare and good zoning practice
require that Sections 19.54.020 and 19.58.330 of the Municipal Code be amended
as follows:
a. Section 19.54.020 Designated--Limitatioris and standards, add new
subsection to read as follows:
"0. Trailers (commercial coaches): See Section 19.58.330."
b. Section 19.58.330 Trailers, add new subsection to read as
follows:
"D. Commercial coach units may be utilized as temporary
building space in conjunction alith public or quasi-public
uses lacated in residential zones, and in conjunction with
public, quasi-public, and private uses, such as banks,
insur�nce offices, savings and loan institutions, public
utility otfices, and similar public-service based uses in
commercial and industrial zones, p�°ovided that a conditional
use permit is procured for each cornmercial coach so utilized.
"All conditional use permits granted for the utilization
of commercial coaches as temporary building space shall
embody a time limit which shall not exceed one (1) year.
Upon application the Planning Commission may extend the
said time for a maximum of one (1) year."
2: The Planning Commission recommends to the City Council that said
amendment be adopted.
3. That this resolution be transmitted to the City Council.
