Field, George Robertson and Mrs. Louis Ward AL is 01el'o " rw r+.- 4 • . - RESOLUTION NO. --1 WHEREAS, on the 11th day of May, 1914, an action was be- gun before the Railroad Commission of the State of California , by Thomas L. Turner, George Shuman, Martha J. Field , George Robertson and Mrs. Louis 'Ward , against the Sweetwater Water Company, a cor- poration, to comrel said Corporation to supply said complainants , with water for use for domestic purposes upon their lands and -premises situate in -Lot No; 71 of the Ex-Mission Lands of San Diego , in the County of San Diego , State of California, said Lot No . 71 now being a subdivision known as Millerton, and hereinafter called the Millerton Tract; and WHEREAS, the Board of Trustees of the City of Chula Vista , a municipal corporation of the sixth class, upon learning that said action had been begun as aforesaid , did , at a regular meeting of said Board of Trustees, held on the l day of June , 1914 , adopt a resolution directing and instructing the City Attorney of said City of Chula vista to intervene in said action on behalf of said City and its inhabitants , in order that their rights might be pre- served; and WHEREAS , said City of Chula Vista was permitted to file its complaint in intervention in said action by said Railroad Com- mission on the 8th day of July, 1914 , and evidence was thereupon introduced by the complainants in said action in support of their ' complaint ; and WHEREAS, before • any evidence was introduced on behalf of the defendant or on behalf of said City of Chula Vista, the com- plainants did propose to compromise their several difficulties re- lating to the service of water on said Millerton Tract and in the furtherance of said adjustment have submitted a stipulation ( sub- ject to tie approval of said Railroad Commission) , that said Com- mission enter an order in said cause in accordance with the terms and conditions of a certain agreement , which said agreement is in- corporated in said stipulation, and shall , by the terms of said stipulation become a part of the record in said cause , and also that a copy of said a€reement' shall be duly recorded in the office. -1- s . . of the County Recorder of the County of San Diego , State of Calif- ornia; and WHEREAS, by the terms of said agreement it appears that Water . said Sweetwater/Company will not be required to furnish more water to said Millerton bract than is now being required of said Company, and it appears to the Board of Trustees of said City of Chula Vista that said Sweetwater Water Co , is now furnishing water to a tract • -- --' 4f land belonging 'to -one Rent Hamilton,- comer ming 'ten acres of `� ' S land , immediately adjoining said Millerton Tract on the west , and that it is proposed by said agreement to divert the water now used on said Hamilton Tract for use on both the Hamilton Tract and Miller- ton tract , and that the total amount of water to be used on both of said tracts till not exceed ,24iQ 006 gallons in any one year, and that said water shall be used exclusively for domestic purposes and not for acre irrigation, and that said water shall be furnished only to actual residents on said tracts; and WHEREAS , the Board of Trustees of said City of Chula Vista. __ being fully advised in the premises, deems it for the best interests of said City and its inhabitants , to accept said proposed agreement of compromise and to enter said stipulation; BE IT RESOLVED by the board of Trustees. of the City of Chula Vista , California, that the C4.ty Attorney of said City of Chula Vista be and he is hereby authorized and directed to egree to and sign said stipulation on behalf of said City of Chula Vista, intervenor in said case .
