I RECITALS
A. Project Site
VJHERE.AS_ the areas of land ��fiich are the subject of this Resolution contain all lands
within the boundaries of Eshibit 1 attached hereto and incorporated into this Resolution bv this
reference. and includes approximatelv 3� acres of land aenerallv located south of Ol��mpic
Pazk�ra�. «est of EastLal:e Pazkwa�� and east of SR-12� within the Otav Ranch Planned
Communit� Free�ti�a} Commercial North (FC-2) area; and
B. Project; Application for Discretionan� Approvals
R'HEREAS. in Juh�. 2012. the Cit�� of Chula Vista deemed the Bald«�in and Sons. LLC
(Applicant) application complete and initiated a General Plan Amendment (GPA) and Ota��
Ranch General Development Plan Amendment (GDPA) (the "Projecr`); and
WHEREAS, the proposed GPA im�olves amending portions of the Land Use and
Transportation element oF the City`s General Plan, indudine associated text, maps and tables;
and
WHEREAS, the proposed GDPA involves amendine portions of Part II of the Otay
Ranch General Development Plan (GDP). includine associated tezt, maps and tables; and
WHEREAS, the proposed GPA and GDPA are contained in a document entitled "PA12 —
FreeN�a�� Commercial North (FC-2) Amendment (GPA 12-]3. PCM ]2-1>), Mazch 3015" as
represented in Eshibit 2 incorporated herein b�� this reference and on file in the Office of the Cit��
Clerk: and
C. Prior Discretionan� Appro��als
WZ-IEREAS, the City of Chula Vista's current General Plan ���as last comprehensi��ely
updated in December 200�: and
WHEREAS; the Otay Ranch General Development Plan �vas approved on October 23,
I993, and most rece�tl}� updated on December 2, 2014: and

WHEREAS, the GPA and GDPA as presented are necessary to accommodate the land
uses anticipated in the associated Development Agreement (DA) between the City of Chula Vista
and Village II To�m Center, LLC and Sunranch Capital Partners, I_LC for Freeway Commercia]
North (FC-2) ("Development AgreemenY'); and
�VHEREAS. the GPA and GDPA were designed to address and accommodate
development of a transit-supportive miaed use residentia] development with a�cillary commercial
and a highly amenitized urban park; and
WHEREAS, the next step in the process would require the approval of an amendment to
the Sectio�al Planning Area (SPA) Plan, and a Tentative Map (1'M) for Freeway Commercial
North (FC-2); and
D. Planning Commission Record of Application
WHEREAS, pursuant to California Govemment Code section 6�090, the Planning
Commission held a duly noticed public hearing on the GPA and GDPA on April 22, 201�; and
WHEREAS, the proceedings and all evidence introduced before the Planning
Commission at the public hearing on this Project held on April 22, 2015, and the minutes and
resolution resulting there from, are hereby incorporated into the record subsequent to these
proceedings; and
WHEREAS, the Planning Commission voted 0-4-2-1 reeommending that City Council
deny the Project; and
E. City Council Record of Application
WHERLAS, the City Clerk set the time and place for the hearing on the GPA and GDPA
and notice of said hearing, together with its purpose �iven by its publication in a ne��spaper of
general circulation in the City, at least ten days prior to the hearing; aud
WHEREAS, pursuant to California Government Code section 65090, the City Council
held a duly noticed public hearing on May 12, 2015, on the subject GPA and GDPA.
NOW. THEREFORE, BE IT RESOLV�D the City Council hereby finds and determines
as follo��s:
11. COMPLIANCE R'ITH CEQA
That the De��elopment Services Director has reviewed the proposed project for
compliance with the California Environmental Quality Act and has determined that the project
���as covered in the previouslti� adopted Final Environmenta] Impact Report for the Otay Ranch
Freeway Commercial Sectional Planning Area (SPA) Plan — Planning Area 12 ("FEIR-02-04")
(SCH#19890101�4). The Development Services Director has determined that only minor
technical changes or additions to this document are necessary and lhat none of the conditions
described in Section 15162 of the State CEQA Guidelines calling for the preparation of a
subsequent document have occurred; therefore, the Development Services Director has prepared
an Addendum to FEIR-02-04.

7-he Cin� Council of the City oFChula Vista finds that. in the exercise of their independent
re��ie« and judement. the .Addendum [o FEIR-02-04 in the form presented, has been prepared in
accordance with the requirements of the Califomia Em ironmental Qualit�� .Act and the
Environmental Re��ie�a Procedures of the Cin of Chula Vista and has considered the Addendum
to FEIR-02-0�.
III. GE\TERAL PLA\' II�77ER�'AL CONSISTENCl
The Cit�� Council hereb�� finds and determines that the General Plan, as amended. is
intemall�� consistent and shall remain intemall� consistent follo�+�ins amendment thereof bv this
Resolution. y
IV. GE\'ERAL DE\%ELOPME\'T PLAi\' IIvTERIvAL CONSISTENCY
The City Council hereb} finds and determines that the General De��elopment Plan, as
amended. is intemallv consistent and shall remain internall�� consistent follo���ina amendment
thereof bv this Resolution.
V. ADOPTIO?�' OF GEI�TERAL PLAN AND GENERAL DEVELOPMENT PLAI�'
AA4ENDI�4E\'TS
In light of the findings abo��e. the General Plan and General Development Pian
Amendment provisions are hereb�� approved and adopted in the form as presented in Eahibits 2
and 3 incorporated herein b}� this reference and on file in the Cit�� Clerk's Office. This approval
is conditioned; and shall onl�� become effective upon; City Council adoption and the effectiveness
of an ordinance approvins that certain development agreement considered and amended b�� the
Citv Council concurrentiv here��ith, in a final form approved by the Cih Attome��.
