REDUCI?�TG THE STM383 CIP BUDGET BY �200.000 I?�' TRANSNET FUI�TDS AI�'D APPROPRIATII�'G THE EQliIVALENT AMOUTiT TO STM361 (�12�.000) AI�'D STL394 (�7>;000), AND PROVIDI?�'G THE CERTIFICATION A?�D IIvDEA4NITY STATEMENTS I�'ECESSARY TO OBTAItv TRAi\SNET FU`ivDS WHEREAS, on November �. 2004. the voters of San Diego County approved the San Dieeo Transportation Improvement Proeram Ordinance and Espenditure Plan (Trans?�Tet Eatension Ordinance); and V�'-HEREAS. the Transi�ret E�tension Ordinance pro��ides that SAI�'DAG, actino as the ReQional Transportation Commission, shall appro�e a multi-��ear proeram of projects submitted b�� local jurisdictions identifying those transportation projects elieible to use transportation sales ta.i (TransNet) funds; and V�'-HEREAS. in Februarv 201�, the City of Chula Vista �vas pro��ided �vith an estimate of annual TransNet local street improvement revenues for Fisca] 1'ears 2016 through 2020; and WHEREAS. Council adopted the TransNet Local Sveet [mprovement Proeram of Projects for Fiscal Years 2014/201� through 2018/2019 for inclusion in the Regional Transportatio❑ Impro��ement Program (RTIP) on A9av 6, 2014. throu_h passage of Resolution 201�-066: and WT-IEREAS. Council subsequently adopted the modification of the Chula Vista portion of the 201�3 RTIP as part of Amendment 3 on March 3: 201�, throueh passaee of Resolutions 201>- 0�8 and 201�-0�9: and �l%HEREAS, a 4/�th ��ote ��as required for Resolution 201�-068. ��hich pro��ided additional fundine of �1�0,000 for Third Avenue Impro��ements Phase III in Fiscal Yeaz 2014/201�_ due to the need to appropriate funds. This was adopted too late to be included in Amendment 3: and WHEREAS. SAI�iDAG sent a letter dated A4arch �. 201�. to all member asencies with unspent TransNet Local Streets and Roads funds. The ]etter indicated that the unspent funds must be reallocated to active projects b}� June 30, 201�; and � Resolution I�'o. 201�-113 Pase No. 2 WHEREAS; in the March 3. 201�; RTIP Amendment, $18,295 from closed projects were returned to unallocated cam�o��er. In accordance ti�ith SANDAG's March Sth letter, these funds, as well as those in closed projects; must be reallocated to a specific project before .Tune 30; 201�; and WHEREAS, additional funding is required for several projects. TransNet fundin� is a��ailable for these projects, as sho��n on Exhibit A; and WHEREAS, staff recommends amending the re��ised TransNet Local Street lmpro��ement Program of Projects for Fiscal Years 2014/201� through 2018/19 for inclusion in the Reeional Transportation Improvement Pro�ram (RTIP) as show�n on Eahibit A; and VdHEREAS. the Cit�� of Chula Vista has held a noticed public meeting on Ma}� l2. 2015. with an agenda item that cleazlv identified the proposed list of projects prior to approval of the projects by its authorized legislative bod�� in accordance with Section 5(A) of the TransNet Extension Ordinance and Rule 7 of SANDAG Board Policy No. 31. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista; that it certifies that in accordance «�ith Section 2(C)(1) of the TransNet Eatension Ordinance. no more than 30 percent of its annual re��enues shall be spent on maintenance-related projects. BE IT FURTI3ER RESOLVED by the City Council of the City of Chula Vista, that it certifies, in accordance with Section 4(E)(3) of the TransNet Extension Ordinance, that all new projects; or major reconstruction projects, funded by TransNet revenues shall accommodate travel by pedestrians and bic��clists, and that any exception to this requirement permitted under the Ordinance and proposed shall be clearly noticed as part of the City of Chula Vista's public hearing process. BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista; that it certifes; in accordance v��ith Section 8 of the TransNet Extension Ordinance, that the required minimum annual level of local discretionary funds to be expended for street and road purposes will be met throughout the 5-}�ear period consistent with the most recent Maintenance of Effort Requirements adopted by SAI�'DAG. BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista, that it certifies_ in accordance with Section 9A of the TransNet Extension Ordinance, that it N=ill collect $2,209; plus all applicable annual increases; from the private sector for each ne��ly constructed residential housing unit in that jurisdiction to comply with the provisions of the Reoional Transportation Conaestion Improvement Program (RTCIP). BE IT FURTHER RESOLVED b}� the City Council of the City of Chula Vista, that it certifies, in accordance with Section 13 of the TransNet Extension Ordinance, that it has established a separate Transportation Improvement Account for TransNet re��enues H�ith interest earned expended onlv for those purposes for which the funds were allocated. BE IT FURTHER RESOLVED b�� the Citv of Chula Vista. that it aerees to indemnifi. hold harmless, and defend SAI�'DAG. the San Dieeo Countv Re�ional Transportation Commission. and all officers and emplo��ees thereof asainst all causes of action or claims related to Citv of Chula Vista's Trans1`'et funded projects. BE IT FURTHER RESOLVED bv the Citv Council of the Cit�� of Chula V'ista. that it adopu the amendment to the TransNet Local Street Impro�ement Program of Projects for Fiscal Years 2014/201� through 2018/2019 for indusion in the RTIP. reduces the STA•i383 CIP budeet b�� 200;000 in Trans\'et funds and appropriates the equi�alent amount to STA4361 (�12�,000) and STL394 (�75,000).
