ESTATES RESIDENTIAL PERI�4IT PARKII�'G D[STRICT
WHEREAS, on I�'ovember ]0; 201�; the Cin� Council adopted Ordinance No. 33�6,
which added Chula Vista Municipal Code Chapter 10.87, Residential Permit Pazkins Districts
and established a process for creatine a Residential Permit Pazking District (RPPD) in a
residential area: and
\4'HEREAS; the purpose of an RPPD is to limit on-street parkine by non-residents and to
facilitate the abilit�� of residents and their guests �vith permits to find on-street parking for their
��ehides near their residences: and
V�'HEREAS, in the months of�4ay and June 201�; a "Petition of Interest for Districr` ���as
circulated ���ithin the neiehborhood of South��estem Colleee Estates to evaluate interest for
establishine an RPPD: and
V�'HEREAS; pursuant to Section 10.87.030(a), a petition must be signed b�� at least fift��
percent (�0%) of the dwelline units in the area proposed for designation as a residential permit
parkino district; and
VJHEREAS, the petition circulated in Mav and June 201� and subsequend�� ��erified b��
staff showed that approaimatel�� se��enty percent (70%) of the residents petitioned �tiere
interesied in formine a District: and
�T�'HEREAS, pursuant to Section 10.87.030(b), staff promptiv studied the elieibility of a
residential permit parkine district in the South���estem Collese Estates neiahborhood_ and
WHEREAS, pursuant to Section ]0.87.030(b). as a result of this eligibilit�� smdy, staff
and the Ciri� Manaeer determined that the South���estem Colleee Estates neiehborhood is
materially and adversel�� affected by the parking of non-resident vehicies on public streets in the
area for eatended and continuous periods; and
V�'HEREAS; as a result of the petition, a communit�� meetine ���as held on Aueust 20.
201� among the City, Chula Vista Police Department, South�vestem Colleee Administration, and
South�vestem Colleae Estates residents re�ardine the formation of an RPPD: and
V�'HEREAS, input from the residents provided staff ���ith information to determine the
various details needed to establish an RPPD in South���estem Colle�e Estates: and

WHEREAS, all feedback was considered, and the final report was prepared and
presented to the Safety Commission on October 7, 2015, in which members of the public
participated and gave testimony; and
WHEREAS, the Safety Commission accepted staff's report and recommended that the
Chula Vista City Council approve the formation, boundary, hours of operation, and permit fee
amount for the Southwestem College Estates Residential Permit Parking District; and
WHEREAS, based upon public input at the Safety Commission meeting, the final district
boundary and street restriction map attached as Exhibit "A" was developed; and
WHEREAS, only the parcels (193 properiies) shown on the map that abut the proposed
restricted streets are eliaible to purchase parking permits; and
WHEREAS, the proposed restricted streets in the District are:
- Auburn A��enue: 800 block
- Columbia Street: 1600 block
- Elmhurst Street: 1600 block
- Fordham Ave: 800 block
- Gotham Street: 1600 block
- Harvard Street: 1600 block
- ]thaca Street: 1600 block
- Otay Lakes Road: 871 to 895 Otay Lakes Road
- Vassar Avenue: Elmhurst Street to Gotham Street
- Wayne Avenue: 900 block
- Xavier Avenue: 800 block
- Yale Street: 1600 block: and
WHEREAS, staff recommends that the permit issuance is in accordance with Section
10.87.080(b)(]) - (4) of the RPPD Ordinance. This allows for three (3) resident permits and one
(1) guest permit per residence. Each resident also may purchase up to four (4) temporary permits
per year. This should provide fair and equitable access to all residents in the District; and
WHEREAS, the parking permits will be issued for a one (1) year period and will be
required to be renewed on an annual basis; and
WHEREAS, based on the input from the residents, the parking restriction will be from 8
am to 5 pm Monday through Friday; and
WHEREAS, upon the City Council adoption of this resolution approving the
Southwestem College Estates Residential Permit Parking District the Ciry Manager will cause
signs to be erected indicating the parkin� restriction along the restricted street segments listed in
this resolution: and

�\'HEREAS. pursuant to California Vehicle Code section 22�07, such a parking
restriction sha11 not apply unti] sians or markings eivine adequate notice thereof are placed.
Additionall}�, enforcement will not beein until the Cin� has acquired the permits and allo���ed
residents a minimum of 30 da��s to purchase a permit; and
V�'HEREAS. based on cost estimates for the siens. sien installation and administration of
the District, the cost per annual permit shall be �20 per permit per year. This fee Hill be
reviewed periodicall� and adjusted accordineb as allowed in the Ordinance; and
V�'HEREAS. Chapter li — Pazl:ing Fees — of the Master Fee Schedule, Fee Bulletin li-
]00 sets out general parkine fees in Chula Vista; and
V�'HEREAS. as set out in an exhibit to this resolution. Fee Bulletin 13-100 shall be
amended to add the cateeorv. "Residential Permit Parkine Districts." and
V�'HEREAS. Fee Bulletin li-]00 also shall be amended to add the "South���estem
Colleee Estates Residential Permit Parkina Districr' and establish a �20.00 nonrefundable fee for
each 12-month resident parkine permit guest pazkine permit. and temporan� parkine permit; and
VdHEREAS; Anide XllI.C.I(e) of the California Constimtion defines a tas to mean an��
le���, charee, or e�action of any kind imposed by a local government unless specificall�-
exempted; and
�'HEREAS. the permit fee is e�empt from the definition of a ta� pursuant to Califomia
Constimtion Article XIII.C.1.(e)(3), because it is a reasonable regulator}� cost for issuine such
permits. the administrati��e enforcement and adjudication of the residential permit parking
district, and does not exceed the reasonable costs of administering the program and maintainin�
the district: and
N'HEREAS. pursuant to Section ]0.87.0�0. the Cit� Council finds that the
recommendation to establish a South�vestem Colleee Estates Residential Permit Parkin¢ District
complies ��ith the requirements of Chula Vista A4unicipal Code Chapter 10.87.
NOW. THEREFORE. BE IT RESOLVED b�� the Citv Council of the Citv of Chula
Vista that it approves the formation, boundan�, hours of operation. and amends the n4aster Fee
Schedule to establish a permit fee amount for the South���estem College Estates Residential
Permit Parkine District.
