RESOLUTION OF INTENTION '

<4 RESOLUTION OF THE BOARD OF TRUSTEES OF THE CI\PY
OF CHULA VISTA, DECLARING ITS INTENTION TO ZSPROVE
PORTIONS OF SECOND AVENUE, THIRD AVETUE, E STREET,
F STREET, AND SECOND STREET, IN SAID CITY, AND DES- ;
CRIBING THE DISTRICT TO BE ASSESSED TO FAX THE COSTS
AND EXPENSES OF SAID IMPROVEMENT.
THE BOARD OF TRUSTEES OF TEE CITY OF CHULA VISTA DO RESOLVE•AS FOLLOWS:
SECTION 1.
That the public interest and convenience requires, and it is
the intention of the Board of Trustees of the City of Chula Vista to order the
improvements specifically described in this Resolution of Intention.
SECTION 2.
The construction of all curbs, gutters, sidewalk, Portland cemaat
concrete pavement, Warrenite pavement on Bituminous base, Standard Guard Fence,
coping, skid-stops or any other improvement described in this Resolution of
Intention shall .be done in accordance with Plan No. 275, Sheets 1 to 7 inclu-
sive, and in further accordance with. Specifications No. 2, for the construct-
ion of cement curbs, sidewalks and gutters; Portland cement concrete pave-
ment; Warrenite pavement on Bituminous Base; and Standard Guard Fence in the
City of Chula Vista.
The grading and paving hereinafter described shall include the grading
and paving of all intersections of streets, avenues, drives, courts and alleys
included within the limits of the streets and avenues to be improved as described 1
herein and shown on Plan No. 275, but shall be omitted upon such portions of the I
roadway of said streets and avenues on which the Dement gutter specified in
this Resolution of Intention is to be constructed.

The construction ,of all curbs, gutters, sidewalks, Portland cement
concrete pavement, Warrenite pavement on bituminous base, or any other
improvement described in this Resolution of Intention, shall be omitted
' herein
upon arch portions of the streets and avenuesidescribed as may be required
by law to be kept in order or repair by any person or company having rail-
road tracks thereon.
SECTION 3.
The improvement herein above referred to is as follows, to-wits
Firsts That the center eighteen (18) feet of the roadway of Second
Avenue, from the northerly boundary line of the City of Chula Vista to the
northerly line of D Street, be graded and paved to the official line and
grade with a Portland cement concrete pavement five inches (5 inches) in
thickness.
Seconds That those portions of the roadways of Second Avenue, E
Street, F Street, Third Avenue. and Second Street hereinafter 'described
in Parcels A to L, inclusive, be graded and paved to the official line
and grade with a bituminous base three (3) inches in thickness, and with
a Warrenite pavement wearing surface one and one—half (1 1/2) inches in
thickness.
Parcels A to L are described as follows, to-wits
PARCEL A
The center eighteen (18) feet of the roadway of Second Avenue, from
the northerly line of D Street to a line drawn parallel with and fifteen
(15) feet northerly from the northerly line of E Street.
PARCEL B
The center eighteen (18) feet of the roadway of E Street, from the
easterly line of National Avenue to a line drawn parallel with and fifteen
(15) feet westerly from the westerly line of Second Avenue, and from a
line drawn parallel with and fifteen (15) feet easterly from the easterly
line of Second Avenue to a line drawn parallel with and twenty (20) feet
Westerly from the Westerly_line of Third Avenue.

