BOARD OF TRUSTEES AND
RESOLUTION DETERMINING THE APPEAL TO TREACITY COUNCIL FROM THE STREET SUPERINTEN-
DENT'S ASSESSMENT AND DIAGRAM IN THE MATTER OF TEE SEWER PROCEEDING TAKEN UNDER
RESOLUTION OF INTENTION TTNo.gg 163, AAINN THEE CITY OF CHULA VISTA, CALIFORNIA.
• BE IT RESOLVED BAY M O ITY COUNCIL of the City of Chula Vista, California,
as follows:
That due and proper notice has been given in the manner and form required
by lee 0f the filing with the City Clerk of the Assessment and Diagram to cover the
costs and expenses and stmt due for the Sewer System constructed in portions of G
and other streets in `the City of Chula Vista, California, under Resolution of Intention
No. 163, and adopted by this Board October 5, 1926.
That certain persons, hereinafter specified, and none others, have filed
written appeals to this Board from said Assessment and Diagram, to-wit: T. L. Edmund-
son and others, M. E. Lafollette and others, San Diego and Arizona Railway Company.
Upon the said hearing a full and fair opportunity was given all persons appealing
to said Board to present the grounds of their appeal.
That each and every of said written appeals, be and the same is, and all of
them are, hereby denied.
That upon the hearing of said appeal, it appears to this Board that certain
of the assessments set forth in said assessment, and diagram, so filed with said
City Clerk, are erroneous, and unjust and should be corrected and amended; now,
therefore, and to that end, -
IT IS YuRTHER RESOLVE], that Assessment No. 5, in the matter of said Sewer
work and improvment on said G and other Streets, in said City of Chula Vista, be
and said assessment is hereby modified in the following particulars, and no other,
to-wit:
The amount represented by Assessment No. 293, is changed from $118.69 to
$127.82.
The amount represented by Assessment No. 1153, is changed from $63.91 to •
$54.78.
The amount represented by Assessment No. 1151, is changed from $63.91 to
$54.78.
The amount represented by Assessment No. 295, is changed from $118.69 to
$127.82.
The amount represented by Assessment No. 279, is changed from $73.04 to

Upon.the hearing of said appeal and examination by this Board of the said assessment
and diagram, it farther appears, and this 'Board finds, that the Street Superintendent
has omitted from the incidental expenses, certain of the costs of printing and publi-
cation incurred and expended in connection with this improvement in the sum of One
Hundred and Twenty-seven Dollars and Ninety-two Cents, ($127.92), such finding and
determination being based upon the examination of the proceedings and evidence sub-
' mitted to the Board by the Street Superintendent, City Engineer and City Clerk.
Following such determination and as a part of'said hearing, the Board examined each
and all of the said assessments, and in making the changes in said assessments spec-
ified and ordered in this Resolution, the said Board considered the true and correct
total amout of the costs and expenses of such work, including the true amount of
incidental expenses, to-wit: The sum of Seventy-nine Thousand, Four Hundred and Thirty-
one Dollars and Seventy-four Cents, ($79,431.74), and in arriving at said changes and
modifications, examined the assessment upon each of the several pieces, parcels, lots,
or portions of lots benetitted, and fixed the amouht which each of such lots should
pay, respectively, in proportion to the estimated benefits received by each, having
in view the true and correct amount of such assessment as now determined by this
Board, including the proper item of incidentalexpenses.
It is further ordered that Assessment No. 1055 shall be amended so as to be
againstthe North Half of Lot 16, in Block E, of Mohnike's Subdivision, and that the
diagram attached to said assessment be amended to conform thereto, and that the por-

of the South Half of Lot 16, in Block E, of 'Mohkike's Subdivision, shall be given a
new number, to-wit: Assessment No. 1198, and the diagram shall be amended to con-
form thereto.
BE IT FURTHER RESOLVED, that the Superintendent of Streets of-laid city be,
and he is hereby authorized and directed to amend and modify the original Assessment
No. 5, to conform to the modifications thereof as herinabove determined.
In all other reppects, all appeals are denied.
