JUI�'E 201� (JRMP)" DOCUMEI�'T Ai\'D AUTHORIZII`TG THE SUBA4ITTAL OF SUBSEQUENT JRMP REPORTS AND UPDATES ALONG �'[TH THE VdQIP AI�Tt�'UAL REPORT TO THE SAN DIEGO REGIOt�'AL WATER QUALITY CONTROL BOARD WHEREAS, on May 08, 20li. the San Diego Reeional Water Qualit�� Control Board (Re�ional Board) adopted a new National Pollutant Dischazee Elimination S}�stem (1�'PDES) Permit and Waste Discharge Requirements for Discharees from the Municipal Separate Storm Se�ver Systems (n4S4) Drainine the �'�'atersheds ���ithin the San Diego Reeion, Order No. R9- 20li-0001 (Municipal Permit): and A%HEREAS, the Municipal Permit regulates discharoes to storm drain svstems within 18 municipalities in San Dieeo Count}�_ the Counn� of San Diego, the San Dieoo Counh� Reeional Airport Authorit}�. and the San Dieeo Unified Port District, as ���ell as li Copermittees in Orange Counn� and � Copermittees in Ri��erside Count}� (collecti��el�� referred to as "Copermittees"): and R'HEREAS: the Municipal Permit established a ne��� N�atershed-based approach by which the Copermittees plan and implement storm ���ater programs; and WIIEREAS. the ne�i° approach requires that the jurisdictions' storm �vater proerams address the priority receiving ���ater conditions, focusing efforts to�vazd measureable impro��ements in recei��ine ti�ater qualit�; and �4jHEREAS, the Municipal Permit requires Responsible Parties; in each of the reeion's N�atersheds, to de��elop A'ater Qualirv Improvement Plans; and A'HEREAS; the Municipal Permit places responsibilities on municipalities to pre��ent throueh enforcement of their ordinances and permitting requirements, discharges of pollutant(s) from their storm drainase svstems to the ���aters of the United States: and VdHEREAS. the San Dieeo Ba�� is the ultimate receivina ���ater bodv of the watershed that encompasses Chula Vista; and R'HEREAS: pursuant to Section 303(d) Clean V�'ater Act; 33 USCA Section 12�1 et seq.. the United States Em�ironmental Protection Aeenc}� (USEPA) and the Regional Board have declared San Dieeo Ba�� to be an impaired ���ater bodv and therefore: special restrictions apph to discharges from all municipalities ���ithin the San Dieeo Ba�� �1'atershed; and Resolution No. 2015-136 � Pase No. 2 WHEREAS. this condition demands extra vigilance and effort on the part of affected municipalities; and WHEREAS, the Cities of San Diego, Chula Vista, La Mesa, Lemon Grove, National City, Imperial Beach, San Diego Unified Port District (Pori of San Diego), San Diego Counh� . Regional Airport Authorit}�; County of San Diego and California Department of Transportation, collectively referred to as the Responsible Parties (RP) developed the San Diego Bay Water Quality Impro��ement Plan (WQIP) document in response to the requirements of the Municipal Permit: and WHEREAS, each Copermittee is also required to update their .Turisdictional Runoff Manaeement Program (JRMP) and other relevant program documents and standards by June 27, 201� in order to be in compliance with the Municipal Permit; and WHEREAS, the purpose of the WQIP is to guide the Responsible Parties' Jurisdictional Runoff Management Programs (JRMPs) toward achieving improved water quality in MS4 discharges and receiving waters; and WHEREAS, in the San Diego Bay WQIP, priorities and goals are established and strate�ies selected for implementation by the Responsible Parties in order to achieve progress toward improving water quality. This approach establishes the WQIP as the foundation that each Responsible Party uses to develop and implement its JRMP; and WHEREAS, Responsible Parties' JRMPs contain the strategies, standards and protocols by which each Responsible Party will implement its individual program in response to the priorities and goals established in the Water Quality ]mprovement Plan; and WHEREAS, the V�'QIP Plan identifies goals related to each Highest Priority and Focused Priority. Furthermore; individual schedules for each goal were established; and WHEREAS, together, the goals and schedules define the targets that the Responsible Parties use to develop their programs and to measure progress; and WHEREAS. the JRMP is an outline of the program to be implemented by Cit}� staff, as required by the Municipal Permit, to ensure that all new development and redevelopment existing industrial, commercial, residential, municipal land uses, and construction sites impleroent adequate pollution prevention measures and BMPs, as well as conduct necessary monitoring and reporting: and WHEREAS, the JRMP is a dynamic document, and includes: inventories of active construction and building sites; commercial and industrial facilities; lists of minimum and recommended BMPs, Best Available Technologies, and Best Conventional Technologies; and, locations of sensitive areas and impaired water bodies; and Resolution No. 201�-li6 Pase No. 3 WHEREAS, the JR�9P document includes the o��erall program to be implemented b}� the Cit�� w�ithin its jurisdiction durine the life of the D4unicipal Permit and covers major components as follows: (1) Leeal Authority Establishment and Enforcemenr; (2) Illicit Discharee Detection and Elimination; (3) Development Plannine: (4) Construction ?�4anaeement: (�) Existing De��elopment Manasement: (6) Enforcement Response Plan: (7) Public Education and Participation; (8) Fiscal Anal��sis; and �1%HEREAS, required b�= the Municipa] Permit. each ��eaz the City �vill submit its JRI�4P report and updates along �+�ith the San Diego Ba�- WQIP annual report to the Regional Boazd. Am- program modifications will be for the advancement of the Cit��`s program and �vill compl}� with all regulations as presented in the Municipal Permit; and WHEREAS: the City is currentiv continuing to implement the storm water qualit� proeram that ���as de��eloped for compliance Nith the pre��ious \'PDES Municipal Permit, Order No. 2007-0001, and Municipal Code Section 14.20; and �'�%HEREAS. updatine the Ciri`s Ordinances, authorizine the submittal of San Diego Ba�� (V�'QIP); appro��ing and authorizing the submittal of the "Ciri- of Chula Vista JRMP document to the Regional Boazd bv the due date of June 27. 201�, are requirements of the A4unicipal Permit; and A'HEREAS, non-compliance �vith said requirements ��'ill result in a ��iolation of the Municipal Permit and espose the Citv to enforcement action, including I�'otices of Violation and/or monetan fines as ���ell as possible third pam� suits. NO�', THEREFORE, BE IT RESOLVED by the Cit�� Council of the Cit�- of Chula Vista. that it approves and authorizes the submittal of San Dieeo Bav (WQIP); appro��es and authorizes the submittal of the "Cin� of Chula Vista Jurisdictional Runoff A4anaeement Proeram. June 201� (JRMP) document, and authorizes submittal of subsequent JRMP reports and updates alone ��ith the WQIP annual report to the San Diego Regional ��%ater Qualit�� Control Board.