The following portion of Second Avenue, E Street, and their inter-
section:
Beginning where a line drawn parallel with and nine (9) feet Westerly
from the center line of Second Avenue intersects a line drawn fifteen (16)
feet Northerly from and parallel with the Northerly line of E Street;
thence along a curve concave Northwesterly, having a radius of forty-six
(46) feet' to an intersection with a line drawn parallel with and fifteen
(15) feet Westerly from the Westerly line of Second Avenue; thence South
erly parallel with Second Avenue eighteen (18) feet; thence along a curve
concave Southwesterly, having a radius of forty-six (46) feet, to the

The center eighteen (18) feet of the roadway of Third Avenue from a
line drawn parallel with and twenty (20) feet Southerly from the Southerly
line of E Street to a line drawn across Third Avenue three hundred ninety

All that portion of the roadway of Third Avenue, described as follows,

drawn parallel with and three hundred thirty (330) feet Northerly from the
Northerly line of G Street, excepting from said portion of Third Avenue the
following described portions of the roadway of Third Avenue, which are to
be reserved for parks, to-wit;
First: Beginning at a point on a line drawn parallel with and nine
(9) feet Westerly from the center line of Third Avenue, distant ten (10)
feet Southerly from the South line of F Street; thence Southerly parallel
with the center line of Third Avenue to a point ten (10) feet Northerly
from the Westerly prolongation across Third Avenue of the Northerly line
of Center Street; thence along a curve to the left concave Northerly,
having a radius of ten (10) feet, to an intersection with a line drawn
parallel with and eleven (11) feet Easterly from the center line of Third
Avenue; thence Northerly parallel with said center line of, Third Avenue

one hundred forty and forty hundredths (140.40) feet Northerly from the
Northerly line of G Street; thence Northerly parallel with the Westerly
line of Third Avenue one hundred thirty-seven (137) feet; thence Northerly
in a straight line to a point situated four (4) feet Easterly from the
Westerly line of Third Avenue and three hundred thirty (330) feet Northerly
from the Northerly line of G Streeh; thence Easterly parallel with the
Northerly line of G Street seventy-two (72) feet to a point fourteen (14)
feet Westerly from the Easterly line of said Third Avenue; thence Southerly
in a straight line to a point situated two hundred seventy-seven and four-tenths

The two strips of the roadway of Third Avenue, each twelve (12)
feet in width, the Westerly side of the Easterly strip and the Easterly
side of the Westerly strip being situated four and five-tenths (4.5)
feet Easterly and Westerly from the original center line of Third
Avenues and-extending from a line drawn across Third Avenue one hundred
forty and four-tenths (140.4) feet Northerly from and parallel with the
Northerly line of G Street to a line drawn parallel with and nine (9)
feet Northerly from the'Norther)y line of Second Street and from a line

a radius of fifty-one (51) feet to a line drawn parallel with and forty

Westerly from and parallel with the center line of Third Avenue inter-
sects a line drawn parallel with and forty-nine (49) feet Northerly
from the center line of Second Street; thence along a curve concave
Northwesterly having a radius of forty(40) feet to an intersection with
a line drawn parallel with and sixteen and five tenths (16.5) feet
Westerly from the Westerly line of Third Avenue; thence Southerly
parallel with Third Avenue eighteen (18) feet; thence along a curve con-
cave Southwesterly having a radius of forty (40) feet to an intersection

Avenue, and from the Easterly line of National Avenue to a line drawn
across Second Street eight hundred (800) feet Easterly from and parallel

PARCEL L
All of the roadway of F Street from the Westerly line of Second
Avenue to the Easterly line of Fourth Avenue, excepting therefrom the
Southerly twelve (12) feet of the roadway of F Street, from the Easterly
line of Del Mar Avenue to the Westerly line of Fourth Avenue.
Third: That the center eighteen (18) feet of the roadway of Second
Street from the Easterly line of Second Avenue to a line drawn across
Second Street eight hundred (800) feet Easterly from and parallel with
the Easterly line of National Avenue, be graded and paved to the official
line and grade with a Bituminous base four (4) inches in thickness and With
a Warrenite pavement Wearing Surface one and one-half 11 1/2) inches in
thickness. ' •
Fourths That cement skid stops shown on the aforereferred to Plans
be constructed upon •Second Avenue from the Southerly line of C Street to
a point nine hundred (900) feet Southerly therefrom, the outer or street
face of said skid stops being situated nine (9). feet Easterly and Westerly
from the center line of said Avenue.
Fifth: That standard guard fences be constructed upon Second Avenue
from a line drawn across Second Avenue twenty-(20) feet Southerly from
the Northerly boundary line of the City of Chula Vista to a point nine

