TO THE COU"NT1' AUD[TOR R%HEREAS, Communin� Facilities District (CFD) 14-M has been established in accordance «ith the "The Mello-Roos Communim Facilities Act oF 1982" ("The Acr'): and �1"HEREAS. pursuant to The Act. each �ear follo�+�ing the establishment of a Communit�� Facilities District, the Cin� Council ma�� pro��ide, bv resolution, for the le��� of the special ta� at the same rate (`�4a�imum Special Ta� Rate `) as provided bv the ordinance adopted: �i�hich established the respecti��e CFD, or at a lo��er rate; and WHEREAS, the Maximum Special Tac Rate for Communitv Facilities District 14-M is authorized to be le��ied for Fiscal Yeaz 201�/2016. are set forth in E�hibit A. attached hereto and incorporated herein b�� reference as if set forth in full; and WHEREAS, once the Cit}� Council pro�ides for the le��� of the special ta� bv resolution. the amount of the special ta� le��� is calculated and applied based on the pre��iously-appro��ed budeet for the respecti��e CFD and the appro��ed method of allocation; and WHEREAS, section >>340 of The Act permits the Cin Council to authorize the clerk or other official to file, �i�ith the Count�� Auditor; a cer[ified list of all parcels subject to the le��, includine the amount of ta.t to be le��ied on each pazcel for the applicable ta� }�ear; and �'�'HEREAS. the certified list must be filed on or before Auaust 10 of that tat vear. NOW. THEREFORE. BE IT RESOLVED that the Cit�� Council of the Cit�� of Chula Vista actine as the leaislative bod�� of Communit� Facilities District 14-M. does herebv: SECTION l. Establish the A4a�imum Special Tax Rates that ma�� be lecied for Fiscal Year 201�/2016 in Communitv Facilities District ]4-M. as the rates set forth in Exhibit A attached hereto. SECTION 2. In accordance with Califomia Go��emment Code section �3340. deleeate the authority to and designate the Cit�� A4anager, or his desienee, as the official to prepare and submit a certified list of ali parcels subject to the le��• of the Special Tax. including the amount of the Special Tax to be levied on each parcel for Fiscal Yeaz 201�/2016; Hhich Special 7a� shall be based upon the budget for each such communit�� facilities district as pre��iouslv approved Resolution No. 201�-189 Paee No. 2 by this Cin- Council and which shall not exceed the applicable Maximum Special Ta�c set forth in Eahibit A, and to file such list with the auditor of the County of San Diego on or before August 10, 2015 or such other later date with the prior wririen consent of such auditor.
