LICENSE AND MAINTENANCE AGREEMENT FOR CHULA VISTA TRACT NO. 09-03 OTAY Rr1I`'CH MILLENIA PHASE 2 (EASTERN URBAI�' CENTER) BETVdEEN THE CITY AND SLF IV—MILLEI�'IA. LLC R'HEREAS; the Millenia Project, also l;no���n as the Eastern Urban Center (EUC), consists of approximately 207 acres of land located south of Birch Road and the Otay Ranch To�tim Center,just east of State Route 12� (the "Project '); and WHEREAS; on May 12, 2009, the oNmer of the Millenia Project, now SLF—Millenia, LLC (Developer), filed a dul�� verified application for the subdivision of the Project. As pan of the Conditions of Appro��al set b�� Resolution No. 2009-22� for the Ota�� Ranch Eastem Urban Center Tentati��e Subdi��ision Map (CVT 09-03). the Developer ���as required to enter into a Grant of Easements. License and A4aintenance Aereement �vith the Cit��: and WHEREAS; on September 23. 20li, the o��ner of the Project recorded Final Map No; 1�942 that subdivided the Project into 12 numbered and li lettered lots. Subsequently, on December 23; 20li, Cip� Council passed and adopted Resolution No. 20li-247 approving a Grant of Easements, License and Maintenance Agreement bet��een the Citv and the Developer for Millenia Phase 1. Millenia Phase 1 consists of Lots 1 through 9 and Lots "A" through "M" of Final Map No. 15942; and VdHEREAS, De��eloper ti-ill subdi��ide portions of Lots 10 through 11 of Final Map No. ]5942. also knoNm as Millenia Phase 2, and is required to enter into a Grant of Easements, License and Maintenance Agreement that N�ill allo�� and obligate Developer to perpetually maintain the landscaping; hardscape, and other facilities within the right-of-N�ay for Millenia Phase 2: and WHEREAS, the Development Services Director has revie���ed the proposed Project for compliance with the Califomia Em�ironmental Qualirv Act and has determined that the proposed Project is adequately co��ered in previous certified Final Second Tier Em�ironmental Impact Report (EIR 07-01) for Otav Ranch Eastem Urban Center (EUC) Sectional Planning Area (SPA) Plan and Tentati��e Map. Thus. pursuant to the Califomia Environmental Qualit�� Act; no additional environmental re��iew is required. NOW. THEREFORE. BE IT RESOLVED bv the Cit�� Council of the Citv of Chula Vista, that it hereby approves the Grant of Easements; License and Maintenance Aereemeni for Chula Vista Tract No. 09-03 Otay Ranch Millenia Phase 2 (Eastem Urban Center); bet��een the City and SLF IV—h4illenia, LLC. in the form presented. �vith such minor modifications as may be required or appro��ed by the City Attomev. a cop}� of H�hich shall be kept on file in the Office of the Cit}� Clerk, and authorizes and directs the Ma��or to esecute the same.
