PREPARATION FOR THE REFU�'DING OF SE�'ERAL

W'HEREAS. the Cit�� formed Communit�- Facilities District (CFD) No. 12-1: CFD No.
2001-1 Improvement Area B. CFD No. li-1, and CFD No. 07-L CFD No. 97-3. CFD No. 99-1.
CFD No. 2000-1, CFD No. 2001-1 IA .4. Reassessment District (R.AD) No. 200�-2; and
R'HEREAS. the Cin� desires to refund the bonds issued for each of the districts described
abo��e in order to pro�ide interest rate sa��ines to the propem� o��mers �+'ithin these districts; and
�'�'HEREAS, the City desires to contract with ��arious qualified consultants �vho �vill
assist the Cih����ith the refundin� of the outstandine bonds: and
\�rHEREAS. the Cit�� desires to obtain cenain consultins services ���ith NBS Govemment
Financine Group for Refunding Disclosure services for Communitv Facilities District (CFD) No.
12-1, CFD I�'o. 2001-1 Improvement Area B, CFD No. li-l. and CFD No. 07-1, CFD No. 97-3.
CFD No. 99-1. CFD No. 2000-1, CFD No. 2001-1 IA A, Reassessment District (RAD) No.
200�-2: and
�'��HEREAS: \TBS has been the Cin`s special ta� adminisvator for over te� }�ears and, as
a result, it is uniquel�� qualified to assist the Citv �rith the refunding of nine special ta� districts
because of their experience and familiarih� with the Districts being considered for refunding; and
�1'HEREAS. pursuant to Chula V'ista �4unicipal Code section 2.�6.070.B.3.. the Cih�
Council has determined that the Ciri�`s competitive biddine requirements are impractical in this
instance and the Cit.`s interests ���ould be materiallv better served bv de��iatine from those
requirements because NBS' e�tensi��e e�perience and unique ►:no��•ledae of the districts beine
considered for refundino ���ill allo�� the Cit�� to proceed e�peditiousl�� �vith the bond refunding in
order to capitalize on current market interest rates.
NOV�'. THEREFORE. BE IT RESOLVED bv the Citv Council of the Citv of Chula
Vista, that it approves the agreement, berneen the Ciri� and NBS Govemment Financin� Group,
in the form presented, «�ith such minor modifications as ma�� be required or approved by the Cit��
Attornev, a cop}� of��hich shall be kept on file in the Office of the Cin Clerk, and authorizes and
directs the Mavor to e�ecute same.
