RESOLUTION OF INTENTION NO. Z O
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF CHULA
VISTA DECLARING ITS INTENTION TO IMPROVE PORTIONS OF SECOND
N AVENUE, THIRD AVENUE, E STREET., F STREET AND SECOND STREET
IN SAID CITY AND.DESCRIBING THE DISTRICT TO BE ASSESSED TO
PAY THE COSTS AND EXPENSES OF SAIL Ib4PROVIMENT.
THE BOARD OF TRUSTEES OF THE CITY OP CHULA VISTA DO RESOLVE AS FOLLOWS:
SECTION ONE.
That the public interest and convenience requiret, and it is the in-
tention of the Board of Trustees of the City of Chula Vista to order the
improvements specifically described in this Resolution of Intention.
SECTION TWO.
The construction of all curbs, gutters, sidewalk, Portland Cement
Concrete Pavement, Warrenite Pavement on Bituminous Base, Standard Guard
Fence, Coping, Skid-stops or any other'iuyrovement described in this Reso-
lution of Intention shall be done in accordance with„11a1 Number 274,
Sheets 1 to 10 inclusive, and in further accordance with Specifications
Number 1, for the construction of curbs, sidewalks, gutters, Portland
Cement Concrete pavement, Warrenite pavement on Bituminous base and standard
guard fence in the City of Chula Vista,"excepting that all curb and sidewalk
shall be constructed in accordance with Decuments No. 1 and No. 2, as set forth
in Ordinance No. 27 of said City.
The grading and paving hereinafter described shall include the grading and
paving of all intersections of streets, avenues, drives, courts and alleys,
included within the limits of the streets and avenues to be improved as described
herein and shown on Plan Number 274.
The construct,.on of all curb, gutters, sidewalk, Portland Cement Concrete
pavement, Warrenite pavement on Bituminous base, or any other improvement des-
cribed in this Resolution of Intention, shall be omitted upon such portions
of the streets and avenues herein described as may be required by law to be .
kept in order or repair by any person or company having railroad tracks thereon.

SECTION THREE
The improvement herein above referred to is as follows, to-wit:
First:
That the center eighteen 118) feet of the roadway of Second Avenue, from
the Northerly boundary line of the City of Chula Vista to the Northerly line
• of D Street be graded and ppvved to the official line amd grade with a Portland
Cement Concrete pavement, five inches (5") in thickness.
Second:
That those portions of the roadways of Second Avenue, E Street, F Street,
Third Avenue and Second Street hereinafter described in parcels A to L in-
clusive, be graded and paved to the official line and grade with a Bituminous
base three (3) inches in thickness, and with a Warrenite Pavement Wearing
Surface, one and one-half (1 1/2) inches in thickness.
Parcels A to L, are described as follows, to-wit:
Parcel A.
The center eighteen (18) feet of the roadway of Second Avenue,
• from the Northerly line of D Street to a line drawn parallel with and
fifteen (15) feet Northerly from the Northerly line of E Street.
Parcel B.
The center eighteen (18) feet of the roadway of fla Street, from
the Easterly line of National Avenue to a line drawn parallel with and
fifteen (15) feet Westerly from the Westerly line of Second Avenue, and from
a line drawn parallel with and fifteen (15) feet Easterly from the Easterly
line of Second Avenue to a line drawn parallel with and twenty (20) feet
Westerly from the Westerly line of Third Avenue.
Parcel C
The following portion of Second Avenue, E Street, and their inter-
section:

the center line of Second Avenue intersects a line drawn fifteen (15) feet
Northerly from and parallel with the Northerly line of E Street; thence
along a curve concave Northwesterly having a •radius of forty-six (46) feet
to an intersection with a line drawn parallel with and fifteen (15) feet
Westerly from the Westerly line of Second Avenue; thence Southerly parallel with
Sedond Avenue eighteen (18) feet; thence along a curve concave Southwesterly
having a radius of forty-six (46) feet to the Southerly line of E Street;
thence Easterly along said Southerly line of E Street twenty-three and two
hundredths (23.02) feet to an intersection with a curve concave Southeasterly
having a radius of forty-six (46) feet; thence along said curve, to an
intersection with a line drawn parallel with and fifteen (15) feet Easterly
from the center line of Second Avenue; thence Northerly
parallel with Second Avenue eighteen (18) feet; thence along a curve con-
cave Northeasterly having a radius of forty-six (46) feet to an intersection
with a line drawn fifteen (15) feet Northerly from and parallel with the
center line of E Street; thence Westerly parallel with E Street eighteen
(18) .feet to the point of beginning.
Parcel D
The center eighteen (181 feet of the roadway of Third Avenue
from a line drawn parallel with and twenty (20) feet Southerly from the South-
erly line of E Street to a line drawn across Third Avenue three hundred
ninety (390) feet Northerly from and parallel with the Northerly line of
F Street.
Parcel E ' • •
All that portion of-the roadway of Third Avenue, described as
follows, to-wit:
Beginning at a point on the Westerly.curb line of Third Avenue at a
point two hundred ninety (290) feet Northerly from the Northerly line of
F Street; thence Northerly in a direct line to a point where a line nine

