HomeMy WebLinkAboutReso 1921-65 RESOLUTION NO. 61 • t RESOLUTION OF INTENTION NO. 61 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF CHULA VISTA DECLARING ITS INTENTION TO IMPROVE PORTIONS • OFNAT IONAL AVENUE AND SECOND S T R E E T IN SAID CITY, AND DESCRIBING THE DISTRICT TO BE ASSESSED TO PAY THE OOSTS AND EXPENSES OF SAID IM- PROVEMENT. The Board of Trustees of the City of Chula Vista do resolve as follows: SECTION 1. That the public interest and convenience requires and it is the intention of the Board of Trustees of the City of Chula Vista to order the following improvements to be made in said City, to-wit: FIRST: That all of the center eighteen (18) feet of the roadway of National Avenue, from the Southerly boundary line of the City of Chula Vista to the Westerly prolongation of the Southerly line of Second Street, together with such portions of intersecting streets as are included therein, and all of Second Street and inter- section of Second Street and National Avenue included within the following described parcel of land: Beginning at a point on the center line of Second Street fifty (50) feet Easterly from its intersection with the center line of National Avenue; thence Northerly parallel with the center line of National Avenue nine (9) feet; thence Westerly parallel with the center line of Second Street nineteen (19) feet to the point of beginning of a curve concave Southeasterly having a radius of forty (40) feet; thence Southwesterly along said curve sixty-two and eighty- three hundredths (62.83) feet; thence Southerly parallel with the center line of National Avenue nine (9) feet to the produced South- . -1- erly line, of Second Street; thence Easterly along said produced Southerly line of Second Street eighteen (1a) feet; thence Southerly parallel with the center line of National Avenue twenty-nine feet (29) to the point of beginning of a curve concave Southeasterly having a radius of sixty (60) feet; thence Northeasterly along said curve ninety-four and twenty-five hundredths. (94.251 feet; thence Westerly parallhl:with the center line of Second Street nineteen • (19) feet; thence Northerly parallel with the center line of National Avenue nine (9) feet to point of beginning, be graded and paved to the official line and grade with Bituminous Base four (4) inches in thickness and with an Asphalt Concrete Pavement wearing surface one and one-half (1-1/2) inches in thickness, in accordance with Flan No. 304A, and in further accordande with Specifications No. 3, for the construction of Asphalt Concrete Pavement on Bituminous Bape in the City of Chula Vista. SECTION 2. That said contemplated work or improvement in the opinion of said Board of Trustees is of more than local or ordinary.public benefit and will affect and benefit the lands and district hereinafter described and said Board of Trustees hereby declares that the district in the said City of Chula Vista benefited by said work or improvement and to be assessed to pay the costs and expenses thereof, is described as follows: All that 'mid portion of the City of Chula Vista included within the following described exterior boundary line, to-wit: Beginning at the intersection of the center linesof H Street and Fourth Avenue; thence Southerly along the center line of Fourth Avenue to the center line of First Street; thence Easterly along the center line of First Street to the Easterly boundary line of the City of Chula Vista; thence- Southerly and Westerly along the Easterly and :southerly boundary lines of the City of Chula Vista to an intersection with the produced center line of Bay Boulevard, said point being sit- uated nineteen hundred and eighty feet, (1980), more or less, Westerly from the center line of National Avenue; thence Northerly along said produced center -2- • • line and said center line of Bay Boulevard to the center line of H Street; thence Easterly along said center line of $ Street to the center line of Fourth Avenue, the point of beginning, excepting therefrom any portion of any public street or alley included therein. • Reference is hereby made to Map number 305, adopted for said work, • in which the assessment district referred to is shown within red colored border lines. SECTION 3. Notice is hereby given that serial bonds to represent unpaid assessments for the expense of said proposed work and improvements, which bonds shall bear interest at the rate of seven per cent per annum, will be issued hereunder in the manner provided by the "Improvement Bond Act of 1915" the last installment of which bonds shall mature nine years from the second day of July next succeeding nine months from their date. All the herein proposed work, except as herein above stated, shall be done in pursuance of an Act of the Legislature of the State of California, designated as the "Improvement Act of 1911," approved April 7, 1911, and the amendments thereto. SECTION 4. Notice is hereby given that on the 9 day of , , 1921, at the hour of 7:30 p.m. of said day, at the Council Chamber of the Board of Trustees of said Oity of Chula Vista, in the City Hall, sit- uated on the 'Westerly side of Third Avenue, just Northerly of F Street in said City, is hereby fixed and designated as the day, hour and place, when and where any and all persons having any objections to the proposed work or improvements herein designated, may appear before said Board of Trustees and show cause if any they have, why said pro- posed improvements should not be carried-Cut in accordance with the -3- • provisions of the Resolution of Intention. SECTION 5. The City Engineer is directed to make a diagram of the property affected or benefited by the proposed work or improvement as described in this Resolution of Intention and to be assessed to pay the expenses thereof. Such diagram shall show each•separate lot, piece or parcel of land, the area in square feet in each of said lots, pieces or parcels of land, the relative location of the sans to the work proposed to be done, all within the limits of the assess- ment district. SECTION 6. All Maps and Plans referred to herein are on file in the office of. the City Engineer of the said City. All specifications referred to herein are on file in the office of the City Cl^rrk of . said City. Said Maps, Plans and Specifications are hereby referred to for a more particular description of said work and made a part hereof. SECTION 7. The Chula Vista Star, a weekly newspaper of general air- t oulation, published and circulated in said City of Chula Vista is here- by designated as the newspaper in which this Resolution of Intention and notice of the passage thereof, shall be published in the manner and by the persons required by law. SECTION 8. The Superintendent of Streets of said City shall immed- iately cause to be conspicuously posted along the line of said contem- plated work or improvement, and in front of all property to be assessed, and along all the open streets within the above described assessment district, notices of the passage of this Rein lution of Intention in - the manner and form required by law. SECTION 9. The City Clerk of said City of Chula Vista is hereby dir- ected to cause this Resolution of Intention to be published by two in- sertions in the manner required by law in said Chula Vista Star. -4- k A ti Adopted and approved this c day of , 1921.
