HomeMy WebLinkAboutReso 1991-16075 RESOLUTION NO. 16075 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA REQUESTING THE BOARD OF SUPERVISORS TO REFRAIN FROM IMPLEMENTATION OF THE BOOKING FEES AUTHORITY UNDER SB2557 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Governor and California Legislature have attempted to shift State and County financial responsibilities to cities under provisions of SB2557 including the authorization of the County to charge cities for booking fees; and, WHEREAS, the San Diego County Board of Supervisors will consider implementation of the booking fee authority on Tuesday, February 26, 1991; and, WHEREAS, the Governor and the California Legislature have avoided their financial responsibilities by enacting measures that are poor public policy, which rob from one local government to finance another, and result in no real solution to the continuing financial problems facing all levels of government in California; and, WHEREAS, in the spirit of cooperation between cities and counties, Chula Vista requests the County to refrain from implementation until cities have had the opportunity to input on the content of the law and together cities and counties have had an opportunity to look at other legislative options; and, WHEREAS, SB2557 is vague regarding whether booking fees cover "booking fees or" other applicable charges as opposed to "booking fees and" other applic~le charges; and, WHEREAS, San Diego County is proposing a rate significantly higher than other counties which will pose significant hardships on local cities; and, WHEREAS, all 457 cities in California balanced their budgets only to find their budgets will be subsequently thrown out of balance by cost shifts and revenue losses designed to balance the budget of the State. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista supports repeal of SB2557 and supports alternatives that will provide adequate long-term funding for cities and counties. Resolution No. 16075 Page 2 - BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista requests the San Diego County Board of Supervisors to refrain from implementation of booking fees until the County and affected cities can consider together other legislative options. The leBislatlon also increases the vehicle license fee (VLF) and dedicates that increase to backfill any loss which counties may incur from the loss of thls "fee euthortty". ~mpact Under SS 2557, counties would receive $330 million from the fee authority. This assumes that counties can collect all available revenue. Cities and school districts have threatened lawsuits on both the bookinS fee authority and property tax administration charBe which would provide approximately $345 million, more than enouBh to backflll the loss from repeal of SB 2557 authority. The current split Of VLF funds between cities and counties mould remain the same and mould not be affected by the provisions of SB 169. Title Repeal of SB 2557 Booking Fees, 2B 169 Pronert~ Tax Char~es In addition, the Governor's b~dget is proposing a shift in program r~eponeibilities for mental health and public health programs to counties. The Governor intends to anpport those programs with an increase In VLF, amounting to $800 million. There Is additional revenue dedicated to these am programs from an increase in tax and alcohol, amounting to approximately $190 million. The estimated State and general fund savings from ehiftlng these programs to counties is approximately $940 million. These lssues will continue to he a part of the budget debate. In the lnter~n, staff Is rmcomnending mupport of SB 169 to ensure that City issues are put on the table when negotiations over the 1991~92 State budget are under consideration. The other proposals will continue to be closely monitored and lobbied at the appropriate time. Becolmendation That the Legislative Coff~nittee authorize staff to prepare appropriate letters in support of SB 169 and any additional clean-up leSislation to repeal SB 2557 and protect Chula Vista'e revenue base. Those issues are consistent with the adopted legislative program, thus requiring no Council action. Finance concurs with staff's racomtnendatlon.
