RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
ACCEPTING BID AND AWARDING CONTRACT FOR "PLACEMENT OF
ASPHALT CONCRETE OVERLAY (lggO-91 PROGRAM) ON VARIOUS
STREETS IN THE CITY OF CHULA VISTA, CALIFORNIA"
The City Council of the City of Chula Vista does hereby resolve as
follows:
WHEREAS, the following eight bids were received and opened at 2:00 p.m.
on the 5th day of December, 1990, in Conference Rooms 2 and 3 in the Public
Services Building of the City of Chula Vista for placement of asphalt concrete
overlay (1990-gl Program):
Sim J. Harris Company $264,149.32
San Diego
Daley Corporation $266,000.00
San Diego
Caves Construction $298,991.40
San Diego
R.L.F., Inc. $299,629.40
San Diego
R. E. Hazard Contracting Company $303,182.12
San Diego
ABC Construction Company, Inc. $303,714.04
San Diego
V.R. Dennis Construction Company $312 199.10
San Diego
Frank and Son Paving, Inc. $354,480.30
Chula Vista
and
WHEREAS, the bid by Sim J. Harris Company had a minor irregularity in the
bid bond and due to a clerical error, the wording "Ten Percent (10%) of the
amount bid" was omitted and staff recommends the Council waive this minor
irregularity; and
WHEREAS, staff received an excellent bid for the proposed overlay work,
much below that anticipated and in comparing this year's low bid with last
year's low bid, the actual prices overall are lower this year; and

WHEREAS, because of this excellent bid, staff is requesting Council
authorization for the City Engineer to execute a change order with Sim J.
Harris Company such that we utilize all the funds currently budgeted in this
year's CIP for pavement overlay; and
WHEREAS, it has been recommended that said contract be awarded to the
lowest responsible bidder, Sim J. Harris Company, who has assured the City
that they are a licensed contractor in the State of California and can produce
an acceptable performance bond.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista has reviewed the specifications for the construction of said project and
does hereby approve same.
BE IT FURTHER RESOLVED that the City Council does hereby waive the minor
irregularity in Sim J. Harris' bid bond due to a clerical error in omitting
the wording "Ten Percent (10%) of the amount bid.
BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista
does hereby acknowledge receipt of said eight bids, and does hereby award the
contract, known as document number C090-282, for said asphalt concrete overlay
to Sim J. Harris Company in the amount of $264,149.32 to be completed in
accordance with the specifications as approved by the Director of Public Works
of the City of Chula Vista.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and
he is hereby authorized and directed to execute said contract for and on
behalf of the City of Chula Vista.
BE IT FURTHER RESOLVED that the City Engineer is hereby authorized to
execute a change order with Sim J. Harris Company to include additional
streets requiring a 1-1/2 inch thick asphalt concrete overlay.
