NEWSPAPER OF SAID CITY AND FIXING AMOUNT OF
THE BOND.
WHEREAS, San Diego Electric Railway Company, a cor-
poration, on M 74 , 1945 , filed a written applica-
tion to the Council of the City of Chula Vista for the grant
to it of the franchise and authority to operate automobile
busses, stages, and/or other self-propelled vehicles for the
transportation of passengers for hire along and upon certain
streets, in the City of Chula Vista, the term of said fran-
chise so applied for to commence upon the effective date of
the ordinance of final grant and to continue to the 10th day
of November, 1973, which said application is on file with the
City Clerk' of the City of "2 and is marked in the files

WHEREAS, upon due consideration of said application
said Council has determined that it is for the best interests
of said City that such franchise and authority be granted,
and that the said Council proposes to grant thernsame ; NOW,
BEFORE,
BE IT RESOLVED by the Council of the City of Chula
Vista, as follows:
That it is now determined that such franchise and
authority shall be granted for the period named and as applied

for in said application.
That the City Clerk be, and he is hereby directed
to advertise the fact of said application, together with a
statement that it is proposed to grant the same as applied
for and stating that bids will be received for auch fran-
chise and authority, and that it will be sold, struck off and
awarded to the highest cash bidder therefor , by publication
in the official newspaper of said City, to wit: THE CHULA
VISTA STAR, once a week for four successive weeks; and said
City Clerk is hereby further directed to sign said notice
and advertisement and to state in said notice the character of
said franchise and authority proposed to be granted, the terms
for which it is to be granted as to each route, and the route
to be traversed; and that sealed bids therefor will be received
up to the hour of *47 o f clock 7) E. , on Nh,bici-y , 7 - day
of % , 1945, when in open session said Council
will open and publicly declare all bids; and that the
successful bidder and assigns must during the life of said
franchise pay to said City two per centurm (2%) of the gross an-
nual receipts of the person, partnership or corporation to whom
the franchise is awarded arising from its use, operation or
possession, such percentage to be payable annually, and to com-
mence to accrue from the date of taking effect of the ordinance
granting the franchise; and that the successful bidder :will
be required to file a bond running to the City of Chula Vista,
with at least two good and sufficient sureties, to be approved by
the City Council, in the penal sum of One Thousand (41000.00) Dol-

lars, conditioned that such bidder ' shall well and truly observe,
fulfill and perform each and every term and condition of such

franchise, and that in case of any breach of condition
of such bond, the whole amount of the penal sum therein
named shall be taken and deemed to be liquidated damages
and shall be recoverable from the principal and sureties
upon said bond. Said advertisement shall also contain and
set forth all other matters and things required by law.
PASSED AND ADOPTED by the City Council of the City of Chula Vista
this 14th. day a., , 1945, by the following vote:
