President of the oard of Trustees of the City of Chula Vista, California. t THIS CONTRACT, entered into on this / day of February, 1919, by and between the CITY OF CHULA VISTA, a munici- pal corporation of the STATE OF OALIFO1INIA, and EDWARD M. LYNCH, a civil engineer of LOS ANGELES, CALIFORNIA, ;'IITNESSETH as follows: That the City of Chula Vista is desirous of securing the pro- fessional services of Edward M. Lynch, for the purpose of having him take charge of certain murk of street improvement upon certain streets that the Board of Trustees intend to order improved in said City, and in consideration of the payment to said Edward M. Lynch of five (5) per cent of the total contract price of said paving, and other improvements upon the completion thereof, said Edward M. Lynch agrees: FIRST. To prepare complete profiles of such streets in the City of Chula Vista, as will be necessary to establish proper grades for the sucessful carrying out of said improvements. SECOND. To prepare all data necessary for the proper establish- went of such official grades as will be necessitated by said improvements. THIRD. To prepare all maps, plans, etc., necessitated by said improvements, and to furnish all legal and other descriptions nreaso- nece�ssa�ry ma r An-tic . FOURTH. To set all stakes, do all engineering work of whatso- ever nature, exercise careful and efficient supervision upon all construction work in such a manner as to fully safeguard the interests of the property owners and the City. FIFTH. To maintain a thoroughly competent and reliable resident engineer, together with necessary assistants in the City of Chula Vista, during the entire period of construction of the im- provements. SIXTH. To prepare complete assessment rolls and maps, representing the total cost of the improvement upon the completion by the con- tractor of said improvements. SEVESITH. To prepare bonds, covering all assessments of twenty-five ($25.00) dollars or more, upon which payment has not been made by '"� the contractor within the time prescribed by law. The City of Chula Vista, however, shall furnish blank assessment rolls and bonds requiredin the work. The purpose of this contract being to obligate said Edward M. Lynch, to perform in a thorough and workmanlike manner, all engineering and inspection services necessary to secure for the City of Chula Vista the best possible improvements for the money expended. The City of Chula Vista, through its -agents, the Board of Trustees, agreeing to pay said Edward M. Lynch, five (5) per cent of the total contract price of the improvements herein referred to. In case said improvements are abandoned for any reason, said City of Chula Vista hereby agrees to reimburse said Edward M. Lynch, for all money actually paid out by him in the performance of his work, no portion of which is to go to him for personal services. Witness our signatures this ivv day of February, 1919.
