AND AUTHORIZii�'G THE CITY n4A\'AGER TO EXECUTE THE AGREEMENT AI�iD UP TO THREE O\'E-YEAR EXTENSIONS V�'HEREAS, the Cit�� o��ns and operates the Chula Vista Animal Care Facilit.�. a municipal animal caze facility (`the Facility`) that sen�es the cities of Chula Vista, Imperial Beach. ?�'ational Citv and Lemon Grove: and R�HEREAS. the Facilit�� requires on-site veterinary senices. �ihich include checkine animals for siens of disease/injurv, providing or supen�ising treatment for sicklinjured animals, adherine to cuneni medical protocols and ensuring that staff is informed of and actine in accordance with such protocols. performing medical procedures requiring sedation, performine general surgerv as needed, and performine spay/neuter sureeries; and R'I-IEREAS, Dr. Tem� K. Paik, DVA4 has proeided these services in a satisfacton� manner since 2009. ensurine full veterinaz�• coveraee at the Facilitv: and W7IEREAS. the Cit}� Council most recentiv appro��ed the Dr. Paik contract to provide relief veterinar}� sen�ices on April 16. 2013 in Resolution No. 2013-0�6; and ��'HEREAS, the Cit�� Manaeer approved a sen�ice contract for Dr. Paik to cover Julv 1, 2015 to June 30, 2016, ti�hich may be administrati��eh� estended for up to three one-��ear terms. Sole-source approval is needed because the total amount of the contract will e�ceed $100,000; and A'HEREAS, since 2009 Dr. Paik has been part of a veterinar�� team that enables the Cit�� to meet a standard of care deemed necessarv bv Countv shelters and the Facilitv. as well as to provide sen�ices in accordance ti�ith State and Federal Drue Enforcement Agenc}� reeulations related to the care and treatment of animals: and y V�'HEREAS, shelter medicine is a unique area of veterinan� medicine, due in part to a hieh volume of spay-neuter surgeries. wfiich are required for all shelter animals adopted in � Califomia: and Resolution No. 2015-186 Page No. 2 WHEREAS. Dr. Paik has unique working knowledge and performance capabilities of the Facility's procedures, policies, and staff as a result of her work with the City that would be difficult to replace; and WHEREAS, in accordance with Chula Vista Municipal Code §2.56.070, competitive bidding requirements/sole source, Dr. Paik is selected to continue to provide relief veterinary services at the Facility based on her experience and demonstrated satisfactory performance capabilities in the unique practice area of shelter veterinary care and high-volume spay/neuter surgeries: and WHEREAS, Dr. Paik has agreed to provide relief veterinary services at the Facility under a one-year Agreement that may be administratively extended up to three additional one-year terms, at a daily or weekly rate not to exceed $55,000.00 per Fiscal Year, according to a work schedule agreeable to both parties; and WHER�AS, these funds are budgeted in the Facility's Fiscal Year 2015/2016 budget and any future allocations N�ill be considered as part of the annual budget process. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista, that it hereby waives the competitive bidding requirement in CVMC §2.56.070 as applied to the Agreement between The City of Chula Vista and Dr. Terry K. Paik, DVM For Spay/Neuter Surgery Services at the Chula Vista Animal Care Facility and the Chula Vista Animal Care Facility "Spay Shuttle and Adoption Module" bus, because the City's interests would be better served and because Dr. Paik since 2009 has demonstrated satisfactory performance capabilities in the unique practice area of shelter veterinary care and high-volume spay/neuter surgeries; and BE IT FURTHER RESOLVED that the City Council hereby approves a one-year Agreement between The City of Chula Vista and Dr. Terry K. Paik, DVM For Spay/Neuter Services at the Chula Vista Animal Care Facility and the Chula Vista Animal Care Facility "Spay Shuttle and Adoption Module ' bus, in the form presented, with such minor modifications as may be required or approved by the Ciry Attorney, a copy of which shall be kept on file in the Office of the City Clerk; and authorizes and directs the City Manager to execute the same and up to three one-year extensions of the Agreement.
