RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
APPROVING AN AMENDMENT TO THE EXISTING MEMOP~ANDUM OF
UNDERSTANDING WITH THE INTERNATIONAL ASSOCIATION OF FIRE
FIREGHTERS LOCAL .2180, WESTERN COUNCIL OF ENGINEERS,
CHULA VISTA EMPLOYEES' ASSOCIATION AND POLICE OFFICERS
ASSOCIATION REGARDING THE PERSIAN GULF CONFLICT LEAVE
POLICY
The City Council of the City of Chula Vista does hereby resolve as
follows:
WHEREAS, at its meeting of February 12, 1991, the City Council authorized
the City Manager to meet and confer with bargaining units with the ultimate
goal of implementing a military leave benefit policy specific to the Persian
Gulf Conflict; and
WHEREAS, the following Persian Gulf Conflict Leave Policy was agreed to
by all four associations and will be included in the Memoranda of
Understanding by side letter:
Persian Gulf Conflict Leave Policy
Definition - persian Gulf Conflict Leave is paid absence from work
granted to employees who have been ordered to active military duty as a
result of the Persian Gulf conflict.
Eligibilit~ - Employees who are members of the reserve corps of the Armed
Forces of the United States or the National Guard or the Naval Militia
who have been ordered to active military duty as a result of the Persian
Gulf Conflict. Employees shall not be eligible for this paid leave for
the 30 days that they receive paid military leave pursuant to the
California Military and Veterans Code.
Duration - This leave is provided as temporary relief from financial
hardship due to loss of pay and benefits for employees on active military
duty as a result of the Persian Gulf Conflict. This paid leave shall
commence on the date which California Military and Veterans Code benefits
are exhausted. This paid leave shall cease on the date the employee is
officially released from the active military duty or 150 calendar days,
whichever occurs earlier.

Method of Computation - The amount of this paid leave shall be equal to
the employee's normal bi-weekly gross p~ (not including overtime pay)
offset by the amount of gross military pay for such duty, including all
military allowances paid to the employee. Employees will continue to
receive full benefits for that period including vacation and sick leave
accruals.
Condition of Payment Pa~qnents authorized under this policy shall be
conditioned upon compliance with procedures established by Director of
Finance and Director of Personnel.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby approve an amendment to the existing MOU's with
International Association of Fire Fighters (IAFF), Western Council of
Engineers (WCE), Chula Vista Employees' Association (CVEA) and Police Officers
Association (POA) regarding the Persian Gulf Conflict Leave Policy as set
forth hereinabove.