hundred (900) feet Southerly therefrom. The outer or street face of said
guard fences to be placed eleven (11) feet either side of the center line
of said Secbnd.Avenue, excepting that the Northerly and Southerly ends of
said guard fence shall be placed fourteen (14) feet from said center line,
tapering to eleven (11) feet from said center line at a point ten (10)
feet from the ends of said guard fence.
Sixths That a cement curb be constructed along both lines of the
roadway of F Street from the Westerly line of Second Avenue to the Easterly
line of Fourth Avenue excepting that said curb shall be omitted along the •
Southerly line of the roadway of F Street from the Easterly line of Del Mar
Avenue to the Westerly line of Fourth Avenue and that said curb shall be

constructed along both lines of the roadway of Third Avenue from a line
drawn across Third Avenue two hundred ninety (290) feet Northerly from
and parallel with the Northerly line of F Street to a line drawn across
Third Avenue three hundred thirty (330) feet Northerly from and parallel
with the Northerly line of G Street.
The construction of said curbs to include full returns at all street
and alley intersections omitting however such portions of said streets upon
which a cement curb has already been constructed and now exists to the
official line and grade.
Seventh: That a cement coping of the size and character shown on the
aforereferred to plans be constructed around the two portions of the road,
way of Third Avenue described in Parcel F, Section 3 hereof, which are to •
be reserved for parks. The outer or street face of said coping to be
coincident with the exterior boundaries of said portions of the 'roadway
so reserved.
, Eighth: That a cement sidewalk fifteen and one-half (15 1/2) feet
in width be constructed along the westerly side of Third Avenue from the
Southerly line of F Street to the Northerly line of Center Street. The
construction of said sidewalk shall include the construction of full returns
at the intersection with F Street and Center Street.
Ninth; That cement sidewalks twelve (12) feet in width and nineteen
(19) feet in length be constructed across the two portions of the roadway of
Third Avenue described in Parcel F, Section 3 hereof, Which are to be o

reserved for Parks. The center line of the walk in the park between F C

Street and Center Street being situated parallel with and one hundred fbr'C.y-five
(145:2) feet Southerly from the Southerly line of F Street and the center line
of the walk in the park between Center Street and Madrona Street being situ-
ated parallel with and one hundred fifteen (115) feet Southerly from the,
Easterly prolongation across Third Avenue of the Southerly line of Center

Tenths That a cement gutter five (5) inches in thickness and
eighteen (18) inches in width be constructed along both curb lines of F
Street from the Westerly line of Fourth Avenue to the Easterly line of Sr
cond Avenue and along both curb lines of Third Avenue from a line drawn
across said Third Avenue two hundred ninety (290) feet Northerly from
and parallel with the Northerly line of F Street to a line drawn
across said Third Avenue three hundred thirty (330) feet Northerly
from and parallel with the Northerly line of G Street, excepting
therefrom all intersections or terminations with said F Street and
Third Avenue of all streets, Avenues and Alleys within said described
limits.
Eleventh: That a cement gutter five (5) inches in thickness
be constructed across the Northerly side of the intersection of F
Street with Fourth Avenue, Del Mar Avenue and Landis Avenue; across
the Northerly side of the termination of Twin Oaks Avenue and Garrett
Street with F Street; across the Northerly side of the termination
with F Street of all alleys between Fourth Avenue and Second Avenue.
The outer or street edge of said gutter to follow a line drawn across
said intersections or terminations seventeen and five tenths (17.5)
feet Southerly from the Northerly line of F Street. The inner edge
of said gutter to follow the face of curb on the Northerly side of
F Street to am intersection with a line drawn parallel with and four-
teen'and five tenths (14.5) feet Southerly from the Northerly line
of F Street. Thence across the intersection or termination, as the
case may be, along said line so drawn, to an intersection with the
face of curb 'on the opposite side of the intersection or termination.
Thence along said face of curb to the produced property line of said
Street, Avenue or Alley. .

