RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA DENYING AN APPEAL AI�TD UPHOLDIIvG
THE PLANNING COMMISSIOI�' DECISIOI�' GRAI�'TING
APPROVAL OF DRI�-0003 FOR AN 87-UI�TIT MULTI-
FAMILY RESIDENTIAL PROJECT AT 701 "D" STREET
R%HEREAS, an application ���as submitted by City Ventures to the Development Senices
Deparrment on A4av 4; 201�, requesting a Design Re��ie��- Permit for an 87-unit multi-family
de��elopment project on a 4.3� acre site located at 701 "D" Street: and
W"HEREAS, the hearing �vas held at the time and place ad��ertised, namel}� December 9.
201�. at 6:00 p.m. in the Council Chambers, 276 Fourth Avenue. before the Planning
Commission. and the hearine ���as thereafter closed: and
\�%HEREAS, on December 9. ZOl�; the Planning Commission appro��ed the Design
RevieH Permit based upon e��idence presented at the public hearing and based upon the required
findines: and
«l IEREAS, on December 16. 201�, an appeal ��-as filed bv Dean Spooner; and
�'�'HEREAS. staff recommends that, based upon the findings made b}� the Plannine
Commission, that the City Council uphold the decision of the Planning Commission and den}�the
appeal; and
�4'HEREAS, the Ciq� Clerk set the time and place for the hearing on the appeal request
and notices of said hearing, toeether «�ith its purpose, ���as given by its publication in a ne«�spaper
of general circulation in the citv and its mailinos to properh� ow�ners ���ithin �00 feet of the
exterior boundaries of the Project Site at least ten (10) days prior to the hearing; and
W�-IEREAS, the dul�� called and notified public hearing on the appeal ���as heard before
the Cin� Council of the Cirv of Chula Vista on Februarv 2. 2016, in the Council Chambers in Cirv
Hali, Chula Vista Civic Center, 276 Fourth A��enue. at 4:00 p.m.
NOW. THEREFORE. BE IT RESOLVED that the Cirv Council, based on the evidence
presented. includin� the record of the Plannine Commission Hearing on this project, finds that
the project meets the requirements of the Cin�`s land use policies and the desien review manual
and, thus, denies the appeal and upholds the decision of the Planning Commission granting
appro��al of DR1�-0003 for an 87-unit multi-family residential project at 701 "D" Street.
