HomeMy WebLinkAboutReso 1992-16614 NOT APPROVED RESOLUTION NO. 16614 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING CHANGES TO THE IN-LIEU PARKING FEE POLICY TO ESTABLISH A NEW FORMULA AND IMPLEMENTING THE RESULTING FEE INCREASE IN TWO PHASES WHEREAS, Section 19.62.040 of the Chula Vista Municipal Code states that the In-Lieu Parking Fee is based upon twenty-five percent (254) of the fair market value of that portion of the property which would have been required to be developed for parking purposes; and, WHEREAS, for the purpose of determining the amount of the fee the City Council adopted the In-Lieu Parking Fee Policy which contains the formula that determines said fee; and, WHEREAS, it has been determined that changes in market conditions and City requirements require that several changes be made to the In-Lieu Parking Fee Policy as follow: 1. Increase the land area required to construct a parking space from 350 square feet to 406 square feet. 2. Increase the fair market value of land for the purpose of determining the In-Lieu Parking Fee from $20 per square foot to $25 per square foot. 3. Add a factor to reflect the City's cost of construction of the required parking spaces and require that the developer pay for one- half (1/2) of this cost. The figure used to determine the fee should be $4,362 per parking space. WHEREAS, in response to the need for changes, a revised In-Lieu Parking Fee Policy has been developed and it is hereby attached to this resolution as Exhibit A; and, WHEREAS, the resulting fee from this policy is $4,670 per parking space; WHEREAS, it has also been determined that it will be more appropriate to apply the fee increase resulting from the new formula in two phases; and, WHEREAS, this resolution was adopted at a duly noticed and held public meeting of the City Council. THE CITY COUNCIL OF THE CITY OF CHULA VISTA does hereby resolve: 1. Approves the changes to the In-Lieu Parking Fee Policy and approves the new policy attached as Exhibit A for the purpose of determining the In-Lieu Parking Fee; and, Resolution No. 16614 Page 2 2. Approves the implementation of the resulting fee in two phases as follows: a.From July 1, 1992 to June 30, 1993, the In-Lieu Parking Fee will be $3,210 per parking space. b. As of July 1, 1993, the fee will be $4,670 per parking space until the Agency and City Council determine that it is necessary to change this amount. Any developer of a new commercial building within the Downtown Parking D~slzict, in Subarea 1 of the Chula Vista Town Centre No. I Project Azea, except for the lands situated within the Townsit~ Focus Area, or any developer of an addition to an existing comm~&al building therein, s~all pay an In-I~eu Parking Fee to the City of Chula V'~a prior to the issuance of a Building Pennit for such new building or addition. 2. The In-Lieu Parking Fee, which shall be computed by the Director of Finance in each applicable case, is predicated upon one-fourth of the fair market value of the land which the developer would normally be required to devote to off-street parking plus one-half of the City's cost of construction of said potking, and shall be based upon the following formula: In-Lieu Fee ($) -- No. of required spaces x 350 x fair market value of land ($/3c1. Ft.) + One-half of the City's cost of Construction No. of Required Spaces = 0if-street parking spaces re~luired for a new building or addition under the City of Chnia Vista's zoning regulations, if the building or gidition were not within the Downtown Parking District. 350 -- The square footage of a standard parking space and its sppurtenant maneuvering area, landscaping, and driveways. Fair Market Value: Recently appraised or estimated value. Where acceptable to the developer, the Director of Finance shall accept $10 per square foot as the fair market value of conm~ercial land within the Town C.~tre No. I PrOject Area. If an appraisal is required, the developer shall pay the cost of such. The In-Lieu Parking Fee Policy i~, not applicable to development within the townsite Focus A~ca. 5. The Director of Community Development shall have the continuing responm'bility of monitoring land values within the Town Centre Project Area, and of recommending changes in the In~Lien Fee's formula, where such are in&cated.
