WHEREAyS, on the 18th day- of October, 1927p this City
Council of the ,City of Chula Vista, California, proceeding under
the provisions of the "Acquisition and Improvement- Act of 1925, "
duly passed and adopted its Resolution of Intention in the above
entitled tatter, to order certain work to be done as therein
fully described; and
WHEREAS, said Resolution was duly published twice in
"The Chula Vista Star, " the newspaper designated in the said
Resolution as the newspaper in which the same should be publish-
ed, said publications having been made on the 21st and 28th days
of October, 1927, which said facts appear from the affidavit of
the Publisher Of said newspaper on file herein; and
WHEREAS, on the 22nd day of October, 1927, the Super-
intendent of Work heretofore appointed by this Council in the
above numbered Acquisition and Improvement District, cauged to
"be conspicuously posted along the line of the work described
' in the said ,Reaolution of Intention, at not''more thap,• three
hundred (300) feet in distance apart, and not less than three
(3 ) in all, notices of the, adoption of said Resolution in the
manner and form required bylaw, which said facts appear from
the affidavit of the said, Superintendent of Work on file herein;
and
WHEREAS, at the time and, place in the said Resolution
of Intention, specified, a full, fair and impartial hearing was
accorded all persona having any objections to the things proposed
to be done as set forth in said Resolution; and

WHEREAS, thereupon this Council adopted its Resolution !
passing upon all protests presented, both written and oral, and
made its final determination as to the boundaries of the assess-
.
ment district , the zones into which said district is to be
divided, the percentages to be raised from each of said zones,
and the grades to which the contemplated work and improvements
are- to be constructed, reference 'to which said Resolution is
hereby made; and
WHEREAS, the Board of Supervisors of the County of
San Diego, California, pursuant to the request of this Council
therefor, has passed and adopted a formal Resolution consenting
to this Council assuming full jurisdiction over and ordering the
improvement of portions of Sixth Avenue and L Street where the
same join the unincorporated territory of the County of San
Diego, and to the assessment of the p' operty in the said County
which, in the judgment of this Council, will be benefited
thereby, a certified copy of which said Resolution has been
filed with the Clerk of this Council; and
WHEREAS, evidence has been received as to the
necessity for the improvements contemplated, and the benefits
to be derived therefrom;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MLA- VISTA, CALIFORNIA, PROCEEDING UNDER AND BY
VIRTUE OF THE SAID "ACQUISITION AND IMPROVEMENT ACT OF 1925, "
AND IT IS HEREBY FOUND, DETERMINED, AND ORDERED AS FOLLOWS:
Section 1.
That the said Resolution of Intention
has been duly and legally published as required by law, and that
the Notices of Public Improvement therein directed to be posted,
have been duly and legally posted in the time, form, manner, and
number as required by law; that all protests or objections pre-
sented have been disposed of, in time, form and manner as

required by law; and that this Council has now acquired juris-
diction to orler the things proposed to be done as set forth in
the said Resolution of Intention.
Section 2.
That the public interest and necessity
require, and TT IS HEREBY ORDERED that the improvements and work
described in the said Resolution of Intention, and in the plans,
profiles, detail drawings, and specifications therein referred
to, be made and done.
Section 3.
That Tuesday, the .7. day of November,

1927, at the hour of o'clock, P.M., of said day, is
hereby fixed as the time for receiving bids for the doing of said
work and improvements , and the Clerk of this Council is hereby
directed to give notice accordingly inviting sealed bids for the
doing of the same, by publishing a notice inviting such sealed
bids by at least two insertions in the "Chula Vista Star, " and by
posting, and keeping posted for five days at or .near the chamber. ' ' \ °0

of this"Council, all as required by the provisions of Section 12
of said "Acquisition and Improvement Act of 1925."
Section 4.
That Three Thousand Dollars' ($3,000.00 )
of the expense of the grading and paving of titeamthd Country
Club Drive, between the Easterly 22 feet of 5th Avenue
and the .Westerly termination of said Drive in K Street, and the
said K Street, between the said termination and 3rd Avenue,
together with a portion of the intersection of the said K Street
with said 3rd Avenue, shall be paid out of the Treasury of the
City of Chula Vista from the general fund thereof.
Section 5.
That to defray the expenses of the work'
and improvements herein ordered, bonds will be issued in accor-
dance with the provisions of the said Act, to the total amount
of the same, excepting the amount to be contributed thereto by
the City as' aforesaid, said bonds to bear interest at the .rate

of seven per cent (7$) .per annum, payable semi-annually, the
first interest payment to be made on the second day' of January

or the second day of July (whichever month first succeeds the
date of the bonds ) next succeeding one year after the date of
such bonds, and the aggregate principal of all bonds issued
under the proceeding to be paid and -discharged within fifteen
(15 ) years after the date of issuance , approximately one-
eleventh (111 ) part of said aggregate principal to be paid
annually; all in. gold coin, and the first payment on the
aggregate' :principal of the bonds issued will be made five 15 )
years after the issuance thereof.
Section 6.
That a special fund for the payment of
said bonds will be constituted by the levy of special assess-
ment taxes upon the lands within the assessment district,
according to the assessed value of said lands, exclusive of
the improvements thereon, except as otherwise provided in the
Act hereinbef ore mentioned, and in accordance with the zones
and percentages as heretofore finally determined by this
Council, which said district shall be known as "Acquisition
and Improvement District No. 1 of the City of Chula Vista,
California."
Passed and adopted by the said City Council of the City of
Chula Vista, California, this 8th day of November, 1927, by the
