DEVELOPMENT
\'�'HEREAS, as a Department of Housine and Urban De��elopment (HUD) entitlement
communit��. the Cit�� of Chula Vista recei��es erant funds under the Home Investment
Partnerships (HOA4E) Proeram Grant Number A4-14-1�4C-06-0�0�. and
WHEREAS: pursuant to Council Resolution Number 2014-064, City Council approved
the HUD Annual Action Plan �ahich includes fundine for a Tenant Based Rental Assistance
Program (TBRA) using H01�4E funding; and
�1'HEREAS. HUD approved the Cit��`s Fiscal Year 2014/201� Annual Action Plan that
included fundina for a HOn4E TBEtr1 Proaram: and
�tiHEREAS. the Citv will ailocate SZ�0.000 in H01�4E funds for a TBRA to assist
elieible households ��fio meet the program requirements; and
�%HERAS. Cin� is seeking a Subrecipient to assist the Cit�� �vith implementing a TBRA
and to meet HUD's Jul�� 31. 201� deadline to commit H0�4E funds: and
R'l-IEREAS, on September 16. 20Li. an RFP ���as issued for agencies interested in
implementine a Rental Assistance Proaram using Emergencv Solutions Grant funds and onl�� one
response ���as received b�� South Bay Communih� Sen ices (SBCS) b}� the submittal deadline; and
WHEREAS. South Bav Communitv Ser��ices �vas selected due to its intimate
knowledae of and approach to implementino a rental assistance program; its extensive
experience, and abilitv to complete the sen�ices in a timelv manner; and

WHEREAS, the City finds that the nature of the services to be provided are unique and
specialized, that South Bay Community Services' has history of working w�ith the City since
2007, and that South Bay Communitp Services was the so]e respondent to the City's bona fide
RFP: and
WHEREAS. the City finds. given that the services to be provided are unique and
specialized in nature; that South Bay Community Services' has history of working with the Cit}�
since 2007. and that South Bay Community Sen�ices was the sole respondent to the Ciry's bona
fide RFP. that a ��aiver of the competitive bidding requirements is appropriate pursuant to Chula
Vista Municipal Code section 2.�6.070(B) (3) and (4); and
�'HEREAS, �iven the aforementioned, the Cin� wishes to waive the competitive
biddina requirements. and enter into a two-party agreement South Bay Community Sen�ices.
acting as a Subrecipient, to implement the TBRA utilizing the a��ailable HOME fund balance,
with an initial contract term; for a maaimum authorized amount of$250,000 for administrative
expenses and rental and security deposit assistance. A copy of said Agreement is on file with the
City Clerk's Office; and
WHERAS, the purchasing agent is authorized to execute three (3) one-year options to
extend the amount the contract, contingent upoa availability of HUD funding; and
WHEREAS; in the event that HUD withdraws the City's HOME funding, the City is not
obligated to compensate South Bay Community Services for program expenditures.
NOV�'; THEREFORL; BE IT RESOLVED, that the City Council for the City of Chula
Vista does herebv:
l. Based on the findings in the above recitals above which are herebv incorporated
herein, and additional testimony and evidence presented in support of this action, N-ai��e the
competitive bidding requirements pursuant to Chula Vista Municipal Code section
2.56.070(B)(3) and (4); and
2. Authorize the City Manager or his designee to execute the initial Agreement in an
amount not to exceed $250;000 between the City of Chula Vista and South Bay Communit��
Ser��ices for the implementation of an HOME TBRA in substantially the Porrn presented, subject
to such minor modifications as may be approved or required by the City Attorney's Office; and
3. Further authorize the Purchasing Agent to execute three one-year options to extend the
A_reement based on availability of HOM� entitlement funds from the U.S. Department of
Housing and Urban De��elopment.
