BACKGROUND 1 . On April 18 Council received a letter from Ms. Darlene Keller of Forest E. Olson, Inc. , asking that a means be found to allow limited professional or non-commercial recrea- tional use of some of the older historic sites in town as a means of preserving them. Council referred the item to the Planning Commission for a report and recommendation. 2. The proposed zoning text amendment will allow limited professio�a�esfwhich ei�ther private non-commercial recreation facilities in the R-1 and R-3 zones on have been designated as a historic site, have historic significance, or have been entered into the Historic Register, subject to the granting of a conditional use permit• 3. On June 28, 1978 the Planning Commission certified the Negative Declaration on IS-78-24 which is herewith forwarded to the City Council . B. ANALYSIS 1 . At present the City of Chula Vista has nine Historical Sites. The proposed zoning text amendment will encourage the preservation of some of the large single family homes which are so designated by allowing them to be converted to limited non-residential use. 2. The conditional use permit process combined with proposed development regula- tions (see attached resolution) will insure appropriate use of historic sites and limit impact due to non-residential vehicular traffic on residential streets. PCA-78-4 RESOLUTION OF THE �ITY PLANNING COf1MISSION RECOMMENDING TO THE CITY COUNCIL THE ADOPTION OF Ah1ENDMENTS TO TITLE 19 OF THE MUNICIPAL CODE TO ALLOW LIMITED OFFICES IN NISTORICAL BUILDINGS AND TO ALLOW PRIVATE NONCOP�P1ERCIAL RECREATIONAL FACILITIES IN THE R-1 APJD R-3 ZONES SUBJECT TO A CONDITIONAL USE PERMIT WHEREAS, the City of Chula Vista has designated certain buildings as historic sites to be preserved, and WHEREAS, requests have been submitted to the PTanning Commission to allow limited professional offices on sites so designated, and WHEREAS, the City Planning Commission set the time and place for a pubiic hearing to consider amendments to the Municipal Code to allow limited professional offices in designated historic buildings, and also to allow private noncommercial recreational facilities in the R-1 and R-3 zones subject to the granting of a conditional use permit, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m. , June 28, 1978 in the Council Chamber, City Hall , before the Planning Commission and said hearing was thereafter closed, and . WHEREAS, the Commission found that in accordance with the Negative Declaration on IS-78-74 and the findings stated therein, the proposed amendments will have no significant adverse environmental impact and certified the Negative Declaration. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: � 1 . From facts presented to the Planning Commission, the Commission finds that public necessity, convenience, general welfare and good zoning practice require that Title 19 of the Municipal Code be amended by adding the following: a. To Section 19.24.040 (R-1 zone) add subparagraphs D and E: D. Private, noncommercial recreational facilities, such as swimming pools, tennis courts, and clubhouses {for additional provisions see Sec. 19.58.100 and 19.58.270) . E. Professional offices (for additional provisions see Sec. 19.58.244) . b. To Section 19.28.040 (R-3 zone) add subparagraphs I and J: I . Private, noncommercial recreational facilities, such as swimming pools, tennis courts, and clubhouses (for additional provisions see Sec. 19.58.100 and 19.58.270). P J. Professional offices (for additional provisions see Sec. 19.58.244) . c. Add new Section 19.58.244 Professional Offices in the R-1 and R-3 zones. It is the intent of this section to allow for limited professional offices on certain lots within existing buildings in the R-1 and R-3 zones, when the Planning Cammission approves a conditional use permit therefor by applying the following guidelines: A. The lot should contain at least 12,500 sq. ft. of level , developable land. B. The lot is developed with a house or other structure which has been designated a historic site or has been recognized as having historic importance and has been entered into the Historic Register as provided in Chapter 2.68 of the Chula Vista Municipal Code. C. The lot is within 300 feet of a thoroughfare or a heavily traveled collector road. D. The use proposed on the lot is limited in scope so as not to generate substantial vehicular traffic on residential streets. 2. The Planning Commission recommends to the City Council that said amendments be adopted. 3. That this resolution be transmitted to the City Council .
