A. BACKGROUND
1 . The applicant is requesting rezoning o�1 .03 acres of a 1 .20 acre "L" shaped
parcel located west of the exist-ing Pep Boys store at 454 Br�adway from R-3 to
C-T-P. The parcel has 25 feet of frontage on Broadway and is split zoned R-3 and C-T.
2. The Negative Declaration on IS-78-6� was certified by the Planning Corranission
on June 14, 1978 and is herewith forwarded to City Council .
B. DISCUSSION

2. Existing site Characteristics
a. The subject 1 .20 acre site is an "L" shaped split zoned parcel with
25 feet of street frontage along Broadway. The 25 foot section extends back 300
feet from Broadway and �s zoned C-T. The remainder of the parcel measures 150' x
300' (1 .03 acres) and is zoned R-3. A natural drainage channel traverses diagonally
across a portion of the R-3 zoned property. Nearly one-fourth of the R-3 area
(southeast corner of the parking lot) is presently being used for Pep Boys parking.
This area was authorized for parking use through the granting of a conditional use
permit in 1968. The 25' wide section is also being used for Pep Boys parking.

D. Identification of environmental effects
Drainage
A unimproved drainage channel , semi-improved in areas , is in the
western portion of the property. Proposed grading and fill will
affect this channel and could create a flooding problem if not
properly designed and constructed. Approval of plans for such work
by the Director of Public Works will be required.
E. Mitigation measures necessary to avoid significant impact

F. Findings of insignificant impact
1. The project will not disturb any rare or endangered wildlife
and there are no geologic hazards or adverse soil conditions
known to be present. .
2 , The project is in general conformance with the General Plan

term to the disadvantage of long term environmental goals.
3 . The project is not anticipated to create any impacts which
could interact to cause a substantial cumulative effect on the
environment.

WNEREAS, a duly verified application for rezoning of property was filed with
the Planning Department by "The Pep Soys," Manny, Moe and Jack of California on
May 17, 1978, application No. PCZ-78-K, and
WHEREAS, said application requested a change of zone for 1 .03 acres located
adjacent to the west of property at 454 Broadway from R-3 to C-T-P, and
WHEREAS, an Initial Study, IS-78-68, was conducted by the Environmental
Review Committee on May 4, 1978, which concluded that there would be no significant
adverse environmental impact as a result of the project proposed for the site and
issued a draft Negative Declaration, and
WHEREAS, the City Planning Commission set the time and place for a public
hearing for the purpose of considering the change of zone, and notice of said
hearing, together with its purpose was given by the publication in a newspaper of
general circulation in the City at least 10 days prior to the date of said hearing,
and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m. ,
June 14, 1978, before the Planning Commission, and said hearing was thereafter
closed.
NOW, THEREFORE, BE iT RESOLVED AS FOLLOWS:
1 . The Commission finds that in accordance with the Negative Declaration
on IS-78-68 and the findings stated therein, this rezoning will have no significant
adverse environmental impact and certifies that the Negative Declaration was
prepared in accordance with the California Environmental Quality Act of 1^70,
as amended.
2. From facts presented to the Commission, the Commission finds that
public necessity, convenience, general welfare and good zoning practice require the
change of zone for 1 .03 acres adjacent to the west of 454 Broadway, as shown on the
attached plat, from R-3 to C-T-P, subject to the following conditions and precise
plan guidelines:
a. Conditions:
� ) The applicant's three parcels shall be consolidated into one
parcel .
2� The natural drainage channel traversing the site shall be
improved by the applicant when the area adjacent to the channel
is improved for use. The channel improvement shall include, but
not be limited to, transition and connecting structures as required

� 3) Plans for channel improvement shall be prepared by a registered
civil engineer and shall be subject to the approval of the City
Engineer.
b. Precise Plan guidelines :
1 ) A 6 foot high block wall shall be required along the south property
line to screen the site from the adjoining mobile home park use.
2} Every effort should be made to orient the commercial uses and
structures away from the adjoining R-3 areas.
3) The 10�0 landscaping requirement for the parking area shall
emphasize the use of trees.
3. The findings of fact in support of said determination are as follows:
a. The subject R-3 property is essentially landlocked and its development
in conjunction with the adjoining residential area is highly unlikely.
The property is currently under the same ownership as the commercial
properties to the east and can be developed more logically in conjunc-
tion with the use on Broadway.
b, The subject property is located in an area designated on the General
Plan which can be interpreted to be residential or commercial .
c. The property to which the "P" Modifying District is applied is bounded
on two sides by multiple family uses and on another side by a mobile
home park. The precise plan guidelines will assist in developing the
property in a manner which will not adversely affect these uses.
4. The Planning Commission recommends to the City Council that said change
of zone be approved.
5. That this resolution be transmitted to the City Council and a copy trans-
mitted to the owner of the owner of the property.