(9) feet Westerly from the center line of Third Avenue intersects a line drawn
three hundred ninety (390) feet Northerly from and parallel with the North-
erly line of it Street; thence Easterly parallel with the Northerly line of
F Street eighteen (18) feet; thence Southerly in a direct line to a point
on the East curb line of Third Avenue at a point two hundred ninety (290)
feet Northerly from the Northerly line of F Street; thence Westerly parallel
with F Street seventy-two (72) feet to point of beginning.
Parcel F.
All of the roadway of Third Avenue, including all intersections of
streets and alleys, lying between a line drawn parallel with and two hundred
ninety (290) feet Northerly from the Northerly line of F Street and a line
drawn parallel with and three hundred thirty (330) feet Northerly from the
Northerly line of G Street, excepting from said portion of Third Avenue the
following described portions of the roadway of Third Avenue which are to be
reserved for parks, to-wit:
First: Beginning at a point on a line drawn parallel with and nine
(9) feet Westerly from the center line of Third Avenue, distant ten (10)
feet Southerly from the South line of F Street; thence Southerly parallel
with the center line of Third Avenue to a point ten (10) feet Northerly from
the Westerly prolongation across Third Avenue of the Northerly line of Center
Street; thence along a curve to the left concave Northerly having a radius
of ten (10) feet to an intersection with a line drawn parallel with and
eleven (11) feet Easterly from the center line of Third Avenue; thence
Northerly parallel with said center line of Third Avenue to a point ten (10)
feet Southerly from the Westerly prolongation across Third Avenue of the
Southerly line of F Street; thence along a curve to the left, concave
Southerly having a radius of ten (10) feet, to the point of beginning.
Second: Beginning at a point on a line drawn parallel. with and nine
(9) feet Westerly from the center line of Third Avenue, distant ten (10) feet
Southerly from the Easterly prolongation of the Southerly line of Center
Street; thence Southerly parallel with the center line of Third Avenue

Northerly line of Madrona Street; thence along a curve to the left, concave
Northerly, having a radius of ten (10) feet, to an intersection with a line
eleven (11) feet Easterly from and parallel with the center line of Third
Avenue; thence Northerly parallel with said center line of Third Avenue to a
point ten (10) feet Southerly from the Westerly prolongation across Third
Avenue of the Southerly line of Center Street; thence along a curve to

Parcel G.
All of the roadway of Third Avenue described as follows, to-arn.t:

That the center eighteen (18) feet of the roadway of Second Street
from the Easterly line of Second Avenue to a line drawn across Second
Street eight hundred (800) feet Easterly from and parallel with the Easterly

line of National Avenue, be graded and paved to the official line and grade
with a Bituminous base four (4) inches in thickness and with a Warrenite
pavement Wearing Surface one and one-half (1 1/2) inches in thickness.
Fourth:
That cement skid stops shown on the aforereferred to Plans'be constructed
upon Second Avenue from the Southerly line of 0 Street to a point nine hun-
dred (900) feet Southerly therefrom, the outer or street face of said
skid stops being situated nine (9) feet Easterly and Westerly from the
center line of said Avenue.
Fifth:
?� That standard guard fences be constructed upon Second Avenue from a
Qline drawn across Second Avenue twenty (20) feet Southerly from the Northerly
boundary line of the City of Chula Vista to a point nine hundred (900)
feet Southerly therefrom. The outer or street face of said guard fences

That a cement curb be constructed along both lines of the roadway of

across Third Avenue two hundred ninety (290) feet Northerly from and parallel
with the Northerly line of F Street to a line drawn across Third Avenue
three hundred thirty (330) feet Northerly from and parallel with the

The construction of said curbs to include full returns at all street
and alley intersections omitting however such portions of said streets
upon which a cement curb has already been constructed and now exists to
the official line and grade.

Seventh:
That a cement coping of the size and character shown on the aforereferred
to plans be constructed around the two portions of the roadway,deseritsed in
Parcel F, Section 3 hereof, which are to be reserved for parks. The outer
or street face of said coping to be coincident with the exterior boundaries
of said portions of the roadway so reserved.
Eighth:
That a cement sidewalk fifteen and one-half (15 1/2) feet in width be
constructed along the Westerly side of Third Avenue from the Southerly line
of'? Street to the Northerly line of Center Street. The construction of
said sidewalk shall include the construction of full returns at the inter-
section with F Street and Center Street .

