HISTORIC SITE �102. .AI�'D AUTHORIZII�'G THE I�4A1'OR TO SIGN SA1D AGREEn4Ei�'7� \1'HEREAS, Califomia Government Code Section �0280 et seq., referred to as the Mills Act authorized ci[ies to enter into agreements �t�ith the o��mers of qualified hisiorical properties to provide for the use, maintenance. and restoration of such historical properties so as to retain their characteristics as properties of historical significance: and WHEREAS, Council Polic��Number 454-01, adopted Ma�� 29. 2001, authorizes the Cit�� Council to enter into Mills Act Asreements with propem�o�j�ners of qualified historic properties; and V1'HEREAS; Council Policv Number 4>4-01, ���as made a part of the Cih•'s Historic Presen�ation Program, adopted in July 201 1; and \�1'HEREAS. the Cin� and the O«�ners of 88 K Sveet for their mutual benefit, no���desire to enter into a Milis Act A_reement both to protect and presen�e the characteristics of historical sienificance of this designated Hisrorical Site (Historic Site �102) and to qualifi� this Historical Resource for an assessment of valuation pursuant to the pro��isions of Article 1.9. (commencine «•ith Section 439) of Chapter 3 of Part 2 of Di�•ision 1 of the Califomia Revenue and Taxation Code (as amended from time to time): and �1'HEREAS, State legislation defines a qualified historic propem� as any propem-that is listed on a national, state or local historic reRister. and \1'HEREAS, the subject propem� is listed on the Chula Vista Reeister of Historical Resources and therefore is deemed a"qualified historic propem�': and WHEREAS. the Historic Preservation Commission at their reeular meetine held on December 2. ZOl�, reviewed the Aereement in its entiren� and ��oted to recommend that the Cih� Council approve the subject 1�lills Act Agreemenr. and WHEREAS, the Development Services Director has determined that this action is esempt pursuant to Califomia Em�ironmental Qualih�Act (CEQA). Section 1�331, Class 31, Historical Resources Res[oration and Rehabilitation of the state CEQA Guidelines. NOW, THEREFORE. BE IT RESOLVED that the Cirv Council does hereb�� approve the subject Milis Act Aereement ben��een the Cin� of Chula Vista and the owners of 88 K Street. located in the Cin• of Chula Vista. and authorizes the n9a��or to esecute said A�reement.