That a cement gutter five (5) Inches in thickness be constructed
across the Southerly side of the intersection of F Street with Fourth
Avenue, Del Mar Avenue and Landis Avenue and across the Southerly
side of the termination with F Street of all Alleys between Fourth
Avenue end Second Avenue, the outer or street edge of said gutter
to follow a line drawn across said intersection or termination seven-
teen and five tenths (17.5) feet Northerly from the Southerly line
of F Street. The inner edge of said gutter to follow the face of the
curb on the Southerly side of F Street to an intersection with a
line drawn parallel with and fourteen and five tenths (14.5) feet
Northerly from the Southerlylline of F Street. Thence across said
intersection or termination along said line so drawn, to an inter-
section with the face of curb on the opposite side of the intersec-
tion or termination. Thence among said face of curb to the produced
property line of said Street, Avenue, or Alley.
That a cement gutter five (5) inches in thickness be constructed
across the Westerly side of the intersection of Center Street with
Third Avenue, the outer or street edge of said gutter to follow a line
drawn across said intersection seventeen and five tenths (17.5)
feet Easterly from the Westerly line of Third Avenue. The inner
edge of said gutter to follow the face of the curb on the Westerly
side of Third Avenue to an intersection with a line drawn across
said intersection fourteen and five tenths (14.5) feet Easterly from
the Westerly line of Third Avenue. Thence across said intersection,
along said linp so drawn, to an intersection with the face of curb
on the opposite side of said intersection. Thence along said face
of curb to the produced property line of said Center Street.
That a cement gutter five (5) inches in thickness be constructed
across the Easterly side of the intersection of Third Avenue with Center
Street and Madrona Street. The outer or street edge of said gutter
to follow a line drawn across said intersections fifteen and five tenths

(15.5) feet Westerly from the Easterly line of Third Avenue. The inner
edge of said gutter to follow the face of curb on the Easterly side
with
of Third Avenue to an intersection with a line drawn parallel and twelve
and five tenths (12.5) feet Westerly from the Easterly line of Third
Avenue. Thence across said intersection along said line so drawn, to
an intersection with the face of curb on the opposite side of the inter-
section. Thence along said face of curb to tie produced property line
of said Street.
Twelfth: That a cement gutter five (5) inches in thickness
and thirty-six (36) inches in width be constructed across the Westerly
side of the intersection of Third Avenue with Madrona Street.
SECTION 4.
Reference is hereby made to Warrenite License Mixture Agreement
of Warren Brothers Company, dated April 18, 1919, and on file in the
office of the Superintendent of Streets of the City of Chula Vista.
SECTION 5.
That said contemplated work or improvement in the opinion of said
Board of Trustees is of more than local or ordinary public benefit
and will effect and benefit the lands and district hereinafter des-
cribed and said Board of Trustees hereby declares that the district
in the said City of Chula Vista benefited by said work or improvement
and to be assessed to pay the costs and expenses thereof, is described
as follows:
All that portion of the City of Chula Vista included within the
following described exterior boundary line, to-wit:
Beginning at a point on the Northerly boundary. line of the City
of Chula Vista, distant eight hundred five (805) feet South 71°39'
West from the Westerly line of National Avenue;
Thence South 31° 49' West 2200 feet;
Thence South 82° 09' West 2500 feet;
Thence South 69° 59' West 1280 feet;
Thence South 18° 01' East 950 feet;
Thence Borth 69° 29' East 1200 feet;

