HomeMy WebLinkAboutReso 1914-8-H RESOLUTION #8-H Original Resolution Missing Excerpt from minutes of Board of Trustees Meeting of April 16, 1914 On motion duly seconded, the following Resolution was adopted: Whereas, the C.L.Hyde Construction Company has been awarded two certain contracts for the grading and surfacing of certain streets in the City of Chula Vista dated respectively, February 3, 1914, and April 16, 1914, and whereas by reason of the fact that said Construction Company, has been delayed and hindered in the performance of said contracts by reason of the failure of the San Diego & Southeastern Tailway Company, to move its poles from certain of said streets to be so improved, and by reason of the failure of the Sweetwater Water Company and the San Diego Consolidated Gas & Electric Company, to lower their pipes and mains in certain of said streets, which lowering is necessary in order to permit the performance and completion of said work; and whereas the said Construction Company was compelled to remove a portion of its grading outfit from said work to other work on the 27th day of March, 1914; and whereas said poles have not yet been removed from said streets and said pipes and mains have not yet been lowered therein, so as to permit the working of said streets under said contract; Now therefore, be it resolved that the time fixed in and by said contracts for the performance and completion of the said work is hereby extended for such length of time as shall correspond with the length of time that said Hyde Construction Company has so unavoidably and without fault on its part been delayed in the completion of said work by reason of the failure of said companies as aforesaid to remove their poles and pipes and mains from said streets so as to permit the further work and completion of said roads under said contract; such extension of time not to exceed however the period of forty days in all. The Resolution is adopted, all voting aye.
