V1'HEREAS, the Citv o��ns and operates the Chula Vista Animal Care Facilit��. a
municipal animal care facilit�� (`the Facilin") that sen�es the cities of Chula Vista. Imperial
Beach. National Cit� and Lemon Grove: and
�L'HEREAS. the Facilin° requues on-site veterinarv services, ���hich include checking
animals for signs of disease/injurv, pro��iding or supen�ising treatment for sicl:/injured animals,
adherine to current medical protocols and ensurine that staff is informed of and actins in
accordance with such protocols, performing medical�procedures requiring sedation, performing
eeneral surger}� as needed, and performine spay/neuter sureeries; and
N'HEREAS, Dr. Vanessa Flores, VMD (Veterinariae Mediciniae Doctoris) has provided
these services on a relief basis in a satisfactorv manner since 2009. ensurine full veterinan�
co��eraee at the Facilirv: and �
l�'HEREAS, the City Council most recentl�� approved Dr. Flores' contract to pro��ide
relief ��eterinan� services on Februar�� 2. 2010 in Resolution No. 2010-067. This contract
pro��ided for one-}�eaz administrati�e estensions through June 30, 2014; and
R'HEREAS, the City Manaeer appro��ed a ser��ice contract for Dr. Flores to begin Jul}� l,
2014, with up to t��o one-��ear administrati��e estensions a��ailable. Sole-source appro��al is
needed because the total amount of the contract ��ill esceed $]00.000: and
WHEREAS, since 2009 Dr. Flores has been part of a ��eterinar�� team that enables the
Citv to meet a standard of care deemed necessan b.� Countv shelters and the Facilitv, as well as
[o provide services in accordance ��ith State and Federal Drug Enforcement Agenc�� regulations
related to the caze and treatment of animals: and
\�'HEREAS, shelter medicine is a unique area of veterinan� medicine, due in part to a
hieh ��olume of spa}�-neuter surgeries. ��hich are required for all shelter animals adopted in
i California: and
WHEREAS. Dr. Flores has unique ��=orking I:nowledge and performance capabilities of
, the Facilirv's procedures, policies. and staff as a result of her �t�ork �vith the Citv that ���ould be
� dif�icult to replace; and

WHEREAS; in accordance with Chula Vista Municipal Code §2.�6.070; competitive
bidding requirements/sole source, Dr. Flores is selected to continue to provide relief veterinary
sen�ices at the Facility based on her experience and demonstrated satisfactory performance
capabilities in the unique practice area of shelter veterinary care and high-volume spay/neuter
surgeries; and
WHEREAS, Dr. Flores has agreed to provide relief veterinary services at the Facility
under a one-year Agreement that may be administratively extended up to two additional one-year
terms, at a daily or weekly rate not to exceed $48,000.00 per Fiscal Year, accordine to a work
schedule agreeable to both parties; and
WHEREAS, these funds are budgeted in the Facility's Fiscal Year 2015/2016 bud�et and
any future allocations will be considered as part of the annual budget process.
NOW; THEREFORE, BE IT RESOLVED by the City Counci] of the City of Chula
Vista, that it hereby waives the competitive bidding requirement in CVMC §2.56.070 as applied
to the Agreement between The City of Chula Vista and Dr. Vanessa Flores, VMD For Relief
Veterinary Ser��ices at the Chula Vista Animal Care Facility, because the City's interests would
be better served and because Dr. Flores since 2009 has demonstrated satisfactory performance
capabilities in the unique practice area of shelter veterinary care and high-volume spay/neuter
surgeries; and
BE 1"C FURTHER RESOLVED that the City Council hereby approves a one-year
agreement between The City of Chula Vista and Dr. Vanessa Flores, VMD For Relief Veterinary
Services at the Chula Vista Animal Care Facility, in the form presented, with such minor
modifications as may be required or approved by the City Attorney, a copy of which shall be
kept on file in the Office of the City Clerk, and authorizes and directs the City Manager to
execute the same and up to two one-year extensions of the Agreement.