The following parcels of land included within said assessment dis-
trict above mentioned are hereby declared to be in uge •for the per-
formance of public functions., and shall be omitted from the assessment
hereafter to be made to cover the costs and expenses of said work or im-
provement,
The Grammar School site; being all except the Easterly thirty
(30) feet of Lot 16, Quarter Section 137. The Public Library site;
Easterly
being the Westerly two hundred twenty (220) feet of theXtvm hundred
fifty (250) feet of Lot 19 of Quarter Section 137 as said Quarter
and
Section 137 is shown on San Diego Land3\Town Co's Map of Chula Vista, as
per map No. 505 thereof filed in the office of the County Recorder of
San Diego County, California, March 13, 1888. The City Hall Site; being
Lot 14, Block E of Mohnikes Subdivision, as per map No. 1284 thereof,
filed in the office of the County Recorder of San Diego County, Cali-
fornia, September 12, 1910,
Reference is hereby made to Map number 276, adopted for said work,
' in which the assessment district referred to is shown within red colored
border lines.
SECTION 6.
The Board of Trustees of the City of Chula Vista determines that

serial bonds shall be issued to represent assessments of twenty-five •
($25.00) dollars or over for the cost of said work or improvement;
said serial bonds shall extend over a period ending nine (9) years from
and after the second day of January next succeeding the date of said
bonds, and an even annual proportion of the principal sum thereof shall
be payable by coupon on the second day of January every year after
their date until the whole is paid; and the interest shall be payable
semi-annually by coupon on the second days of January awl. July res-
pectively of each year, at the rate of seven (7) per cent per annum
on all sums unpaid until the whole of said principal and interest are
paid. A11 of the herein proposed work shall be cone in pursuance of
an Act of the Legislature of the State of California designated as the
"Improvement Act of 1911," approved April 7, 1911, and the amendments
thereto.
SECTION 7.
Notice is hereby given that on the day of September, 1919, at
the hour of 7:30 P.M. of said day, at the Council Chamber of the Board
of Trustees of said City of Chula Vista, in the City Hall, situated on
the Westerly side of Third Avenue, just Northerly of P Street in said
City, is hereby fixed and designated as the day, hour and place, when
and where any and all persons having any objections to the proposed
work or improvement herein designated, may appear before said Board of
Trustees and show cause if any they have, Why sad proposed improvements
should not be carried out in accordance with the provisions of this
Resolution of Intention.

SECTION 8.
The City Engineer is directed to make a diagram of the property
affected or benefited by the proposed work or improvement as described in
this Resolution of Intention and to be assessed to pay the expenses thereof.
Such diagram shall show each separate lot,piepe or parcel of land, the

area in square feet in each of said lots, pieces or parcels of land, the
relative location of the same to the work proposed to be done, all within
the limits of the assessment district.
Sr70TION 9.
All Plans referred to in this Resolution are on file in the office
of the City Engineer of the said City. Al]. specifications referred to in
this Resolution are on file in the office of the City Clerk of said. City,
Said Plans and Specifications are hereby referred to for a more particular
description of said work and made a part hereof.
SECTION 10.
The Chula Vista Review and Chula Vista Star, weekly newspapers of
general circulation, published and circulated in said. City of Chula Vista,
are hereby designated as the newspapers in which this Resolution of Inten-
tion, and notice of the passage thereof, shall be published in the manner
and by the persons required by law.
SECTION 11.
The Superintendent of Streets of said City shall immediately cause to
be conspicuously posted along the line of said contemplated work or im-
provement, and in front of all property to be assessed, and along all the
open streets within the above described assessment district, notices of
the passage of this Resolution of Intention in the manner and form required
by law.
SECTION 12.
The City Clerk of said City of Chula Vista is hereby directed to
cause this Resolution of Intention to be published by two insertions in
the manner required by law in said Chula Vista Review and Chula Vista
Star and also printed and posted according to law.
