HomeMy WebLinkAboutOrd 2016-3364 ORDIt�'ANCE NO. 3364 ORDI?�iAi�'CE OF THE CITY OF CHULA VISTA ADDING CHIJLA VISTA MLTNICIPAL CODE CHAPTER 2.47 - `�HEALTHY CHULA VISTA ADVISORY COMMISSIOI�" WHEREAS; the Cin� of Chula Vista adopted the Health�� Chula Vista Initiative in 20li to promote the health and �i�ellbeing of residents through partnerships, programs and policies; and V�'HEREAS, on Januan� 5, 2016 the Cit�� Council adopted the Healthy Chula Vista Action Plan �=hich identifies a strateg�� of creatine a health ad��isorv commission to help guide the City ��ith policy and proerams under the Initiative; and �'HEREAS. Citv staff recommends that the Health�� Chula Vista Advisorv Commission be established, and has prepazed a draft ordinance to add Chapter 2.47 to the Chula \'ista Municipal Code; establishing rules and procedures for the Healthv Chula Vista Ad�isory Commission. NOW. THEREFORE, the Cih- Council of the Cirv of Chula Vista does ordain as follo��s: Section I. 7�hat Chapter 2.47 is hereby added to the Chula Vista Municipal Code, to read as follo��-s: Chapter 2.47 HEALTHY CHULA V[STA ADVISORY COMMISS[ON Sections: 2.47.010 Creation. 2.47.020 Purpose and intent. 2.47.030 Functions and duties. 2.47.040 Membership. 2.47.0�0 1�4eetine schedule. 2.47.010 Creation. The Healthy Chula Vista Ad��isory Commission ���as created as a result of the Health}� Chula Vista Action Plan adopted Januarv �. 2016. The Qeneral rules oovemina boards and commissions set forth in CVMC Chapter 2.2�, shall eo��em the Healthv Chula Vista Ad��isory Board, e�cept as specifically provided belo�v. 2.47.020 Purpose and intent. It is the purpose and intent of the Citv Council, in establishine the Board, to create an advisory and coordinatine bodv ��hich is to sen�e as a resource, to ad��ise and to make recommendations to the Citv Council, and Citv n9anager on health related policies and opportunities under the Healthti�Chula\'ista Initiati��e that ��ould benefit the communit��. Ordinance No. 3564 Page No. 2 2.47.030 Functions and duties. The functions and duties of the Health}� Chula Vista Advisory Commission shall be as follows: A. Serve as an advisory body to the City Council and City Manager. B. Periodically assess the health needs of the residents of Chula Vista and review health related policies and strategies, including the general plan and Healthy Chula Vista Action Plan to make recommendations to improve said plans to address identified community health needs. C. Perform such others functions or duties as may be delegated by the City Council. 2.47.040 Membership. A. The Healthy Chula Vista Advisory Commission shall consist of nine voting members, to be appointed in accordance with Article VI of the City Charter, CVMC Chapter 2.25, and this chapter. B. The voting members shall be appointed according to the following specifications: Fi��e members shall have expertise and experience in at least one of the focus areas of the Healthy Chula Vista Action Plan: Land Use, Transportation, Nutrition, Health Care, Physical Activity and/or Enviromnent; and tbe four remaining seats shall include a resident from each of the four City Council districts developed by the Chula Vista Districting Commission and approved by the Chula Vista City Council o� July 14, 2015, and shall, throughout their terms, maintain their residency and elector status. The aforementioned four members from each of the four council districts shall each be nominated by the Mayor after the Mayor consults with and receives a recommendation from the councilmember representing the council district. 2.47.050 Meeting schedule. The Commission shall hold regular meetings monthly on the second Thursday at 4:00 p.m., in the Council Conference Room (C-]O1), located in Building ]00 (Ciry Hall) in the Civic Center at 276 Fourth Avenue. The Commission may change its regular meeting day, time or location by written resolution in accordance ��ith CVMC section 2.25.200. Section IL Severability If any portion of this Ordinance, or its application to any person or circumstance, is for any reason held to be invalid, unenforceable or unconstitutional, by a court of competent jurisdiction, that portion shall be deemed severable, and such invalidity, unenforceability or unconstimtionality shal] not affect the validity or enforceability of the remaining portions of the Ordinance, or its application to any other person or circumstance. The City Counci] of the City of Chula Vista hereby declares that it would have adopted each section, sentence, clause or phrase of this Ordinance; irrespective of the fact that any one or more other sections; sentences, clauses or phrases of the Ordinance be declared invalid; unenforceable or unconstitutional. Coustruction The Ciq- Council of the Cit}� of Chula Vista intends this Ordinance to supplement; not to duplicate or contradict. applicable state and federal lati� and this Ordinance shall be construed in lieht of that intent. Section IV. Effective Date This Ordinance shall take effect and be in force on the thirtieth da�� afrer its final passaee. Section V. Publication The City Clerk shall certifi� to the passage and adoption of this Ordinance and shall cause the same to be published or posted according to la���.