At such points as said cement gutters herein referred to cross a street
or alley intersection they shall be constructed to a width of three (3)
feet instead of eighteen (18) inches as specified; but such gutters shall
be omitted across the intersection of Third Avenue with F Street.
SECTION FOUR.
Reference is hereby made to Warrenite License Mixture Agreement of
Warren Brothers Company, dated April 18, 1919, and on file in the office of
the Superintendent of Streets of the City of Chula Vista.
SECTION FIVE.
That said contemplated work or improvement in the opinion of said
Board of Trustees is of mare than local or ordinary public benefit and will
affect and benefit the lands and district hereinafter described, and said
Board of Trustees hereby declares that the district in the said City of Chula
Vista benefited by said work or improvement and to be assessed to pay the
costs and expenses thereof, is described as follows:
All that portion of the City of Chula Vista included within the corporate
limits, excepting therefrom any portion of any public street or alley included
therein:
The following parcels of land included within said assessment district
above mentioned are hereby declared to be in use for the performance of
public functions, and shall be omitted from the assessment hereafter to be
made to cover the costs and expenses of said work or improvement.
The GrAmmar School site; being all except the Easterly thirty (30)
feet of Lot 16, Quarter Section 137. The Public Library site; being
the Westerly 2 2 Q,00feet of the Easterly Zs o.00 feet of Lot 19 of
Quarter Section 137, as said Quarter Section 137 is shown on San Diego
Land and Town Co.'s Map of Chula Vista, as per map No. 505 thereof filed
in the office of the County Recorder of San Diego County, California,
March 13, 1888. The City Hall Site; being Lot 14, Block E of Mohnikes
Subdivision, as per map Number'1284 thereof,filed in the office of the County

Recorder of San Diego County, California, September 12, 1910.
Reference is hereby made to Map Number 275, adopted for said work, in
which the assessment district referred to is shown within red colored
border lines.
SECTION SIR.
The Board of Trustees of the City of Chula Vista determines that serial
bonds shall be issued to represent assessments of twenty-five ($25.00)
dollars or aver for the cost of said work or improvement; said serial bonds
shall extend over a period ending nine (9) years from and after the second
day of January next succeeding the date of said bonds, and en even annual
proportion of the principal sum thereof shall be payable by coupon on the sr
• cond day of January every year after their date until the whole is paid; and
the interest shall be payable semi-ammually by coupon on the second days
of January and July respectively of each year, at the rate of seven (7)
per cent per annum on all sums unpaid until the whole of saSd principal aid
interest are paid. All of the herein proposed mark shall be done in pur-
• seance of an Act of the Legislature of the State of California, designated
as the "Improvement Act of 1911,"approved April 7, 1911, and the amendments
thereto.
SECTION SEVEN.
Notice is hereby given that on the 8A day of May 1919, at the hour
of 7'3o P. M., of said day, at the Council Chamber of the Board of Trustees
of said City of Chula Vista, in the City Hall, situated on the Westerly side
of Third Avenue, just Northerly of F Street in said City, is hereby fixed and
designated as the day, hour and place, when and where any and all persons
having any objections to the proposed work or improvement herein designated,
may appear before said Board of Trustees and show cause if any they have, why
said proposed improvement should not be carried out in accordance with the
provisions of this Resolution of Intention. •

SECTION EIGHT.
The City Engineer is directed to make a diagram of the property affected
or benefited by the proposed work or improvement as described in this Resolution
of Intention and to be assessed to pay the expenses thereof. Such diagram shall
show each separate lot, piece or parcel of land, the area in square feet in
each of said lots, pieces or parcels of land, the relative location of the same
to the work proposed to be done, all within the limits of the assessment dis-
trict.
SECTION NINE.
All Plans referred to in this Resolutioh are on file in the office of
the City Engineer`of the said City. All specifications referred to in this
Resolution are on file in the office of the City Clerk of said City. Said
Plans and Specifications are hereby referred to fora more particular des-
cription of said work and made a part hereof.
SECTION TEN.

The Chula Vista Review a weekly newspapenjof general circulation,
published and circulated in said City of Chula Vista,° s hereby designated
as the newspaperjin which this Resolution of Intention, and notice of the
passage thereof, shall be published in the manner and by the persons required '
by law.
SECTION ELEVEN.
The Superintendent of Streets of said City shall immediately cause to
be conspiculously posted along the line of said contemplated work or improvement,
and in front of all property to be assessed, and along all the open streets
within the above described assessment district, notices of the passage of this
Resolution of Intention in the manner and form required by law.
SECTION TWELVE.
The City Clerk of said City of Chula Vista is hereby directed to cause
this Resolution of Intention to be published by two insertions in the manner
